BACKGROUND: A fireworks display is planned for the Town of Chapel Hill July 4 Celebration. As in years past, the display will be held at Kenan Stadium. GS 14.414, indicates that the Board shall consider a fireworks permit for"any and all kinds of fireworks and explosives,which are used for exhibitions or amusement purposes." GS 14-413 empowers the Commissioner to authorize and issue permits for the use of pyrotechnics in connection with"...shows of all descriptions—but only after satisfactory evidence is produced to the effect that said pyrotechnics will be used for the aforementioned purposes and none other." County policy further requires assurance from the sponsoring agency that adequate public safety measures will be exercised; and that the County will be protected as an additional insured on the insurance policy(iss)covering the event. Documents attached satisfy the checklist criteria previously endorsed by the Commissioners. RECOMMENDATION: The Manager recormnends that the Board approve a pyrotechnics permit for the Town of Chapel Hill's July 4 Celebration;and authorize the Chair to sign on behalf of the Board. Safety and fire protection will be provided by the departments listed below. However, the fireworks display operator will have the primary responsibility for safety. a. Fire Protection - Chapel Hill Fire Department - UNC Health and Safety Office CarrbQro Fire Department b. Fire Prevention - UNC Health and Safety Office - Chapel Hill Fire Department - Orange County Fire Marshal C. Crowd Control and Security - University Police - UNC Transportation and Parking - Chapel Hill Police - UNC Athletic Department d. Emergency Medical Services - South orange Rescue Squad 2 . Outdoor display of fireworks will be in accordance with the NFPA Code. The purpose of the code is to provide requirements for the reasonably safe conduction of outdoor fireworks displays. 3 . Crowd control will be the responsibility of police and transportation officials. Monitors will be located around the discharge site and fallout area to prevent spectators or other unauthorized persons from entering. Police will keep spectators out of the restricted access area. A copy of the site plan is attached. 4 . Interagency Unified Command will be in place within the Kenan Stadium press box .with the following departmental and agency representation: Chapel Hill Fire Department - Lead Agency UNC Health and Safety Office UNC Police UNC Athletic Department Chapel Hill Police Department South Orange Rescue Squad UNC Transportation 5. Measures to control smoke, fallout, and other fireworks by-products will be as follows: a. No fireworks or displays will be permitted within the stadium. The master of ceremonies will make a public address announcement to this effect. b. Two fire units will be assigned to the discharge site at the Ramshead parking lot for control and safety of the immediate discharge area. A third unit will be assigned to Ridge Road at the direction of Command. c. The Chapel Hill Fire Department will have firefighters with water fire extinguishers assigned within the stadium. d. Because of the possibility of misfires or duds, use of the Ramshead parking lot will be restricted until the--area is declared safe by the Chapel Hill Fire Marshal. e. After the site is declared safe, the Ramshead parking lot will be swept and vacuumed by the Town of Chapel Hill. f. Two EMS units will be assigned -- one to Gate 2 for crowd coverage and the other to the Kenan Field House lot for fire control coverage. 6. Spectator seating will be on the north side of the stadium with the upper and lower decks completely open for spectators. Entry and exit will be from Gates 2, 3 and 4 . Police will direct spectators away from the Ramshead lot. 7 . Timetable: 1200 Ramshead lot closed and cleared 1600 Fire Prevention, Fire Protection, Security in place 1600 Fireworks set up by Southern International Fireworks 1800 Ridge Road closed 1900 Command post in operation 1930 Gates open to the public 2015 Entertainment and Program .2130 Fireworks begin 2200 Fireworks end 8 . The decision to delay or postpone the fireworks due to inclement weather or any. other reason shall be made by Command. The rain date is July 5. 9 . Command may make operational revisions to this plan in order to manage changing circumstances. 10. The Fire Protection and Safety Plan will be executed by the following co-sponsors of the plan. Fireworks Unlimited is the only manufacturer-displayer in North Carolina, and Ken has worked in the factory, as wetl as shooting 60 plus fireworks displays. With his time in the factory and shooting dleplays. Ken has over 50 hours exper!.arks, and is one of the top 5 pyrotechnialans to the state. Ken was one, of the Lead Pyrotsohnioiam at the largest display in ttrs state in 1905 and is the lead pyrotachniiclan at every display he perform. if you have any questions. please give and a call. We will monitor set-up and safety precautions on site and will halt any unsafe or unregulated activities during the program. On June 23, 1994, the Town of Chapel Hill was approved for a pyrotechnic permit to be used in association with the July 4,1994 Celebration at Kenan Stadium,Chapel Hill,NC. The approval is granted based on the following assurances from the requestor: *Public Safety personnel will be on site during the event to ensure public safety and to provide adequate traffic control; *Proof of Liability insurance which includes the County as a named insured, has been submitted to the Orange County Director of Purchasing and Central Services. Limits of liability are no less than$1,000,000 per occurrence. *Show setup will be approved by the Town of Chapel Hill Fire Chief or his designee,prior to the beginning of show. Permitted explosives include those listed on attachment 31, as submitted by Fireworks,Unlimited,Inc. ♦Kenn Stadium has had a current fire inspection and is in compliance with the Standard Fire Prevention Code,1939,with North Carolina amandments.
