PURPOSE: To follow-up the December 3, 2007 Board of Commissioner meeting requesting
from staff additional information needed to evaluate the proposed options for developing a gas
recovery project at the Orange County Landfill.
BACKGROUND: At the December 3, 2008 BOCC meeting, the Board was presented with
three options for development of a landfill gas recovery project. The options were:
1. to enter into a formal Memorandum of Understanding with the University to grant UNC
exclusive negotiating privileges on a potential landfill gas recovery project
2. to proceed with a Request for Proposals process, encouraging the University to
participate
3. for Orange County to proceed to develop a landfill gas recovery project itself
The BOCC directed the Manager to meet with University staff prior to the December 11 BOCC
meeting to further discuss and consider Option #1. The meeting with the University is
scheduled for December 10 and an oral report of that meeting will be presented to the BOCC at
its December 11 meeting.
At the December 3 meeting, the BOCC removed Option 3 from consideration and requested
that staff develop a listing of pros and cons of each option to aide the BOCC's decision making.
This information will be delivered to the BOCC prior to the December 11 meeting.
The BOCC also expressed its interest in obtaining more financial information about the value of
gas recovery and carbon credits. Staff is working with the consultant to provide a general
reference point based upon research and experience with other municipalities' recovery
programs.

FINANCIAL IMPACT: There is no direct financial impact relative to discussing the options.
However, there could be expense related to implementation of any of the options, and possibly
revenue to the County, depending on project specific economics.
RECOMMENDATION(S): The Manager reserves the prerogative to amend or revise the
current standing recommendation of proceeding with Option #2, pending the outcome of the
December 10 meeting with the University.
