PURPOSE: To consider approving a dedication of Right of Way and Permanent Drainage
Easements to service the Churton Street access and public transportation improvements as
presented, upon final review of the County Attorney, and to authorize the Chair to sign on behalf
of the Board.
BACKGROUND: The Town of Hillsborough is requesting this dedication (see Attachment 1,
"Deed of Easement") in order to install and service a bus stop as part of the larger Churton
Street access improvement project (see Attachment 2, "Site Indicator"). A new crosswalk will
also be added across Churton Street at the Nash and Kollock Street intersection at this point,
connecting to the bus stop. The improvements are scheduled to be installed during the summer
and fall of 2015.
The right-of-way request will require approximately 2,640 square feet of the County's River Park
along Churton Street to be dedicated. This area is currently largely a wooded edge along the
road with a slope that changes from steep to slight, with a mix of 10-12 young and moderately-
aged hardwoods that would be removed for construction and will be replaced after the project is
complete
This bus stop improvement will include landscaping and storm water drainage treatment work
east of the bus stop that will be coordinated with the County's future River Park entrance from
Churton Street. The Town of Hillsborough will accommodate potentially needed adjustments
and coordination regarding this future park entrance through a standard encroachment
agreement once the entrance design is complete (see Attachment 3, "NCDOT Email").

Orange County will continue to work with the Town of Hillsborough to ensure coordination for
the successful installation of these improvements.
FINANCIAL IMPACT: The right-of-way dedication and permanent drainage easement will
impact the design of the planned River Park improvements scheduled for FY 2015-16, although
the degree of financial impact of the work cannot be determined until final drawings are done,
the work completed, and the plan for new park improvements finalized. The bus stop right-of-
way and drainage easement will require regrading the slope into River Park, making another
sliver of the park largely unusable. Additionally, the new crosswalk associated with the project
effectively creates a new entryway into River Park, which - while a positive pedestrian
improvement to the park - will make new trail connections from that point prudent to include in
the FY 2015-16 work. Staff estimates the new trail connections that would be triggered by these
improvements to be approximately $10-20,000, which would be funded from the Capital
Investment Plan project.
RECOMMENDATION(S): The Manager recommends the Board approve a dedication of Right
of Way and Permanent Drainage Easements to service the Churton Street access and public
transportation improvements as presented, upon final review of the County Attorney, and to
authorize the Chair to sign on behalf of the Board.

Additional Right of Way
Commencing at a #5 rebar set in the margin of the Rights-of-Way of NC Hwy 86 North, also known as
South Churton Street in the Town of Hillsborough, North Carolina, and having the NC State Plane
Coordinate of N: 845619.8844 usft, E: 1970679.4474 usft, and being the Point of Beginning. From said
Point of Beginning, the following courses and distances: NO2°08'12"W 240.00' to a #5 rebar set;
N88°01'29"E 9.16' to a #5 rebar set; S01°58'31"E 240.00' to a #5 rebar set; S88°01'29"W 8.49' to the
Point of Beginning and being +/- 2,117.53 square feet.
Permanent Drainage Easement
Commencing at a #5 rebar set in the margin of Rights-of-Way of NC Hwy 86 North, also known as South
Churton Street in the Town of Hillsborough, North Carolina, and having the NC State Plane Coordinate of
N845694.1329 usft, E: 1970685.3768 usft, and being the Point of Beginning. From said Point of
Beginning, the following courses and distances: N88°01'29"E 20.00' to a #5 rebar set, S01°58'31"E 24.00'
to a #5 rebar set; S88°01'29"W 20.00'; N01°58'31"W 24.00' to a #5 rebar set to the Point of Beginning
and being +/- 480 square feet.

Typically, revision of the PDE meets and bounds would not be required. Installations or other work within the PDE can
be authorized by way of the encroachment agreement.They will need to get an approved encroachment agreement to
make the trail connection to the sidewalk regardless of this PDE. I'll be happy to address any specific design related
questions they may have.

Quick clarification...Will you verify that if Orange County needs to revise the PDE due to extending the pipe or installing
another drainage feature like a rain garden in the vicinity of the new trail into the park that it is indeed possible to
record a new plat in coordination with NCDOT?
I ask for this clarification because County staff is still in process of designing the new entrance and doesn't want to be
hemmed in by the current PDE. They simply want to ensure that if they need to adjust it that it will be possible. Thanks,
