SUBJECT: RESOLUTIONS RESPONDING TO STIPULATIONS OF THE SPECIAL USE PERMIT FOR
THE SOUTHERN HUMAN SERVICES SITE; TRANSIT SERVICE TO THE SITE AND
CONFIRMING BUILDING LOCATION ON THE SITE

PURPOSE: To adopt resolutions responding to required improvements regarding the Southern
Human Services(SHS)site and requesting transit service to the County's property, as well as to have
the Board confirm the location of the building on the site.
BACKGROUND: The Chapel Hill Town Council considered the SHS site rezoning and the Special Use
Permit at their meeting on June 20. Since County Staff and the project architect had worked closely
with the Town staff throughout the planning process many of the stipulations were expected and are
acceptable. There are, however, areas which we would encourage the Board to seek further
collaboration with the Town. Specifically they include the following:
1. Required Improvement #4 of attached Resolution A,which requests that the entry drive be
redesigned to form a T-intersection with an east-west drive(See attached drawing#1).
2. Required Improvement #5(Resolution A),which asks that we make provisions for a future
roadway connection to the University property to the west of our site.
3. Required Improvement #9(Resolution A),which requests that six parking spaces along the
north side of the main entry drive be eliminated.
The Manager,Project Architect and County Staff suggest that the stipulations be further clarified in
a manner substantively similar to the following :
1. Required Improvement #4: We request further collaboration with Town staff regarding
the proposed T-intersection,to ensure that the future use of a buildable site on the property is not
precluded.
2. Required Improvement # 5: The Commissioners request further collaboration in making
provisions for a roadway connection to the west,specifically to address the types of traffic anticipated
and those impacts on County facilities.
3. Required Improvement #9: We agree that if the west roadway is constructed parking
spaces along the north side of the main entry should be removed in order to eliminate traffic hazards
of persons backing onto the street. We recommend that the Commissioners request clarification
from the Town as to speck location and the number of spaces to be removed and request that any
spaces removed be incorporated into the main body of parking,west of the proposed building.

In addition to approving the resolution which addresses the conditions of the Special Use Permit, we
recommend that the Board approve the resolution requesting transit service to Homestead Road. As
you may be aware,the closest bus stop to our site is on Airport Road. While it is feasible to provide
shuttle service for the clients from Homestead Road to the SHS Building,it would be preferable to have
a bus stop in close proximity to the entry driveway on Homestead Road. The attached resolution
requests a Homestead Road bus stop and suggests that the County Manager work with the Town
Manager during the construction period to determine the best manner of service delivery.
As a last item,we request that the Board endorse the location of the building on the site. The Planning
Committee for the SHS Building, which includes Commissioners Gordon and Halkiotis, the County
Manager,neighborhood repre sentatives, building users and other County staff, have supported the
location of the building for reasons which include,but are not limited to the following:
► The soil conditions and the utility easement at the front of our site would require that the
building be placed on one of the slopes facing Homestead Road,which would be more costly
and require more grading than the proposed location.
► The area is already cleared,thereby requiring less site work to be done;
► It allows a southern exposure,which is critical to what is going on in the building from an
energy point of view;
► The overall environmental impact from storm water run-off and pollutants generated by
vehicles is significantly minimized through use of this location since the surrounding
vegetation works as a"filter";
► The opportunity for expansion of this building in the future is best served by this location.
RECOMMENDATION: The Manager recommends that the Board :
1. Adopt the attached resolutions requesting transit service and clarifying the Board's
position on the stipulations of the Special Use Permit;and
2. Endorse the location of the building on the site by formal motion; and
3. Authorize the Chair to sign the resolutions and forward them to the Mayor of Chapel
Hill prior to the July 5,1884 Town Council meeting.
RESOLUTION A
A RESOLUTION APPROVING AN APPLICATION FOR A SPECIAL USE PERMIT
FOR THE ORANGE COUNTY SOUTHERN HUMAN SERVICES CENTER (File
Number 24..42)
BE IT RESOLVED by the Council of the Town of Chapel Hill that it finds that the Special
Use Permit application, proposed by Orange County on property identified as Chapel Hill
Township Tax Map 24, Lot 42, if developed according to the site plan dated February 9,
1994 and the conditions listed below:
1. Would be located, designed, and proposed to be operated so as to maintain or
promote the public health, safety, and general welfare;
2. Would comply with all required regulations and standards of the Development
Ordinance, including all applicable provisions of Articles 12, 13, 14, and 18, and with
all other applicable regulations;
3. Is a public necessity; and
4. Would conform with the general plans for the physical development of the Town as
embodied in the Development Ordinance and in the Comprehensive Plan.
BE IT FURTHER RESOLVED that the Council of the Town of Chapel Hill hereby
approves the application for the Special Use Permit for the Orange County Southern
Human Services Center in accordance with the plans listed above and with conditions listed
below:
Stipulations Specific to the Development
1. That construction begin by (two years from the date of
Council approval) and be completed by (three years from the
date of Council approval).
Required Improvements
2. Right of Wav Dedication: That half of a 90 foot right-of-way be dedicated along the
subject property's Homestead Road frontage.
3. Homestead Road ImRrwement: That Homestead Road be improved along the
subject property's frontage to half a 51 foot cross-section with curb and gutter,
sidewalk and bike lane.

4. Entry Drive to Town Standards: That the entry drive be built to Town public street
standards and be 27 feet back to back and be redesigned to form a T-intersection
with an east-west drive built to Town public street standards.
S. Future Connection to the West: That the applicant make provisions for a future
roadway connection to the west (University of North Carolina property).
6. Pedestrian Connections: That the applicant make provisions for future pedestrian
connections to the east and south.
7. Sidewalk Access from the West: That the sidewalk from Homestead Road
paralleling the driveway provide for pedestrian access from the west.side of the
driveway.
8. Maintenance of Entrance Drive: That a note be included on the final plans
indicating that Orange County will be responsible for maintenance of the entrance
drive.
9. Parking Spaces Removed: That the six parking spaces along the north side of the
main entry drive, as currently proposed, be eliminated.
10. Parking Lot to Town Standards: That the internal drive aisles, and parking lot be
constructed to Town standard and that any alternate paving used in the parking lot
have the same load bearing capacity as the Town's standard pavement design.
Stipulations Related to the Resource Conservation District
11. Boundaries: That the boundaries of the Resource Conservation District be shown
on the final plat and final plans with a note indicating that "Development shall be
restricted within the Resource Conservation District in accordance with the
Development Ordinance."
12. Variase That all variances necessary for development within the Resource
Conservation District be obtained before application for final plat or final plan
approval.
Stilmlations Related to State and Federal Governments Approvals
13. Aovroval of Encroachment Agreements That any required State permits or
encroachment agreements be approved and copies of the approved permits and
agreements be submitted to the Town of Chapel Hill prior to the issuance of a
Zoning Compliance Permit.
Stipulations Related to Landscape Elements
14. Landscape Plan Approval: That a detailed landscape plan, landscape maintenance
plan, and lighting plan be approved by the Appearance Commission prior to issuance
of a Zoning Compliance Permit.
15. Landscape Protection Plan: That a Landscape Protection Plan be approved by the
Town Manager prior to issuance of a Zoning Compliance Permit.
Stipulations Related to Building Elevations
16. Building Elevation Approval: That detailed building elevations be approved by the
Appearance Commission prior to issuance of a Zoning Compliance Permit.
17. Fire ow: That a fire flow report prepared by a registered professional engineer,
showing that flows meet the minimum requirements of the Design Manual, be
approved by the Town Manager prior to issuance of a Zoning Compliance Permit.
18. Utility ighting Plan ARproval: That the final utility/lighting plan be approved by •
Orange Water and Sewer Authority, Duke Power, Public Service Company,Southern
Bell, and the Town Manager before issuance of a Zoning Compliance Permit.
Miscellaneous Stipulations
19. Solid Waste Management Plan: That a detailed solid waste management plan,
including a recycling plan and plan for management of construction debris, be
approved by the Town Manager prior to the issuance of a Zoning Compliance
Permit.
20. Transportation Management Plan: That a Transportation Management Plan be
approved by the Town Manager prior to issuance of a Zoning Compliance Permit.
21. Detailed Plans: That final detailed site plan, grading plan, utility/lighting plans,
stormwater management plan (with hydraulic calculations), landscape plan and
landscape management plan be approved by the Town Manager before issuance of
a Zoning Compliance Permit, and that such plans conform to the plans approved by
this application and demonstrate compliance with all applicable conditions and the
design standards of the Development Ordinance and the Design Manual.
22. Erosion Control: That a soil erosion and sedimentation control plan be approved by
the NC Department of Environment, Health and Natural Resources and the Town
Manager before issuance of a Zoning Compliance Permit.
23. Silt Control: That the applicant take appropriate measures to prevent and remove
the deposit of wet or dry silt on adjacent paved roadways.
24. Continued Validity: That continued validity and effectiveness of this approval is
expressly conditioned on the continued compliance with the plans and conditions
listed above.
25. Non•severability: If any of the above conditions is held to be invalid, approval in its
entirety shall be void.
BE IT FURTHER RESOLVED that the Council of the Town of Chapel Hill hereby
approves the application for a Special Use Permit for the Orange County Southern Human
Services Center in accordance with the plans and conditions listed above.

RESOLUTION
RESPONSE TO STIPULATIONS OF SPECIAL USE PERMIT FOR THE
SOUTHERN HUMAN SERVICES CENTER SITE
WHEREAS, County Staff and the Project Architect have worked closely with Town Staff regarding
the Southern Human Service Center Project;and
WHEREAS, Resolution A,Approving an Application For Special Use Permit For The Orange
County Southern Human Services Center, presents certain requirements for the
County's project;and
WHEREAS, The County desires further collaboration with the Town on Required kiWrovements,
numbers four(4),five(5),and nine(9);
THEREFORE, IT IS RESOLVED THAT the County Commissioners accept the conditions of approval of
the Special Use Permit with the following requests:
1. RE Stipulation 4: We request further collaboration with Town staff regarding the
proposed T-intersection, to ensure that the use of a future buildable site on the property is not
precluded.
2. RE Stipulation 5: As the Commissioners authorize the architect to amend the site plan
to prevent any physical barrier to a potential roadway connection to the west (University of North
Carolina property),the Commissioners request further collaboration and discussion with the Town with
regard to general plans for the roadway system in this area and specifically the types and volume of
traffic anticipated from a west connection and the impacts on County facilities.
3. RE Stipulation 9: The Commissioners request clarification from the Town as to
speck location and the number of spaces to be removed and request that any spaces removed be
incorporated into the main body of parking,west of the proposed building.

RESOLUTION
REQUESTING TRANSIT SERVICE TO THE
COUNTY'S PROPERTY ON HOMESTEAD ROAD
WHEREAS, the County plans to construct a building on Homestead Road from which to provide
human services for the Citizens of Southern Orange County;and
WHEREAS, the bus stop closest to the site of the proposed Southern Human Services Building is
presently on Airport Road;and
WHEREAS, it is clear to the County Commissioners that citizens of Chapel Hill and Carrboro using
public transit service should not be required to walk a significant distance from the bus
stop to the Southern Human Services facility;and
WHEREAS, the County will provide shuttle service from the closest bus stop to the Southern Human
Services facility;
THEREFORE, BE IT RESOLVED THAT the County Commissioners request that the Town Council
consider the prospects of extending bus service to Homestead Road; and we further suggest to the
Town Council that the Town Manager work with the County Manager during the approximately two-
year construction period of the Southern Human Services Building to establish the most acceptable
mix of Town Transit/County shuttle service for the facility.
