DEPARTMENT: HEALTH PUBLIC HEARING: Yes X No ATTACHMENT(S) : INFORMATION CONTACT: 1. 3 page contract HEALTH DIRECTOR'S OFFICE X2411 TELEPHONE NUMBER: Hillsborough - 732-8181 Chapel Hill - 968-4501 Mebane - 227-2031 Durham - 688-7331 PURPOSE: To approve a contract between the UNC School of Dentistry and the Orange County Health Department for the coordination of a dental screening program for 0 - 5 year old children funded by Smart Start. Approximately, 1,200 children will be screened by sixteen teams of dental hygiene students under the professional supervision of dental school faculty. BACKGROUND: The Board of Commissioners have previously approved the Smart Start grant on April 4, 1994, and the contract between the Department of Human Resources and the Health Department for the funding of the dental screening program and other initiatives on May 2, 1994 . The enclosed document is a sub-contract from the health department to the dental school for the coordination of the dental screening project. It enables the health department to avoid having to establish a temporary position and has enabled closer coordination between the health department, the School of Dentistry and the dental and hygiene students, who will actually carry out the work. No county funds are required, the contract is fully funded by the Smart Start grant and the work will be completed by June 30, 1994. RECOMMENDATIONS) The Manager recommends that the contract be approved. 2 MEMORANDUM OF AGREEMENT BETWEEN THE UNIVERSITY OF NORTH CAROLINA AT CHAPEL HILL CHAPEL HILL, NORTH CAROLINA for the DEPARTMENT OF DENTAL ECOLOGY in the SCHOOL OF DENTISTRY and Orange County Health Department for the Smart Start Grant I. PURPOSE This document is a Memorandum of Agreement between The University of North Carolina at Chapel Hill, for its Department of Dental Ecology in the School of Dentistry, hereafter referred to as the "University," and Orange County Health Department, hereafter referred to as the "0031)", for the purpose of providing a Coordinator for its Smart Start Grant awarded by the Orange County Partnership for Young Children, hereafter referred to as "OPYC" II. EFFECTIVE DATES This agreement shall be effective as of April 1, 1994 and shall remain in effect until altered Or terminated as set forth below. Either party may request a change in either the terms of or the termination of this agreement by giving the other party 60 (sixty) days written notice in advance of the desired termination date. Any agreed change to this agreement must be approved by written endorsement thereto. III. GENERAL AGREEMENT During the performance of this agreement, both parties agree as follows: A. The contracting party hereby agrees with the University that, in its educational and/or employment practices; said contracting party will not discriminate against any person because of race, color, religion, sex, national origin, age, or disability. B. The OCHD will not be responsible for damages arising from personal injury to students of the University while they are present at the OCHD unless personal injury was caused by the negligence of the OCHD, its employees, or agents. C. In the event the student is exposed to blood or body fluids, the OCHD will be responsible for providing an initial response, according to the Institution's Blood- ' Borne Pathogens Standard. The student will be required to return to University of North Carolina Student Health Services for post-incident testing and counseling if feasible. In the event the student is unable to do so in a timely manner, the OCHD will provide access to testing and counseling for the student. The student will be responsible for the payment of services, but will be able to request reimbursement from the University of North Carolina. The University of North Carolina Pa 3 School of Dentistry for the Department of Dental Ecology and Orange County Health Department for the Smart Start Grant D. The University of North Carolina will be responsible for the negligence of its employees and agents to the extent of the North Carolina Tort Claims Act. IV. SPECIFIC RESPONSIBILITIES OF THE UNIVERSITY The University acknowledges the following specific responsibilities in connection with this agreement: A. To Provide a Project Coordinator for the Smart Start Program who will: 1) Schedule preselected senior dental and dental hygiene students to visit the Orange County Health Department and the majority of day care centers in Orange County to perform dental screenings, examinations, education and preventive treatment; 2) inform the day care centers and the parents regarding all aspects for the student visits; 3) provide the OCHD with the results of the screening and examinations; 4) be available to answer questions from Parents and the day care center directors; 5) design screening and examination report forms,write informational advertisements to appear in local newspapers;6) be responsible for inventory of all supplies used in the study (these supplies will be purchased by the OPYC grant); 7) gather data/results of screening and examinations, utilize the statistical analysis of the results to compile a report to the OCHD regarding the status of the teeth of the smart start children; 8) consult with the NC Public Health Dental Hygienist in order to provide the specific dental educational materials needed for the children,parents and the day care Personnel; 9) schedule dental attendings who will serve as preceptors to the dental students and the dental hygiene students while at the OCHD Dental Clinics, B. To insure that University students, who are the subject of this agreement, abide by all existing rules and regulations of the OCHD in the performance of their activities at the OCHD. C. To be responsible for providing adequate, professional liability insurance for the University and its students who are the subject of this agreement. While the student is on rotation,their professional liability insurance coverage through Medical Security insurance_Company will be provided by the School of Dentistry (with coverage of at least $200,040 per incident up to $600,000 dental hygiene students and $1,000,000 to - $3,000,000 a year for dental students). - D. The University shall be responsible for training its students to-follow the OSHA Blood-borne Pathogens Standards, ensuring that its students comply with health requirements established by North Carolina state regulations and the University. To maintain proper health records of its students rotating through the OCHD, and instructing its students about Hepatitis B vaccinations, about the student's responsibility for post-exposure follow-up and any incurred costs, about the students responsibility for the provision of protective equipment, and proper past-exposure record-keeping. F. To provide proof of Blood-borne Pathogens training for each student. G. The University shall bill the OCHD for the entire $8,000 for the services of the Project Coordinator by June 10, 1994. V. SPECIFIC RESPONSIBILITIES OF THE OCHD A. The OCHD shall reimburse the University for these services by June 30, 1994, IN WITNESS WHEREOF, the OCHD and the University have executed this agreement as of the date first written herein.
