BACKGROUND: Orange County is statutorily required to update its ten year solid .waste management plan every three years. The three-year update was due June 30, 2006. This was not submitted, as Orange County with its municipalities and UNC decided to engage in .a long term, comprehensive integrated solid waste plan that is still in progress, led by the Solid Waste Plan Work Group representing all the governments and UNC. Orange County is the lead agency with regard to state solid waste reporting and plan submittal and has historically performed this function on behalf of the Towns, whose input and approval is solicited. The plan presented here is a placeholder document that is more descriptive than prescriptive, pending completion of ongoing Work Group planning activities and the development of a new revised Plan next year. It describes solid waste work done in the County over the past four years and the nature of the current planning process along with voting out the upcoming decisions that the County and Towns could make to move towards the 61 % reduction goal. Approval of this interim Plan brings Orange County into compliance with the state law, making the County eligible for solid waste grant funds and informs the state of the current rigorous planning efforts. The Town of Chapel .Hill Town Council adopted a resolution of approval on May 19. The Town of Carrboro adopted a resolution of approval on May 20. The Town of Hillsborough Board of Commissioners received the Plan at its May 12 meeting and adopted a resolution at the Town Board's May 27 meeting. The resolutions of adoption will be attached to the Plan when submitted to the State. Staff suggests that a town's decision or failure to adopt the plan not impede the County's decision to adopt a plan prior to the summer break and thereby come into compliance with the statute. 2 The plan, which was previously reviewed by the Board at the, April 15, 2008 Board Meeting, is approximately 70 pages. Due to its length, it is not provided here, but is available upon request. FINANCIAL IMPACT: Adoption of the Plan has no financial impact outside that already proposed within the FY 2008-09 Budget and does not obligate the County to future expenditures. RECOMMENDATION(S): The Manager recommends that the Board approve the attached resolution adopting the Solid Waste Management Plan and authorize its submittal to the State. 3 RESOLUTION ADOPTING THE THREE-YEAR SOLID WASTE MANAGEMENT PLAN UPDATE TO BE SUBMITTED TO STATE OF NORTH CAROLINA WHEREAS, North Carolina statutorily requires each County and Municipality to update its ten year solid waste plan every three years, and WHEREAS, Orange County and its municipalities have historically cooperated closely on solid waste management including plan development with the County being the lead agency with regard to state reporting and planning, and WHEREAS, the Board of Orange County Commissioners has created a representative solid waste management plan work group that is developing a more comprehensive, integrated long term plan including a financial plan and detailed implementation plan that will supersede this plan next year, and WHEREAS, the Orange County Solid Waste Department and the Solid Waste Advisory Board have developed an interim plan for consideration, and WHEREAS, plan development has included representatives from the Towns and UNC and their interests have thereby been represented in plan development, and WHEREAS, a widely publicized public meeting, sponsored by the Solid Waste Advisory Board, was conducted on May 1 and no residents attended and provided input on the plan document, and WHEREAS, this plan submittal is predominantly a descriptive document with recognition that further substantive work is required on the County's overall integrated solid waste management plan, and WHEREAS, the current submittal is almost two years overdue from the original plan update due-date of June 30, 2006, and WHEREAS, Orange County and its towns have historically been among the leaders in the State with regard to waste reduction and responsible solid waste management; THEREFORE NOW BE IT RESOLVED that the Board of Orange County Commissioners adopts this solid waste management plan update.
