Represen latives of Peat, Marwick and Mitchell , the County's auditing irm, wi 1 l review the 1976-197'7 audit. V 7. The Mana r recommends the tax refunds listed in Agenda Attachment II be approve d. (Agenda Attachment II) 8. The Social Services Board has requested the Board of County Commissioners provide a additional appropriation of $10,000 to. their general assistance fund. AGENDA ATTACHMENT IV AUTOMOBILE BIDS The Mangler submitted a report of bid results and a recommendation concerning tie acquisition of six police vehicles at the Board meeting of November 7th. Further discussion of the recommendation with the Sheriff has lead to a modified recommendation from the Manager. Since the Sheriff feels the cars proposed by the low bidder were not as satisfactory as for police patrol work as those proposed by the next low bi der, the Manager is submitting a new recommendation. Counsel and Butch Gunnells , Counsel for Intergovern- mental Affairs DATE: November 14, 1977 RE: County Enforcement of New Insulation and Energy Conservation Standards in the State Building Code The 1977 General Assembly enacted two laws which make counties and municipalities responsible for enforcement of new provisions in the State Building Code requiring insulation and efficient energy utilization in buildings. Enforcement of these new energy conservation standards is required, whether or not the county currently enforces other portions n t e 5tat� Building Code. Chapter 703 of the 1977 Session Laws �ge ��unty and Flty to �ignate by Septe mberll977 the person( responsible for enforcing these newly enacted energy conserva- tion standards in the State Building Code. In each county which already has an inspection department, the superintendent makes the designation. In each county without an inspection d p art ment, the board of county commissioners designates one or more "'energy and insulation inspectors" and notifies the State Department. of Insurance as to the selection. Chapter 703 further provides that, on and after January l; 1978, no person, firm, or corporation may for a consideration install any insulation or other energy coniservation materials or equipment intended to meet the State Building requirements until a rmit has been secured from the designated county or eft—y enforcement j „official. This law also provides that a permit can be issued { only to a licensed contractor or to the holder of an annual license issued by the county or city with jurisdiction over the site. A separate law, Cha ter 792 , sec. 7 of the 1.977 Session Laws, provides that on and 3anuary 1, 19782 no new residential building shall be occupied until it has-.-been certified as being in compliance with the :Minimum insulation standards for residential construction enacted in the State Building Code. Be aware also that Chapter 703 is currently scheduled to terminate on July 1, 1.979, but the 1979 General Assembly is authorized to review experience under the law and enact further legislation on the subject as appears desirable. DRAFT AGENDA ATTACHMENT VI 1.1/14/77 - AN ORDINANCE TO LICENSE INSULATION CONTRACTORS AND OTHERS WHO INSTALL MA.TERI AND EQUIPMENT DESIGNED TO MEET THE ENERGY CONSERVATION STANDARDS ' OF THE STAT BUILDING CODE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF Section 1. Authority. This ordinance is adopted pursuant to Chapter 703, North Carolina Sessi Laws of 1977, and G. S. 153A-134. Section 2. License Re uc fired. On and after January 1, 1978, no person, firm or corporation may for a consideration install, alter or restore, within any unincorporated part of County and within any' city which adopts this ordinance pursu; to the aut ority granted in G. S. 1,53A-122, any insulation or other material: or energy utilization equipment designed or intended to meet the State' Buil.d. Code requirements for insulation and energy utilization standards who is not either: (a) licensed as a contractor to do the proposed work under Chapter 8; of the General. Statutes; (b) working under the supervision of a registered architect or professional. engineer; (c) an owner working upon his own building; or (d) licensed under this ordinance. Section 3. Applications. Every person desiring a license under this ordinance shall submit an application for such license to the (clerk of the Board of County Commissioners) (building inspector) (tax collector)-T other official) conforming to the following requirements: (1) Form of Application. Each application shall be a written statement upon firms provided by the (designated official.) . (2) Contents of _Application. (a) The (dlsignated board or officer) may suspend or revoke any license issued hereunder at any time upon a showing that the applicant or any employee, partner, officer, or director of the applicant has: (a) knowingly made a false statement in the application for a license; or (b) violated the State Building Code requirements as to insulation or energy utilization equipment or materials , whether in this or any other jurisdiction; or' (c) been convicted of an act involving dishonest fraud, or deceit with respect to any contract entered into for work requiring this license. (b) Any licensee whose license is suspended or revoked may appeal the suspension or revocation to the Board of County Commissioners. After reasonable notice to the licensee, the Board shall afford the licensee an opportunity to show why its license should not be suspended or revoked. Section 7. Change of Location. The location of. any licensed business may be changed, provided 10 days , notice thereof is given to the (licensing agency designated in Sec . 4 (b) ) and operation at such new location does not violate any applicable State or local law, ordinance, or regulation. Section 8. Permit Required; Permit Fees. On and after January 1, 1978, .no person, firm or corporation licensed under this ordinate may for a consideration install, alter or restore any insulation or other materials or . energy utilization equipment designed or intended to meet the State Building Code requirements for insulation and energy utilization without first securing a permit from the (designated officer or board) for each item of work. S. 153A-123. Section 11. Effective Date. Phils Ridge: This plain depicts division of a forty-five (45) acre tract into nine (9) lots. The property is situated south of SR #1005 near its junction with SR #1943. The subdivision proposes the property be served by a "Class B" private road. The Board of Education has reviewed this plat and made no adverse comment. The Health Department has stated each lot in the subdivision to be provisionably suitable for septic tanks. Size: The Plann" g board shall not limit the size of each Advisory Council. 'g—ow—ever' , each t ship Council may determine such a limit provided that it be large enough to ensure representation of the township. B. Structure, Rule of procedure: Each Advisory Council shall elect those officers which alre necessary for the operation of the Council. Officers shall be electO for a one year term and may succeed themselves for one term. Each AM ory Council shall also determine a quorum and voting majority. C. Official meetings: No vote shall be taken on any matter except at the regular monthly meeting hich shall generally conform to the monthly schedule approved by the Ianning Board and agreed upon by each Advisory Council. Any exception to the above shall be resolved by a conference,of the Planning Board Chairman, a Pla ing Board member of the township requesting the exception, and the Chairman of that township's Advisory Council. D. Term of appointm nt; The Planning Board shall replace those Council members whose terms have expired by sel.ecting.from a list formed by Advisory Council suggestions, public solicitation for interested people, and any other means of identifying q al.ified and interested persons. However, the township Advisory Councils shall. not officially nominate replacements for those members whose to ,s have expired. one half of the original. Advisory Council. shall be appoiut d for two year terms and the other half shall be appointed for three year t rms, beginning October, 1977. Thereafter, all appointments shall be for two year terms. E. Replacement of i divi.dual vacancies: The Planning Board shall appoint a replacement to, f ll each vacancy due to resignation or failure to serve. Each Council shall determine the number of consecutive absences allowed before a member is repl ced. A vacancy shall not be considered for replacement until the meetin fol'l'owing the one at which the vacancy is announced. In filling vacancie , the Board shall maintain a representative Council.. Replacements for a township Advisory Council shall be selected by the following method. The Plannin Board member(s) and the Advisory Council Chairman of the township shall p esent a name or a list of alternatives to the Advisory Council for comm nt. The name or the list shall then be presented to the Planning Board fir appointment.
