The Finance Director will review in detail cost necessary to imple- ment three additional positions in the Planning Department. (Agenda ttachment 11) 7. January 23, 1978 2. • 3. The County Attorney informed the Board that they needed to resolve tc 4. provide a defense for each individual Commissioner, and to indemnify in the 5- event there is any judgment against any Commissioner . Mr. Gledhill stated I6 • that he had bee in touch with the Great American Insurance Company, and 7. according to the Regional Claims Manager and the investigator for the 8 . Insurance Compa�y, the policy the County is covered under is not an error 9 . and omissions pe'olicy, but a property damage liability policy. The Insurar, 10 . Company has alrad Y obtain counsel to handl e th is case and will not honor 11. the request of the County Attorney' s law firm to represent the County. 12. The County Attorney will stay in touch and mbhtor the situation for the 13. County. 14. Commissioner Pinney raised the question of why the County was not 15. covered, when it had paid money for a policy. 16. Mr. Gledhill stated that the people from whom the policy was purchase 17. are not aliens f I r the company that writes the policy, and for that reason 18. their failure t acquire this coverage is not something by which the Compa 19. can be bound. Any action the Board wishes to take against any insurance 20 . company should b e against Collier and Cobb. 21 . Mr. Gledhil stated that in his opinion the County could not be liabl, 22 . in excess of $25 ,000. The County Commissioners are covered under the 23. County's liability policy with Great American Insurance Company up to 24 . $250,000 for pro erty damage. This is the policy that is responding to 25 . the suit. 26 . Mr. Gledhill stated that the resolution which he presented to the Boa= 27. gave to the Coun y Attorney specific authorization to defend the Commis-- 28. sioners in this .litigation, and to make sure that action taken in the suit 29. happens within t e limits of the policy. 30. The Orange County Board of Commissioners met in special session on 6. Tuesday, January 24, 1978 , at 6 :00 p.m. , in the Culbreth Library of the 7. Grey Culbreth Junior High School. in Chapel. Hill, N. C. 8. Present were Chairman Richard Whitted, Commissioners Norman Gustavese 9. Jan Pinney, Norman Walker, and Donald Will.hoit. 10. Staff personnel present were S . M. Gattis, County Manage' and Neal 13,. Evans, County Finance Officer. 12. The purpose of the meeting was to consider a resolution, prepared by 13. the County Attorney, regarding the sale of $6,000,000 School Bonds . 14 . The County Manager informed the Board the necessary documents had not 1,5 . en recieved from Bond Couns6l , and suggested the meeting be adjourned to 16 . another time. 1.7. Upon motion of Commissioner Pinney, seconded by Commissioner Gustaves+ 18 . it was moved and adopted to adjourn this meeting to meet again on Friday, _19 . Present: Commissioners Norman Gustaveson Jan Pinney, Norman Walker, Richard Whitted, and Donald Willhoit. Absent : None The Chairman announced that this was the hour and day fix by the Board of Commissioners for the Public Hearing on the Preliminary Assessment Role filed with the Clerk of the Board of Commissioners of Orange County pursuant to the direction of the Orange County Board of Commissioners and pursuant to the Board ' s decision to finance a portion of the local share of the cost of paving Bayberry Drive, Azalea Drive , and Azalea Place , roads locate in Section I of Morgan Creek Hills Subdivision in Chapel Hill. Township, Orange County, North Carolina. The Chairman also announced that the Board of Commissioners would immediately hear anyone who might wish to be heard on the Preliminary Assessment Role. r. Don. Francisco advised the Board that the Department of Transportation had raised a question concerning inclusion of Azalea Place in the project. Planning Page 3 NORTH CAROLINA AN ORDINANCE AND RESOLUTION TO CREATES A RECREATION APIA ORANGE COUNTY PARKS COUNCIL OIL ORANGE COUNTY WHEREAS , by virtue of Article Twelve (I2) of Chapter One Hundred Sixty (160) of the General Statues of North Carolina, provides legalistic authority for the County of Orange to create an Or�gi �oun y Recreation and parks Council , and whereas, in its considered Judgment , the Board of County Commissioners of Orange County believe that adequate recreation programs and facilities can best be advanced by establishing the recreation system under the supervision and direction of a Recreation Council as authorized by General Statues One Hundred Sixty-One Hundred Sixty (160 - 160) and other statutes and case law -of North Carolina ; now, therefore , be it ordained and re- solved by the County Commissioners of Orange County, North Carolina, as follows , to wit : ARTICLE I :- RECREATION, GENERAL SECTION I: PREAMBLE WHEREAS, the State of North Carolina General Assembly has indicated; That the lack of an adequate recreation program and facilities is a menace to the morals, happiness and welfare of the people of this state in time of peace as well as in times of war; that making available recreation opportunities- for citizens of all ages is a subject of general interest and that recreation is a function requiring appropriate action by the governing bodies of the several political: subdivisions of the state. In planned recreation per units of participation and in breadth and depth of choice , the cost is relatively low. 5. The local governmental unit gives permanence and continuity -to recreation . 6. The local governmental unit cannot afford not to provide recreation, for -money spent for recreation is , in reality invested in ,citizeas ' health and happiness .as .well as in increased and longer retained_real_e�_tRvalu �;l —a--rrce to w 3c industry is increasingly drawn, and which gives important help in securing and in holding business , tourists and other industry in a community. 7 . The non—revenue producing as well as the self--supporting recreation activities are an actual economy for they bring about a directly tra�cabl.e reduction in the cost of policing, crime prevention, operation of emergency and mental health wards (in hospitals) and contribute to other economic facets of the unit ' s health and welfare concerns . THEREFORE, the County of Orange hereby invests its Recreation Council with the duty , authority and responsibility to assist in creating opportunity for citizen participation in recreation. as specified in this, its recreation ordinance , and legal name shall be , Orange County Recreation and Parks Council. SECTION'_II : DEFINITION OF RECREATION ACTIVITIES For the purpose of this ordinan�(ei, recreation is defined to mean those activities which fall within the general classification a;')eas of ; the arts ; drama ; crafts ; athletics ; sports and P games ; dance ; hobbies ; music; nature and outing; reading; writing; linquistics; social recreation ; special community events and special activities ; volunteer services : rPv-ant*q _ -SECTION :III: DEFINITION OF RECREATION AREAS : STRUCTURES : -UNITS MANAGER; GOVERNING BODY Structures and Areas, for the purpose of this ordinance, are defined to mean the outdoor and indoor areas and -structures :on- or in which people derive opportunity for the pursuit of happi- ness :through recreation,::whether -or riot these areas and structures are owned,. Leased, borrowed , controlled -or operated -within the boundaries of Orange County. Unit, for the purpose of 'this. ordi.'nance, means the County of orange. Mann er., for .the purpose of, this ordinance, means the administrator whether he is the County Manager, or another person to whom is delegated the administrative duties and responsibilities of the unit. GoVerning. Bow, .for the -purpo.se of .this ordinance, means the County Hoard of Commissioners . Council.,. for the purpose of. this ordinance,. -means the Advisory Recreation Body to the Department Manager and Governing Body. SECTION IV: POWERS, GENERAL It is tbe;. basic function of the_.. Ithe Department of...,Recreation and Parks. and.. its Council are authorized to aid and assist. agencies (in line with reasonable and legally correct policies recommended by the Recreat: Council and accepted by the unit) which include public ; private ; commercial. ; those which are quasi-public in character , and which, although -public in nature, are not- under the unit 's govern' , churches ,- hospitals ,. military installations , orphanages., commercial ing body (suet. as schools recreation, business and industrial_ agencies) ; as well. as civic , neighborhood and service groups in their recreation interests and needs ._ Page 7 ARTICLE Tl ; RECREATION COUNCIL SECTION y: CREATION: NAME: NUMBER OF MEMBERS There is hereby created an. Orange County Recreation and Parks. Council composed of twenty 'Ewo (22) citizens of Orange County, to be known -as the Orange County Recreation and Parks Council. SECTION 'Vx ; COUNCIL: POWERS AND DUTIES The Recreation Council shall serve as the advisory- body for the Department of Recreation and Parks and the unit . The Council shall suggest policies to the Department , the Manager, and the Governing Body, within its pourers and responsibilities as stated in this ordinance . The Council shall serve as a liaison between the Department, the Manager, the Governing Body of the unit and citizens of the community. The Council shall, consult with and advise the Department , the Manager and the Governing Body in matters affecting recreation policies , program, personnel., finances , and the acquisition and disposal of lands and properties related to the total community recreation program, and to its long--range planning for recreation, The Recreation Council shall assume duties for recreation purposes as follows : Make recommen- dation; (1) for the establishment of a system of supervised recreation for the unit ; (2) to set i apart for use as parks, playgrounds, recreation centers , water areas, or other recreation areas and structures, any lands or buildings owned 'by or leased to the unit , and for approval by the units authorized body, and may sugglVt improvements of such lands and .for the construction and for the equipping and staffing of s, ch buildings and structures as may be necessary to the recrea- tion program within those funds allocated to the Department ; (3) and advise .in the acquisition as provided by Chapter 40, eminent domain# of the Qeneral 5tsruLes oz NUE6LL 1,aLV1_ LL= MLLu -- of the Governing Body , may approved by the Governing Body of the unit ; (4) and advise with the approval. in the acceptance by the unit and, accept an rent , gift, bequest , or donation, any p Y gi .I i personal or real property offered or made available for recreation purposes and which is judged to be of present or possible future use for recreation. Any gift , bequest of money or other property, any grant , devise of real or personal property so acquired shall be held, by the Depart- ment, used and finally disposed of in accordance with the terms under which such- grant , gift or, devise is made and accepted; (5) and advise in the construction, equipping , operation, and main- tenance of parks, playgrounds, recreation centers and all buildings and structures necessary or useful to department function, and will advise in regard to other recreation facilities which are owned or controlled by the unit or leased or loaned, to the unit . SECTION VII: APOINTMENT OF THE COUNCIL Each member of the Council shall be a legal bonified county resident appointed by -the Orange County Board of Commissioners with recommendations being forwarded from the Recreation Council . i ' SECTION VIII: COMPOSITION A member of the Governing Body of the Orange County Board of commissioners .shall be designate( one (1) of the twenty-two(22) citizens appointed as Council Members. Two(2) of the twenty-two (22) citizens shall be designated as representatives of each of the public school boards . Two (2) of the twenty-two (22) citizens shall be designated as representatives of each of the municipal recreation commissions. Three(3) of the twenty--two (22) citizens shall be designated municipal Jay persons rage 9 each representing one (1) of the three (3) .municipalities. The remaining fourteen (14) shall represent townships (two (2) per t4Wnship) . Council analysis ; Bingham Township - 2 ; Cedar Grove Township - 2 ; Hillsborough Township - 2 ; Eno Township - 2 ; Little River Township - 2 ; Cheeks Township 2; Chapel Hill Township - 2 ; Governing Body Representative - 1; School Boards - 2 ; Recreation Commissions - 2; Municipalities - 3 . SECTION IX; LENGTH OF APPOINTMENT Each member shall be -appointed for a three (3) year term, Initial appointments shall be arranged so that approximately one-third "1/3) of the terms will expire each year, except for the representative from the Orange County Board of Commissioners who shall serve on the Recreation Council concurrent with his or her term of office on the Board of Commissioners . No other member may serve more than two (2) consecutive terms of office , or six (6) years without a one (1) year break in service after this time period. SECTION X; MEETINGS Council meetings shall be held on a monthly basis unless when determined otherwise by the Council, The Chairman of the Council or, in his absense, the Vice-Chairman, may call a special meeting of the Council at any time by giving each member twenty-four (24) hours notice. Special meetings' will be scheduled upon request by four (4) or more Council members. A quorum of the Council shall be in attendance before action of an official nature can be taken. A quorum is at least vne (1) or more than the number absent , of appointed members. 'Following two (2) conse- cutive unexcused absences , or .a ttsta3. of three (3) unexcused absences during the year, of one of its members, the Council shall recommend a minimum of two (2) -nominees for each delinquent seat to the Governing Body. These nominees shall represent the same geographic areas as those being-.:replaced.. .. Attachment No. 3 is from .Tack knight, State Re- gional. Sanitarian; this detailed breakdown shows we need 3. 5 Sanitarians to meet aUr present sanitation.reEired_work load. This attachment also shores what we are and are not able to do. {We are ther fore requesting that we start now with fund under expenditures to staff this effort. Attachment No. 4, top part , gives the cost factor (short and long term) of the 1equested additional sanitation staff (due to the balancing of needs against funds available we are only requesting 3 additional sanitation staff at this time). There are three main reasons why we need to get started on this staffing nnx: 1. The inimal required work for orange County's environmental health considerations is of going to be accomplished this year , thereby impacting the present and future problems. 2. If ue are able to actually hire Sanitarian 11's, they will be non- functional (carry less than a full load) for at least two to three months. if we can only recruit a licensed Sanitarian I's they will not be functional for at least three to four rriont s. If we have to hire new graduates they would not be functional, for five to six Tao the_ New graduates are required to spend 30 days away from the Agency at a trai.ni 8 site, plus they cannot function after that until trained also by the local, agency and lastly they must be certified by the State District Sani- tarian. Robinson; The foll firing sanitation program study and evaluation has been compiled to give you an updated report of the workload of the environ- mental health staff during 1977_ This reporting procedure is done on a standard form that is used by our Branch to help the local health departments e al,uate the number of sanita.rians that are needed for their envire ental health program. The workload of the sanitarian,s has been comp led in estimated man-days required to perform the activities which are the responsibility of their section. Reports were prepared in both April, and May of 1977 for the board of health whilh showed the percentage of coverage of inspections iu the food and lodging program and the number of estimated man-days required for hat program and the environmental program. This final report indictdes that the workload was even heavier than had been predicted in May of 1977. The heavy demand on the sa.nitarians to handle the numerous requests concerning evaluations of proposed building sites prevented the sani.tarians from spending adequate time on the food and lodging program. There is a tremendous need to improve the amount of time:,spent on the food and lodging pro-ram to ensure that, the degree of sanitation in the food estab- lislatents is satisfactory. The longer this Program is neglected, the more difficulfi. it will be to develop and improve this phase of the envi,rornnenta.l health program. If the d mands on the sanitarians continue to grow as they have Cp during, 1971, he quality of their work can be expected to decrease unless �Ir. January,_ 1978 AGENDA ATTACHMENT III FUNDING CERTAIN EMS EQUIPMENT THROUGH 1203 PLANNING GRANTS Funds are currently available to acquire emergency medical services equipment through the 1203 Equipment Grant Program. A local match is required if application for 1203 Grants is made. In lieu of actual cash match the State Office will accent certification that the County has spent a specific sum for emergency medical services. Our current budget for Emergency Medical Services exceeds $130,000. The County Rescue Squads have filed with me a list of their equipment needs. I am requesting the County be allowed to certify an expenditure for emergency medical services in order that this equipment might be obtained r-ee of local match.
