PURPOSE: To approve the proposed land exchange for Orange County Public Works with
Town of Hillsborough related to the agreement between the Town and the County, thereby
helping to finalize the Fairview Public Campus Master Plan approval process.
BACKGROUND: In the fall of 2004, the BOCC asked the Town and County legal and
management staff to refine a draft Memorandum of Agreement (MOA) that would outline a
design process for creating a Fairview Public Campus Master Plan. The Plan would
encompass the 67-acre Fairview Park site and the adjoining 26-acre County Public Works
property, including properties subject to land exchange discussions. A Memorandum of
Agreement was approved by the BOCC and Town during November 2004.
This item was further addressed at the January 23, 2007 BOCC meeting. The Board of
Commissioners confirmed the proposed land exchange as outlined and applicable to the
approved Fairview Public Campus Master Plan. The BOCC also committed to
discuss/consider providing an alternative amenity instead of the tennis courts, as proposed
by the Hillsborough Board of Commissioners, before the design and construction of the park
facilities, and to seek further clarification in writing from the Town Board as to what it wished
to pursue. The resulting land exchange has moved forward in such a way to be sensitive to
the residences in the neighborhood. It should also be noted that the discussions between
the Town and County in regard to meeting space for both Boards led to the protection of the
mature hardwood trees on the Public Works property.

The County is currently awaiting word on a Parks and Recreation Trust Fund grant, with
notification expected in May or July. A conditional use permit application with the Town of
Hillsborough is currently under consideration.
The attached survey from Summit Consulting Engineers shows the five-acre land area to be
exchanged. The Town of Hillsborough is expected to address the issue at the Town Board's
meeting on May 12, 2008.
FINANCIAL IMPACT: There is no cost associated with the land exchange. The Town of
Hillsborough took the lead on retaining a surveyor and the development of plats and deeds to be
recorded subject to legal review and Board approvals. A copy of the survey is included as an
attachment. The 2001 voter approved bonds included $850,000 for development and
construction of Phase Two of Fairview Park.
RECOMMEN®ATI®N(S): The Manager recommends that the Board approve the land
exchange as identified in the attached survey and authorize the Chair and Clerk to sign the
transfer documents.
