PURPOSE: To review a Class A Special Use Permit (hereafter 'SUP') application proposing the
development of a Private Montessori Farm School at 711 Terry Road (SR 1573) in accordance
with the provisions of Article Eight (8) Special Uses and Section 8.8.30 Elementary, Middle, and
Secondary of the Orange County Zoning Ordinance (hereafter 'Ordinance)
BACKGROUND: On March 14, 2008 staff received a
development of a private school at 711 Terry Road (SR 1573)
property and the application are as follows:

PROPOSAL: The applicant, Montessori Farm School, a private non-profit corporation is
seeking a SUP to develop a private school based on the Montessori curriculum. The applicant
intends to develop their school with a major emphasis on providing a farm/agricultural and
science oriented curriculum including:
a. Farm and crop production,
b. Animal care,
c. Recycling, composting, and water conservation activities/projects, and
d. Study of the natural environment.
The applicant is proposing to have three (3) pre-school classrooms, one (1) elementary
classroom (1st through 3rd grades) and one upper elementary classroom (4th through 6th grades)
for approximately:
a. Eighty (80) pre-school/kindergarten and
b. Forty (40) elementary school children (grades 1st through 6th)
There will be a total of one hundred twenty (120) children attending school at the
property once the facility reaches the intended capacity. The applicant indicates that there
will be twelve (12) staff supporting the school's activities, with one (1) lead teacher and one (1)
assistant per individual classroom.
The review of this application shall be in accordance with the provisions of Article Eight (8), and
specifically Section 8.8.30 of the Ordinance. The following standards, as detailed within Section
8.8.30 of the Ordinance, have been established to determine the appropriateness of the
application:
I. Service Provision:
(1) Fire — identifies the primary and secondary responders and the source(s) of water.
On May 5, 2008 the following information was provided by Mike Tapp, Deputy
Director/Fire Marshall, Orange County Emergency Services concerning this
project via e-mail:
1. Caldwell Fire Department is the designated provider of fire and
first responder services for this property,
2. The Caldwell Fire Department has identified the need for, a
water source for fire protection for the school.
Currently, the Department uses tankers to transport water to
fires in the area. Due to life and safety considerations for an
educational occupancy, however, a water source for fire
protection must be designed and installed.
The design of the water source shall be approved by the
Caldwell Fire Chief and the Orange County Fire Marshal's
Office.
3. Stacking spaces in the driveway shown on the plans must be
revised to reflect a twenty (20) foot roadway. Stacking vehicles
in the driveway will restrict access to the buildings by
emergency response vehicles
4. Fire lanes shall be installed to access classrooms from the
parking lot area. Fire lanes must meet the provisions of the
North Carolina Fire Prevention Code.
Staff Comment According to the applicant these issues are being addressed for
discussion at the public hearing. Mr. Tapp has indicated that he has no concerns
over the development of the property so long as these concerns are addressed.
(2) Police — identifies the primary and secondary responders.
Staff Comment The application identifies that the Orange County Sheriff's office
will be responsible for providing protective services to the proposed school.
The Orange County Sheriffs office has informed staff that there is sufficient
capacity within the department to provide protective services to the proposed new
school through a letter dated April 17, 2008 (see letter within Attachment 3)
(3) Rescue services — identifies the primary and secondary responders.
Staff Comment The application identifies that Orange County. EMS will be
responsible for providing emergency services to the proposed school.
The County Fire Marshall /EMS Director has informed staff that there is sufficient
capacity within the department to provide rescue services to the proposed new
school.
(4) Water Supply — identification of public or private utility source and capacity of
water supply or identification of water source through a water resource study.
Staff Comment The application indicates that they intend to develop a private
well on the property to serve as the primary water source for the school.
(5) Wastewater Treatment Methods — provider and capacity of wastewater treatment
source.
Staff Comment The application indicates that they intend to develop a private
septic system on the property for waster water disposal.
(6) Solid Waste. A Solid Waste Management Plan will have to be prepared and
reviewed by Orange County Solid Waste.
Staff Comment Staff has been informed by Mr. J. Grant Gale, of Orange County
Solid Waste, that a Solid Waste Management Plan has been submitted for review
on this proposal. Mr. Gale has informed staff that he has requested additional
information from the applicant.
The applicant has informed staff that the final Solid Waste Management Plan will
be submitted at the public hearing.

II. Biological Inventory:
A Biological Inventory is required to be prepared in accordance with Section 8.8.29.113 (B) of
the Ordinance. The purpose of the inventory is intended to identify
' habitat diversity, species diversity, species or special concern such as those
designated as threatened or endangered, last known sighting, candidate species
likely to be present which may warrant protection, specimen trees outstanding in
size and /or species, and the status and source of the information complied in the
inventory'
Staff Comment. Planning and Environmental Resource and Conservation (ERCD) staff has
reviewed the proposal and determined that there are no significant animal/plant species on the
property or existing habitat area warranting special consideration or protection based on
information contained within the Inventory of Natural Areas and Wildlife Habitats for Orange
County North Carolina (see memo within Attachment 3)
The applicant has informed staff public hearing.
Ill. Landscaping and Buffering:
The Ordinance requires the submission of a landscape plan outlining the locations of existing
vegetation, areas proposed for preservation, as well as plants and materials for proposed
planting areas.
Staff Comment The landscaping and buffering information is contained on the second page
of the site plan .and includes information on the Resource Protection plan for the project. The
plan denotes the following:
1. There are several streams on the rear of this property requiring a eighty (80) foot stream
buffer per Section 6.23.7. The streams are located to the rear of the property, east of the
proposed school building sites.
Staff Comment The Site Plan and Resource Management Plan denote the appropriate
stream buffer as required by the Ordinance.
2. In addition to the stream buffer, the applicant is proposing:
a. A twenty (20) foot vegetative buffer along the north property line,
b. A variable buffer area separating the Elizabeth Mack property (TMBL 5.10-22 1
0806-76-4683) ranging from forty (40) to one hundred (100) feet along the eastern
portion of Ms. Mack's property and twenty (20) feet of vegetative and pasture area
to the south of Ms. Mack's property.
c. A variable vegetative buffer along the southern property line, ranging from ten (10)
to twenty (20) feet in width. The proposed driveway and emergency vehicle
access area is approximately ten (10) feet from the southern property line.

The landscaping and buffering plan .appears to be consistent with the requirements of the
Ordinance. Unfortunately, the applicant was unable to provide staff with full size copies, in
color, of the Resource Management Plan identifying the various buffer information.
Final determination will be made upon the submission and review of the final draft of the
Biological Inventory and the full size, color copy, of the Resource Management Plan.
IV. Stormwater Management/Drainage/Grading and Erosion Control:
The applicant has submitted a Grading and Erosion Control Plan to the County for review. The
plan indicates that stormwater shall be maintained on the property. The property is to be
graded to channel stormwater runoff into a fenced pond shown on the submitted site plan.
This pond is also listed as being a potential source of water for the Caldwell Fire Department to
use for fire protection services.
Staff Comment Review of the Grading and Erosion Control plan is proceeding. If the SUP is
approved, a condition of approval should be that the site will comply with any and all provisions
of the approved Grading and Erosion Control Plan.
V. Traffic Impact:
The Ordinance requires that a Traffic Impact Analysis (TIA) be completed in accordance with
the provisions of Article Thirteen (13) of the Ordinance. The purpose of the TIA is to identify
any and all traffic improvements that will be necessary to support the development of the
proposed land use.
Staff Comment Terry Road is a State Maintained Road classified as a Minor Arterial by the
Orange County Land Use Element of the Comprehensive Plan. The capacity of Terry Road is
intended to be between 10,000-25,000 Vehicles Per Day (VPD). The anticipated traffic trips
generated by the proposed school site has been estimated at approximately three hundred
(300) trips per day.
In accordance with Section 13.3 of the Ordinance, a formal TIA is not required for this project
as the estimated traffic generated by the proposed development will not exceed eight hundred
(800) trips per day.
Staff has required the applicant to submit the site plan to the North Carolina Department of
Transportation for review. NC DOT is in the process of reviewing and issuing a driveway permit
that will identify any and all on/off-site improvements necessary to address traffic flow concerns.
The applicant will be required to adhere to any permitting conditions imposed by NC DOT. .
V1. Public Road Access:
The Ordinance requires that the property have. access from an existing public road and that
such access be in compliance with any and all public road access management plan adopted
by Orange County.
Staff Comment As previously indicated, Terry Road is a State Maintained Road classified as a
Minor Arterial by the Orange County Land Use Element of the Comprehensive Plan. The

applicant is proposing to have one (1) vehicular ingress and egress from Terry Road to access
the property.
VII. Additional Standards:
Per Section 8.8.30 (3) the following additional standards are required as part of the SUP review:
a. The minimum lot size shall be, with respect to non-charter public schools, as
required by the School Construction Standards adopted from time to time by
Orange County Board of County Commissioners, the Orange County Board of
Education and the Chapel Hill-Carrboro Board of Education. With respect to all
schools the lot size shall be adequate to accommodate all activities. The
proposed methods to handle the maximum number of participants and patrons for
any single event shall be provided while also adhering to safe vehicular and
pedestrian circulation.
b. Negative visual impacts shall be minimized along any major roadway. Negative
visual impacts include, but are not limited to, loading/unloading areas, delivery
areas, air handling units (roof top and other), parking areas for machinery, and
storage buildings. Appropriate screening methods shall be used to enhance the
aesthetic value of a project.
C. Transportation improvements as deemed necessary by the Traffic Impact Study.
Staff Comment As previously indicated a formal Traffic Impact Study is not

Staff has required the applicant to submit -the site plan to the North Carolina

d. The site shall be designed to take advantage of multiple shared use opportunities,
which may include a Park and Ride facility for public transportation.
e. There shall be a minimum of two access points to the site. Access points shall
separate student drop-off areas and visitor parking from bus traffic. If school
buses are used, then at least one access shall be limited to school employee and
bus use during normal school hours. All access points shall be located to, provide
maximum visibility and safety. No driveway shall be permitted in a location that
will hinder or congest traffic movement on a public street.
Staff Comment The applicant is only showing one (1) access point to the
property off of Terry Road.
Internal circulation segregates student drop-off/pick-up traffic from visitor or staff
traffic. As there is no proposed use of school busses, the applicant is not required
to'provide a separate access point for school* employee and bus use.
FINANCIAL IMPACT: None
RECOMMENDATION(S): The Zoning Officer recommends that the Board :
1. Receive the proposed amendments,
2. Conduct the Public Hearing,
3. Receive any and all comments on the proposal, and
4. Refer the amendment package to the Planning Board for review and comment with a
request that a recommendation be submitted within three (3) regular meetings of the
Planning Board

Locations and widths of all easements and rights -of -way within or adjacent to
the site.
Location of all existing and proposed structures on the site.
Location of all areas on the site subject to flood hazard or inundation as shown
on flood maps or soils maps.

Existing topography at a contour interval of five (5) feet based on mean sea
level datum.

INTENT TOPRUCH4SE FOR SCHOOL ZONING:
The Montessori Farm School wishes tn � the 711 Terry Road property, and develop an
educational facility for children ages 3 through 6th grade. Traditional academic skills taught
using the Montessori method witt be enhanced by a focus on stewardship of the earth through
combining a school and farm environment designed specifically for this purpose.
We have strived, in the last year, to locate the most appropriate location for this venture. A
property in Orange County ix the most attractive for a few reasons. YYe feet the location iu
especially desirable due to the fact that Orange County is dedicated to the same goals of
environmentai-mindednessasvvnare. While more and more farms are sold for neighborhoods,
we see the importance of educating children as to how to protect the land, ensure safe living
conditions, and understand how food iogrown. VYe see the importance of working with families
in a rural farm setting towards the preservation of common knowledge mffood production and
care of the earth, as well as an acute understanding nf the interdependency ofnature, animals
and humans in the environment. The area is central to the clientele that vva attract, and are
families are like-minded in this venture. Our c6rhentk/ enrolled students, andtheir
deepk/=invoh/ed families, all come from the HiUsborouQh and N. Durham County area.
Presently, Montessori Farm School is renting space in the education building behind the
Abundant Life Church. The children vve enroll start aa early as 3 years old, and our oldest is
third grade. We intend to add fourth grade next year, fifth the following year and then sixth
the following year. Three and four year olds attend five days a week from 8:3O-12:15,
Kindergarten through elementary attends five days a week from 8:30 - 2:30.
Once vve have reached ourgoaioffuiicapacity;/0ontensnhFarnmSchooiwil[housethree
preschool classrooms, one tower elementary classroom (1 st through 3 m grade) and one upper
elementary classroom (4 0 through 6 m grade.) Total enrollment at that time wilt consist of BO
preschool/ kindergarten students and 4O elementary students. Each classroom will have 2
adults (one lead teacher and one nsxistant,) Th� Head of School, and anassistant
administrator, wilt occupy the of�ice' bringing ourtotal staff count to 12.
We are a private non-profit, run by a board consisting of parents and members of the
community who share our vision and cgmrnitment, While we currently do not offer
scholarships, we have started m fund in order that vve may do so in the near future. Students
bring their own lunch, since we do not (and wilt not) have lunchroom facilities.
Aside from our academic and agricultural intentions, we also intend for our students to
participate in, and champion, causes reflecting our vision outside of the farm school confines.
To that end, for example, our kindergarten through elementary students have already started
participating in4-Hweekly. YVe see this program asa wonderful way to enhance our science
curriculum while working With environmental issues and learning how tn care for large animals.
YYe believe that one teaches, Learns and lives through example, and therefore also promote the
necessary life skills of recycling, composting and water conservation. While vve work towards
the realization of our own farm school facility, vwe visit other farms, plant and harvest gardens
around our present school environment, and care for the small animals we have.
We would deeply appreciate your consideration in our venture, and are most grateful for all
th� support and encouragement we have received from the Orange County administrators to
date.

Dear Property Owner:
This letter is being sent to inform you that the Orange County Board of Commissioners
and the Planning Board have scheduled a JOINT PUBLIC HEARING to review a request
submitted by the Montessori Farm School, a private non - profit corporation, seeking the issuance
of a Class A Special Use Permit to develop a private school based on the Montessori curriculum
at 711 Terry Road (TMBL 5.10..22 / PIN 0806 -76- 4683).
The applicant intends to develop the school with a major emphasis on providing a
farm/agricultural and science oriented curriculum including:
a. Farm and crop production,
b. Animal care,
C. Recycling, composting, and water conservation activities /projects, and
d. Study of the natural environment.
The applicant is proposing have three (3) pre- school classrooms, one (1) elementary
classroom (1St through 3r grades) and one upper elementary classroom (4th through 6th grades)
for approximately:
a. Eighty (80) pre- school/kindergarten and
b. Forty (40) elementary school children (grades 1" through 6th)

The Solid Waste Department Staff have reviewed the plans and have the following comments:
General Comments:

Solid Waste staff strongly urges the applicant to contact Solid Waste staff to clarify recycling issues to streamline review
and revisions for solid vvaeta needs.
Property is currently eligible for recycling service provided by Orange County Solid Waste.
Requested Stipulations or Conditions
Need Solid Waste Management Plan:
We recommend that a Solid Waste Management Plan be developed for this project. Specifically, this plan should address
how landclearing, demolition, and construction wastes will be disposed of and if recyclables and waste generation rates
have been considered in planning for waste collection services. VVe recommend that this plan ba initiated on soon oo
possible so that the collection of recyclables can be considered as the site plan is being developed. VVe recommend the
applicant contact Solid Waste Staff at818-2Q42 for assistance in developing the Solid Waste Management Plan.

Need
VVa recommend that prior to issuance ofaZoning Compliance Permit the applicant specifically provide for corrugated
cardboard recycling, addressing compliance with RRMO cardboard recycling requirements. \A/e believe that osecond
dumpster to be utilized for recyclable cardboard may be necessary and should be incorporated into any Site Plan
changes.
Pre-construction Meeting Stipulation:
We'rec6mmend that the applicant be stipulated eoo condition ofpermit issuance to hold the pre-demolition and pre-
construction
Deconstruction Assessment Stipulation:
VVe recommend that the applicant be stipulated to hold a deconstruction assessment meeting with Orange County staff
(Roderick Jones 918-2942) concerning the buildings to be removed from this site. We also recommend the following note
.be placed on the final plans: "Prior to any demolition or construction activity on the site the applicant will hold o
deconstruction assessment conference with the County's Solid Waste staff concerning buildings to be removed from this
areas, Refuse and Recycling Area Dimension Details:
The revised plans must include a separate, to-scale, dimensioned detail of any proposed refuse/recycling collection
including pad length, width, and depth, associated screening, overhead clearances, and protective bollards. Bollards
must be 6" CID steel, with two bollards centered behind each bulk waste container and placed 1' off the back wall of the
enclosure. Dbmpster, roll-cart, and compactor details should be provided to scale. Preferable scales for the detail are 1"
= 10' or V = 20'. The revised plans label each bulk waste container for type of material to be collected. It is unclear from
the initial design how trash and recycling will be handled. Applicant appears to provide adequate room for
recycling carts for paper and container recycling. Applicant must provide a 32.5'turn radius to allow vehicle to
enter site, access recycling carts, turn around and exit the site. Space for bulk refuse appears inadequate.

Blocked Service:
We recommend the following note be included on the plans prior to issuance of a Zoning Compliance Permit: "if any
vehicles are parked in the refuse or recyclables collection vehicle access area, the containers will not receive service until

We recommend that the revised plans label each bulk waste container for type of material to be collected.
Heavy Duty PavinqPvVaiver:
We recommend the collection vehicle access route to any area containing recyclable material collection containers be
paved with all-weather, heavy-duty pavement OR the following note be included on the plans and recorded on the plat:
"Orange County will not be responsible for any pavement damage that may result from service vehicles."
Overhead wires:
We recommend the property owner address refuse service access in relation to the height of any overhead wires at the
entrance bo the collection area. Any-merhead wires must be raised boa minimum of18'amd any other overhead
impediment(s) to access will need to be raised to a minimum height of 16'or relocated before service vehicles could
service any waste through this route.
We recommend that the applicant reserve space for segregated grease rendering/recycling ooUectonendconoidor
providing space for segregated food waste collection near the delivery entrance for any building which currently houses,
proposes to include or may at some future date incorporate a restaurant, cafeteria, bar, or other food service facility at
any time. Commercial grease wastes are not allowed disposed with regular wastes.

NOTES TO BE PLACED ON FINAL PLANS:
Construction Waste:
1. 8v Orange County Ordinance, clean wood waste, scrap metal and corrugated cardboard, all present in
construction waste, must berecycled.
2. By Orange County Ordinance, all haulers of construction waste must be properly licensed.
3. Prior to any demolition or construction activity on the site the applicant *will hold a pre-demolition/pre-construction
conference with the County's Solid Waste staff. This may be the same meeting held with other development
officials

We have completed the plans review on the proposed Montessori School and offer the following comments:
1. Caldwell Fire Department is the provider of fire and first responder services. Orange County Emergency
Medical Services is the provider of emergency medical services.
2. Caldwell Fire Department has identified the need for a water source for fire protection for the school.
Currently, the fire department uses tankers to transport water to fires in the area. However, due to life
safety considerations for an educational occupancy such as this, a water source for fire protection must be
designed and installed. The design of the water source shall be approved by the Caldwell Fire Chief and the
Orange County Fire Marshal's Office.
3. Stacking paces in the driveway shown on the plans must be revised to reflect a twenty (20) foot roadway.
Stacking vehicles in the driveway will restrict access to the buildings by emergency response vehicles
4. Fire lanes must be installed to access classrooms from the parking lot area. Fire lanes must meet the
provisions of the North Carolina Fire Prevention Code.
5. Caldwell Fire Department may offer additional comments at a later date.

Subject: Proposed Montessori Farm School (Class A SUP)
Thank you for the opportunity to review Site Plan for a proposed Montessori Farm School on
a 14.5-acre parcel located on the east side of Terry Road (Eno Township).
ERCD staff comments on proposed site plans are generally to address any concerns with
respect to potential impacts on important natural or cultural resources. My comments on
this proposal are based on an examination of the Site Plan (dated 3/11/08) and a review of
ERCD's comprehensive resource database.
The Site Plan would limit the construction of the school and its associated facilities
(including utilities) to the western two-thirds of the property—all of which is either open
grassland or was cleared of its trees by the harvesting of timber within the past five years.
The eastern one-third of the property is to be left undisturbed as a "preserved natural area
for nature study and stream buffer." That portion of the property is forested with mixed
hardwood trees and includes two streams within the Little River Protected Watershed.
There is no natural heritage site or proposed county wildlife corridor on or adjacent to this
property. There are no adopted plans for proposed greenway corridors on or adjacent to
this property. (Nor are there any sites identified in the county's inventory of historic sites.)
Overall, the plan appears to be consistent with the County's desire to minimize
adverse environmental impacts with respect to the protection of floodplains,
wetlands, natural areas and wildlife habitat.
ERCD will evaluate this proposal further upon receipt of a biological inventory of
the property to be prepared in accordance with Section 8.8.29.1113 (b) of the
Orange County Subdivision Ordinance.
