He said there had not �n a great deal of interest from industry in development due to the high interest rates. He added that funds had been expended for the financing of a Metro Atlas which would be ready for dis- tribution in the next few months_ Mr. Bergman cited a letter prom former Board Chair, Anne Barnes, which inquired about a _ 'cater and sewer extension policy for the County. He said as a group the Authority was unclear about direction; that is, should such a policy give one option or include several options? He felt the Authority had not received enough guidance or staff support. Chairman Whitted said the Hoard of Commissioners needed to rethinlc its designation to the Industrial Revenue and Bonding Authority; the basic question, as he sees it, is which agency in '~an-jc County should be the lead authority in economic development. Chairman Whitted said the Hoard needed to decide to what extent"the County is willing to finance water/sewer lines. some Board members felt each such request for water/sewer extension should be decided on an individual basis while other Board members felt each option, with all the pros and cons, should be spelled out during policy development. Commissioner Willhoit moved, seconded by Commissioner Walker, to ask the Authority to develop a water and sewer extension policy i far Orange County and that such a policy be based on a revolving fund Woncept with the specific mechanics left up to the Authority to present to the Board in the policy, Commissioner Marshall suggested j a friendly amendment, that the fund be self liquidating rather than revolving. Commissioner Willhoit said he had no problem with that; basically he feels that the mechanics should be left up to the Authority to develop. The County Attorney told the Board it would have to have "specific statutory guidance" in any such policy for financing, interest rates, and method of repayment. Commissioner Willhoit said he felt that was a "mechanics" area which should be left to:-the 00275 Authority to work out. Commissioner Willhoit said the "bottom Line" is that the County should not subsidize extension. Commissioner Gustaveson felt that more options were needed. Commissioner Willhoit's motion, as amended, :stands; Com- missioner Walker's sencond to that motion, as amended, stands. Mr. Bergman was asked to bring back a policy based on the motion for Board discussion and,if appropriate, amendments and approval. 2. Architects' presentations on the old Courthouse Mr. Gary Gales and Mr. Josh Gurlitz gave their background on the Old Courthouse, saying they had tried to assimilate the needs, views and programs of the Manager and the Board of Com- missioners within their proposal. They said the $60,000 budgeted was not enough to get the building functional. Mr. Gurlitz said the County should first determine the needs of the primary users of the Old Courthouse, suggesting that the Museum could occupy either the first floor-. of the Courthouse or an old house moved onto the grounds. Board members said they envisioned District Court in that space and that the prime goal is to maintain and enhance the Old E Courthouse. Mr. Giles and Mr. Gurlitz were thanked for their presentation.. Mr. James Webb and Mr. Roman Kolodji presented their pro- posals for the Old Courthouse. They approached the problem from three sides; 1) structural problems; 2) legally mandated constraints; and, 3) occupancy constraints. The architects said the structure appeared to be sound. They said if sprinklers were used a second exit was not needed. They added that occupancy of the upper level 00 7R would be limited to one hundred persons. Mr. Kolodji said the elevators, sprinklers and toilets could be installed within the $60,000 set aside by the County. The architects added that electrical wiring and cooling and heating would add $35,000 and $45,000 to the costs, respectively. Messrs. Webb and Kolodji were thanked for a very thorough presentation. The Board took a short recess. G. Board Decision Items 1. Northern Fairview Redevelopment Plan: Commissioner Willhoit moved to approve the Redevelopment Plan as submitted; Commissioner Gustaveson seconded the motion. Commissioner Marshall asked the County Attorney how the new eminent domain law would affect this plan. Mr. Gledhill, the Attorney, said not at all, the County was garnishing the power to condemn, not the method. Vote: Ayes, 5; noes, 0. 2. Sheriff Salary: Commissioner Walker moved to leave the Sheriff's starting salary at $31,296, that is, a pay grade '7_9, step 4B. Chairman Whitted said the motion died for lack of a second. Commissioner Whitted moved, seconded by Commissioner Willhoit, to adopt the following Resolution: Be it resolved by the Board of Commissioners of Orange County, North Carolina, that it is the intention of the said Board to set the salary of the Sheriff of Orange County, North Carolina at a rate of $25,920 per annum to take effect on the date the person elected in the general elec- tion of 1982 to the offz_ce of Sheriff takes office. Vote: Ayes, ' 4 (Commissioners Gustaveson, Marshall, Whitted. and Willhoit) ; noes, 1 (Commissioner Walker) . The Board of Commissioners adjourned for lunch to reassemble at 2:00 P.M. The Board of Commissioners convened following lunch. Com- missioner Walker was not present. 3. Appointments: The Board instructed the Clerk to adver- tise the Orange County Planning Board vacancies and to write letters to the Leagues of Women Voters and Chambers of Commerce in Chapel Q QZ77 Hill--Carrboro and Hillsborough advising them of the vacancies on various Boards and Commissions. The Board reviewed its current assignments on Commissions s and Boards. The consensus was to maintain current assignments. Commissioner Willhoit moved, seconded by Chairman Whitted, to appoint Commissioner Shirley E. Marshall to the Senior Citizens Board. . Vote: Ayes, 4; noes, 0. Commissioner Willhoit moved, seconded by Chairman Whitted appoint Commissioner Shirley E. Marshall to the Board of Social Services to such time as all committee obligations are reviewed by the Board. Vote: Ayes, 4; noes, 0. Commissioner Gustaveson moved, seconded by Chairman Whitted, to name Ms. Elizabeth Walters Chair of the Agricultural Task Force Implementation Committee. Vote: Ayes, 4; noes, 0. Commissioner Willhoit moved, seconded by Chairman Whitted, to appoint Commissioner Shirley E. Marshall to the Agricultural Task Force Implementation Committee. Vote: Ayes, 4; noes, 0. 4. Duke Power Company Planned Development Request: Com- missioner Willhoit moved, seconded by Commissioner Marshall, to approve the Planning Staff's recommendation that a Public Hearing on Duke Power Company's Planned Development Request on January 25, 1982, at 7:30 P.M. in the Commissioners' Room. Vote: Ayes, 4; noes, 0. 5. Chestnut Ridge Church Road: Commissioner Gustaveson moved to approve the recommendation of the Department of Transpor- tation to relocate Chestnut Ridge Church Road; Commissioner Willhoit f seconded the motion. Vote: Ayes, 4; noes, 0. 6. Tax Release--Policy Research & Planning Group, Inc. : former Tax Supervisor, Mr:Bill Laws, told the Board this was an educational group and there would be no problem granting the exemption under 05 105-278.4 or GS 105-278.7 if the request had been timely. The property was discovered in 1981 for 19BI. The Tax Supervisor recommended this exemption be granted. The County Attorney told the Board that if it found the property exempt it also had the power to release the taxes. Chairman Whitted moved, seconded by Commissioner Marshall, to release the taxes for 19$1 for the Policy Research & Planning Group, Inc. Vote: Ayes, 9; noes, 0. 7. Northside Multipurpose Center Contract for Architectural Services: Commissioner Gustaveson moved seconded by Commissioner Willhoit to approve the contract for architectural services on the Northside Multipurpose Center with James Webb Associates. Vote: Ayes,4; noes, 0. Commissioner Willhoit asked that those in the Multipurpose Center receive copies of the approved architect'+s proposal. B. Housing Rehabilitation Bid Award: Commissioner Gustaveson moved to award the rehabilitation contracts to McDuffi:e for Unit m 24, and to Taylor Home Improvement for units tt 13, 20, and 121, in the amounts of $2,135,00; $6,400.00; $11,080.00; and 5 $11,935.00, respectively, and to authorize the County Manager�to execute any change orders in those contracts. Commissioner Whiitted seconded the motion. Vote: Ayes, 4; noes, 0_ 9. Tax Collection status: The County Manager presented a report toti7e Board on the status of the tax collection for the County and present fund balance. The Manager presented this report with a view toward underspending the budget this fiscal year. After some discussion, the Board of Commissioners suggested the Manager arrive at a specific fund balance figure and return it to the Board. . 10. Work session: Commissioner Gustaveson asked that the Board set a work session to look at planning department and County e goals. Commissioner Gustaveson said he wanted the Board to look at budget objectives by department and see where we are on those objectives. The County Manager said he would need until about the middle of February to get a grasp of where the County is on that. Chairman Whitted said the Board would consider setting such .a: work session at its next meeting. H. Executive session---Personnel and legal matters: 00279 Commissioner Willhait moved, seconded by Commissioner Marshall, to convene in executive session for personnel and legal matters. North Carolina General Statute Section 153A-92 places the responsibility for "fixing" or approving the pay and allowances of all county officers and employees. This is done in Orange County by the adoption by the Board of a pay classification plan. The period for filing notice of candidacy for the upcoming; Sheriff's election begins January 4, 1982, and ends February 1, 1932. The Executive Secretary of the Board of Elections must know the salary of this position from the date the newly elected person takes office in order to set the filing fee (G.S. Section 163-107) for the office. Since Sheriff Knight has announced his intention not to run for re-election and since the present salary is based in part on the incumbent's loncievity in office, the question of the salary for this position is timely. 4 Consideration of the natter must occur by giving notice of intent by Board resolution no later than January 17, 1932 (adopted fourteen days prior to the last day for filing candidacy for the office-- } G.S. Section 153A-•92). Comparative salary information is attached. Impact: Establish basis for filing fee. Financial Condition As reported earlier, I have been analyzing the County's revenue and expenditure situation with the assistance of the Finance Depart- ment. This has included review of the 1980-81 audit, current year tax collections as of the end of each month and projecting cash flow for the next twelve months to determine requirements. In the case of the audit and first and second quarter inflow/outflow of cash we are dealing with hard data. Forecasting, on the other hand, must involve assumptions and therefore is subject to error. It is essential to make the best estimates possible and adjust, to forecasting errors as time elapses. Enough information has been drawn to update you. other updates will follow as factors are monitored. The following are observations at this point: 1f Unemployment are affecting collections. End of November figures .lagged 4% behind last year. COUNTY LEVY NOVEMBER, YEAR-TO-DATE % COLLECTED 1980-81 $7,166,345.88 secured 28.56 2,046,963.74 $1,828,656.17 unsecured 16.69 30.5,374.63 1981-82 $8,689,958.48 secured 24,35 2,116,046.87 $1,131,220.65 unsecured 15.49 175,257.99 It is hoped that this is a temporary phenomenon. However, were this to become a pattern through the end of January the County might not realize the 97% collection assumed during the budget process. Interest rates remaining high may be a factor. The penalty for non-payment of taxes falls below what one could derive by having the money invested, this reduces the incentive to pay prior to legal action being mounted which is a full year from the due date on secured property. The legislature has under consideration a bill to raise the penalty. This would help along with earlier mailing of bills and possibly a prepayment discount for bills paid by the end of August. memo Board Members December 30, 1981 Page 2 2. Growth in property values during 1981 calendar year is bleak, with new home starts down by at least 50% in the County. Secondly there will. be a good number of appeals during 1982 to the Board of Equali- zation and Review due to some sales of like property which have sold during 1981 for less than the appraised value as of January 1981. 3. The County came into this year with an unreserved fund balance of $165,974. This compared with $711,970 as of June 30, 1980. Unless the amount is raised through underspending during the last half of Fy 1981-82 there will be a shortfall of cash needed for accounts payable and payroll for the months July thru November of 1982. Underspending will not be easy as the Board, in the interest of having the lowest possible tax rate after a revaluation, cut the budget before its adoption. 4. on the positive side more revenue should be derived from sales taxes. First quarter collection was $493,554 of the $1,839,538 budgeted for the y.ar. 5. Intangible tax may not equal last year when $554,000 was collected; $425,000 was budgeted for this year. It comes as a one time pay- ment in August for the year preceeding. 6. Interest on investments likewise is difficult to project. The County has had less to invest and whereas interest rates in January of last year were 15.3 we expect 12.2 in January of 1982. 7. Revenue sharing which amounts to $50Q.,OOC in the 1981--82 budget is expected to be cut 12% ($.60,000) in the coining year. All of this amounts to the need for watchfulness in the coming months and undexspendiag where possible. I seek your guidance on measures you feel should be taken.
