PURPOSE: To present to the Board of Commissioners a draft notice for a
public hearing on the Waste Treatment Oversight Program
BACKGROUND: During the discussion of the proposed Waste Treatment
Oversight Program at the April 19 meeting of the BOCC, the
County Commissioners determined that a public hearing
should be held on the issue. The Commissioners directed
staff to prepare the notice for this public hearing and
to submit the notice for the Board's approval at the next
regular meeting of the BOCC.
RECOMMENDATION: The administration recommends that the Board review the
proposed notice and approve the notice for publication.

NOTICE OF PUBLIC HEARING ON PROPOSED PROGRAMS MODIFYING COUNTY
POLICIES, PRACTICES AND REGULATIONS RELATED TO ON-SITE WASTE
TREATMENT SYSTEMS FOR ORANGE COUNTY, NC
Pursuant to the directions of Orange County Board of
Commissioners, notice is hereby given that a public hearing will
be held in the Public Meeting Room at the Orange Water and Sewer
Authority office building at 400 Jones-Ferry Road in Carrboro on
Tuesday, May 17, 1994 at 7 : 30 PM for the purpose of giving all
interested citizens an opportunity to speak for or against the
following items:
1. Public health concerns related to the use of on-site waste
treatment systems having treatment capacity greater than that
of standard single family systems or technology more complex
than that of conventional septic systems. Historically,
these systems have a much higher rate of failure than single-
family conventional (gravity flow) septic systems. State
health regulations now require local health departments to
periodically inspect many of these types of systems.
2 . An Orange County program to provide periodic inspections,
more frequent than state requirements, to monitor maintenance
and operations practices for specified types of on-site waste
treatment systems. The intent of the program is to promote
operational and maintenance practices that will prolong the
systems' useful life-span and will provide a level of waste
treatment that protects public health and the environment.
The program is proposed to be financed through inspection
fees charged to system owners and users rather than with
Property tax funds.
3 . An Orange County program to ensure the availability of the
financial resources necessary to make repairs to specified
types of on-site waste treatment systems. The intent of the
program is to ensure that system owners (and Orange County if
necessary) have access to funds sufficient to repair any
failing system. Funds are to be provided by system owners
through letters of credit or escrowed funds. Any funds
advanced for system repair by the County will be subject to
repayment and will be secured by liens against the property
of system owners.
All waste treatment systems permitted after the adoption of these 3
programs will be affected by the provisions and requirements of
the programs. Furthermore, existing treatment systems may be
included in the programs at a later date. The following types of
systems are proposed for inclusion into these programs:
* CONVENTIONAL SEPTIC TANK SYSTEMS
non-single family use or single family dwelling larger than
four bedrooms, inspected every five years at cost of $100 per
inspection
* PUMP-CONVENTIONAL SEPTIC TANK SYSTEMS WITH ONE PUMP
- inspected once every five years at a cost $100 per inspection
* LOW PRESSURE SEPTIC TANK SYSTEMS WITH ONE PUMP
- inspected once every year at a cost $100 per inspection -
* PUMP-CONVENTIONAL and LOW PRESSURE SEPTIC TANK SYSTEMS, TWO OR
MORE PUMPS - TREATMENT CAPACITY LESS THAN 3001 GALLONS PER DAY
- inspected once every year at a cost of $100 per inspection -
* PUMP CONVENTIONAL and LOW PRESSURE SEPTIC TANK SYSTEMS -
TREATMENT CAPACITY IN EXCESS OF 3000 GALLONS PER DAY OR WITH A
SAND FILTER PRE-TREATMENT SYSTEM
- inspected twice per year at a cost of $100 per inspection -
* PUMP CONVENTIONAL AND LOW PRESSURE SEPTIC TANK SYSTEMS WITH
MECHANICAL, BIOLOGICAL OR CHEMICAL PRE-TREATMENT - TREATMENT
CAPACITY LESS THAN 3001 GALLONS PER DAY
- inspected twice per year at a cost of $100 per inspection -
* PUMP CONVENTIONAL AND LOW PRESSURE SEPTIC TANK SYSTEMS WITH
MECHANICAL, BIOLOGICAL OR CHEMICAL PRE-TREATMENT -TREATMENT
CAPACITY IN EXCESS OF 3000 GALLONS PER DAY
- inspected monthly at a cost of $100 per inspection -
* SPRAY IRRIGATION OR DISCHARGING SAND FILTER SYSTEMS, SINGLE
FAMILY USE
- inspected twice per year at a cost $100 per inspection -
* SPRAY IRRIGATION OR DISCHARGING SAND FILTER SYSTEMS, NON-SINGLE
FAMILY USE
- inspected quarterly at a cost of $100 per inspection. These
systems are also subject to additional fees associated with
cost of laboratory analysis of ground water, effluent and
stream samples if such sampling is required by the system's
operating or discharge permit
• PACKAGE WASTE TREATMENT PLANTS
- inspected quarterly at a cost of $100 per inspection. These
systems are also subject to additional fees associated with
cost of laboratory analysis of effluent and stream samples if
such sampling is required by the system's operating or
discharge permit
• SLUDGE APPLICATION SITES
- inspected during application at a cost of $100 per inspection
