PURPOSE:
To adopt a resolution authorizing the exchange of land between the
County and Habitat For Humanity.
BACKGROUND:
At the February 1, 1994 County Commissioners' Meeting, County Staff
informed the Board that Habitat For Humanity requested a land exchange
with the County near the Efland-Cheeks Community Center. Habitat
proposed to give the County 0.12 acre in exchange for the County giving
0. 12 acre to Habitat. Property given to the County will make the
County lot accessible from Richmond Road. Property given to Habitat
will make its parcel suitable for building a single family dwelling.
The Board directed staff to follow the procedure outlined by the County
Attorney for the land exchange. Relative values of both properties
have been determined; properties have been surveyed with the land to be
exchanged subdivided; a title search of Habitat's property has been
completed; and a resolution authorizing the land exchange has be
drafted with public notice published in a local newspaper 10 days
before the April 19, 1994 meeting describing the land exchange.
RECOMMENDATION(S) :
Manager recommends that the Board adopt the resolution authorizing the
land exchange between Habitat for Humanity and the County.

PUBLIC NOTICE
OF LAND EXCHANGE
Pursuant to N.C. Gen. Stat. §160A-271, the Orange County Board
of Commissioners hereby gives notice of its intent to authorize, at
its next regular meeting on April 19, 1994 , an exchange of land
owned by Orange County for land owned by the heirs of John L.
Efland, Sr. which is to be donated to Habitat for Humanity.
One of the Tracts of land involved in the exchange, hereafter
referred to as Tract A, currently owned by John L. Efland's heirs,
is being donated to Habitat For Humanity. It is located in Cheeks
Township, Orange County, on Richmond Road (SR 1312) . It is part of
the lot described in the Orange County tax map as 3 . 31 .A. 20C, PIN
# 9844-39-2803 . The other of the tracts of land involved in the
exchange, hereafter referred to as Tract B, currently owned by
Orange County, is located adjacent to the Efland lot, off of
Richmond Road (SR 1312) . It is part of the lot described in the
Orange County tax map as 3 . 31 .A. 37 , PIN # 9844-39-4709 . Tract A
and Tract B are also designated as such on the plat of survey
entitled "Property Surveyed for Orange County" by Callemyn Land
Surveyors, dated 3/9/94 and on file in the Orange County Manager's
office, to which plat reference is hereby made for more detailed
information concerning the proposed land exchange.
The County proposes to exchange Tract B valued at $1,082 , for
Tract A valued at $1,202 . In the exchange the County would receive
a triangle shaped portion of the Efland lot which would be joined
with an adjacent 1 .5 acre County owned lot. This would provide
road access to the existing County owned 1. 5 acre lot. In exchange
the County would provide a rectangular portion of its 1 .5 acre lot

to be joined with a the remainder of the Efland lot. This would
make the Efland lot suitable for building a home for the Habitat
for Humanity project.

RESOLUTION
ORANGE COUNTY
WHEREAS, Orange County owns a tract or parcel of land located
in Cheeks Township, Orange County, North Carolina, off of Richmond
Road (SR 1312) , and it is part of the lot described in the Orange
County tax map as 3.31.A.37, PIN # 9844-39-4709, hereafter referred
to sometimes as Tract B and sometimes as the County owned lot, and
WHEREAS, the heirs of John L. Efland, Sr. own a tract or
parcel of land adjoining the Orange County property in Cheeks
Township, Orange County, North Carolina, on Richmond Road (SR
1312) , and it is part of the lot described in the Orange County tax
map as 3.31.A.20C, PIN # 9844-39-2803, hereafter referred to
sometimes as Tract A and sometimes as the Efland lot, and
WHEREAS, Tract A and Tract B are also designated as such on the
plat of survey entitled "Property Surveyed for Orange County" by
Callemyn Land Surveyors, dated 3/9/94 and on file in the Orange
County Manager's office, and will be filed with the Orange County
Register of Deeds when the deeds are exchanged, to which plat
reference is hereby made for more detailed information, and
WHEREAS, Tract A is being donated by the John L. Efland heirs
to Habitat For Humanity, and
WHEREAS, Orange County wishes to exchange part of Tract B for
part of Tract A, and
WHEREAS, in the exchange the County would receive a triangle
shaped portion of the Efland lot, valued at $1,202, which would be
joined with an adjacent 1.5 acre County owned lot, providing road

access to the existing County owned lot, and
WHEREAS, in exchange the County would provide a rectangular
portion of its 1.5 acre lot, valued at $1,082, to be joined with
the remainder of the Efland lot, making the Efland lot suitable for
building a home for the Habitat for Humanity project, and
WHEREAS, Orange County is receiving full and fair
consideration for the land it owns, and
WHEREAS, Orange County has held a public hearing on this land
exchange after giving 10 days' public notice which described the
properties to be exchanged, stated the value of the properties, and
announced the Board of Commissioners intent to authorize the
exchange, and
WHEREAS, North Carolina General Statutes 5160A-271, authorizes
Orange County to exchange any real property belonging to the County
for other real property.
IT IS THEREFORE RESOLVED THAT
1. Orange County, pursuant to North Carolina General
Statutes S160A-271, offers to exchange with the heirs of John
Efland, Jr. the property described above as Tract B for the Orange
County property described above as Tract A.
2 . The Chair of the Board of County Commissioners is
authorized to execute a deed for Tract B, on behalf of Orange
County (and the Clerk to the Board of Commissioners is authorized
to attest this deed) , in a form approved by the Orange County
attorney, naming as grantee Habitat for Humanity.
3 . The Orange County attorney is authorized to accept on
behalf of Orange County, the deed for Tract A, in a form approved

by the Orange County attorney, in exchange for the deed for Tract
B.
