2) Legal Description
PURPOSE: To consider approving a dedication of the Stormwater Facility Easements built to
service Culbreth Middle School to the Town of Chapel Hill as presented, upon final review of the
County Attorney, and to authorize the Chair to sign on behalf of the Board.
BACKGROUND: The Town of Chapel Hill is requesting this dedication in order to properly
service the stormwater management facilities installed to service Culbreth Middle School. The
facilities descriptions are provided as part of Attachment 2 entitled "Dedication of Stormwater
Facility Easements" prepared by Phillip Riley of Riley Surveying on February 11, 2015.
FINANCIAL IMPACT: None.
RECOMMENDATION(S): The Manager recommends the Board approve a dedication of the
Stormwater Facility Easements built to service Culbreth Middle School to the Town of Chapel
Hill as presented, upon final review of the County Attorney, and to authorize the Chair to sign on
behalf of the Board.

Orange County, NC the current owner of Culbreth Middle School Property, according to Deed Book
5743, at Page 496 Orange County Registry, does hereby dedicate and convey unto Town of Chapel Hill,
its successors and assigns, all of its rights, title and interest in and to the Access Easements in
accordance with plans titled "Dedication of Storm Water Facility Easements" prepared by Riley
Surveying, PA, and dated 01/28/2015.
IN WITNESS WHEREOF, this letter is executed by the duly authorized officers of Orange County, NC and
its corporate seal to be hereunto a fixed, all on the day and year first above written.

Being all of a certain portion of land situated in Chapel Hill Township, Orange County, North Carolina bounded on the north by
Culbreth Road (variable public right -of -way), on the east, south and west by the property of Orange County Tract 1, DB 5743
PG 496 of the Orange County Registry (PIN 9777999032) and being more particularly described as:
Beginning at a computed point on the southern right -of -way of Culbreth Road, said point being the northeast corner
of Tract 1; thence, with said southern right -of -way N 77 °41'59" W 98.03' to a computed point, the northeast corner of
a 25' Access Easement, said point also being the true point of beginning; thence, leaving said computed point and
within Tract 1 Orange County the following seven calls: S 04 °41'00" W 734.35' to a point, N 85 007'16" W 26.64' to a
point, N 04 051'22" E 213.44' to a point, N 85 007'16" W 47.57' to a point, N 04 052'44" E 25.00' to a point, S 85 007'16"

Beginning at an existing iron pipe at the southernmost corner of Tract 1, said pipe being labeled Survey Control and

457.50' to a computed point having NC Grid co- ordinates of N: 778,760.68 and E: 1,980,277.89 and being the true
