PURPOSE: To consider accepting a $10,000 Survey and Planning Grant from the State
Historic Preservation Office.
BACKGROUND: At its January 18, 1994 meeting, the Board of Commissioners authorized the
County Manager to apply for up to$10,000 from the Survey and Planning Grant
Program administered by the State Historic Preservation Office. The amount
would be used to carry out Phase IV of an overall preservation program,
consisting of the preparation of a Historic Preservation Element as part of the
Comprehensive Plan, i.e., the "game plan" to follow in terms a historic
preservation program. Refer to the attached application for a complete project
description.
The Planning Director was notified on March 22, 1994 that the application has
been approved.To receive the giant,the County must sign the attached Subgrant
Agreement and provide certification of matching funds.This must be accomplished
by April 30, 1994.
The project is estimated to cost$45,890,including$10,000 in grant funds,$19,040
in County matching funds ($10,000 appropriation plus one-time$9,040 diversion
of intern funds in FY 1994-95 budget), and$16,850 in-kind services.A consultant
is to be sought to prepare the Historic Preservation Element with assistance from
the Planning Department Staff. Phase V, the preparation of National Register
nominations, would be the subject of a grant request in 1995.
At its March 23, 1994 meeting, the Historic Preservation Commission voted
unanimously to recommend acceptance of the grant award.
RECOMMENDATION: The Administration recommends that the County Manager be authorized
to sign the Subgrant Agreement and provide certification of matching
funds.

Dear Mr. Collins:
We are pleased to inform you that your application for a 1994
Certified Local Government (CLG) grant is one of thirteen
selected for funding from among twenty-three proposals. Grant
funds are made available to the State Historic Preservation
Office, Division of Archives and History, from the Historic
Preservation Fund (HPF) administered by the U. S. Department of
the Interior, National Park Service.
This year approximately $72, 000 will be awarded to county and
municipal governments participating in the CLG program. Funding
is targeted for archaeology, restoration, architectural survey,
preservation planning, and nominations to the National Register
of Historic Places.
The enclosed Grant Project Outline, based on your grant
application, will provide a brief summary of anticipated
activities and costs related to your project. To convey your
acceptance of the grant, with its related conditions, please sign
both copies of the enclosed Subgrant Agreement and the
certification of Matching Share Form and return them by April 30,
1994 to: Lloyd D. Childers, grants administrator, State Historic
Preservation Office, Division of Archives and History, 109 East

Enclosed with this letter is an "Introduction to Subgrantee
Requirements" memorandum from Ms. Childers, along with a Grantee
Handbook and information about a Grants Workshop to be held in
Raleigh on Tuesday, June 7. During that meeting, Deputy
Secretary of the Department of Cultural Resources, Elizabeth
Buford, will present Grant Award Certificates. I hope that you

PROJECT DESCRIPTION
The project is the preparation of a Historic Preservation Element
of the Orange County Comprehensive Plan. It will provide a
framework to preserve the county's rural character and heritage in
the face of accelerating pressures for growth and development. The
preservation plan will integrate historic preservation with
conservation of other cultural and natural resources. Orange
County's planning staff will coordinate the project. A fulltime
consultant will be hired to undertake the planning process and the
plan itself, assisted by the planning staff. The architectural
inventory is complete, and the archaeological survey is underway.
The consultant will develop a plan that discusses the county's
development history, 'identifies and evaluates the historic
architecture and archaeological resources; identifies threats and
opportunities; and sets community goals, objectives, and action
recommendations for preservation. The document will describe
preservation tools and techniques including the National Register
of Historic Places, local designation, building and housing codes,
development review procedures, transfer of development rights,
financial incentives, and raising public awareness. The plan will
address conflicts and linkages with other community goals in the
comprehensive plan. There will be a strong element of public
participation using multiple strategies in the development of the
plan. Two documents will result: the description of the planning
process and the plan itself. Both will be printed and made
available as a model for other jurisdictions.

SUBGRANT AGREEMENT
This Subgrant Agreement is entered into this 21st day of
March, 1994 by the State Historic Preservation Office (HPO) ,
hereafter known as the HPO, and Orange County Historic
Preservation Commission, Subgrantee, for and in consideration of
a federal grant in the amount of $10, 000 (ten thousand dollars) ,
for the purpose of preparation of a historic preservation plan
for Orange County. The project must be completed no later than
September 30, 1995.
SUBGRANTEE STANDARDS: The Subgrantee agrees to: have a
satisfactory record of performance; comply with the required
completion schedule for the project; conform with debarment
requirements; and be otherwise qualified and eligible to receive
a grant award under applicable laws and regulations.
AGREEMENT: The Subgrantee agrees to match the grant with funds
or services from nonfederal sources within the grant period, to
use grant and matching funds or services for the purpose
specified above, and to furnish such reports and documentation,
financial or otherwise, as may be specified by the HPO. Project
activities shall be performed according to the Secretary of the
Interior's Standards for Archaeology and Historic Preservation,
! under the guidelines and professional supervision of the HPO.
l APPENDIX FOR SUBGRANT AGREEMENTS: The Subgrantee agrees to the
stipulations contained in the attached "Appendix for Subgrant
Agreements". The Appendix shall be attached to all contracts

involving project activities.
PAYMENT OF GRANT FUNDS: The HPO agrees to reimburse the
Subgrantee up to 60% of all expenditures for the project as
described. Upon request the HPO may advance the Subgrantee up to
25% of the HPO's share of the project cost. After satisfactory
documentation of this advance, including at least 40% matching
share, additional advances may be requested. Final payment of
grant funds will be paid only after satisfactory project
a completion.

APPENDIX
for
SUBGRANT AGREEMENTS -
The following stipulations apply to all subgrant projects
funded in part by federal Historic Preservation Fund (HPF)
I monies awarded to the North Carolina Department of Cultural
Resources, Division of Archives and History, State Historic
Preservation Office (HPO) , by the U. S. Department of the
Interior, National Park Service.
Questions about the application of these conditions to
specific projects are available from the HPO project

1 . PROCUREMENT: Subgrantees must forward to the HPO
evidence of compliance with Federal competitive
procurement requirements for professional services and
subcontracts prior to reimbursement , if applicable.
2. RETENTION OF RECORDS: Acceptable federal and nonfederal
share supporting documentation must be submitted prior to
' reimbursement , if applicable. Documentation includes:
copies of contract , timesheets, front and back of
canceled checks (or computer printouts) , invoices, etc.
3 . CHANGES IN SCOPE: The approved scope of work, products,
budget and performance/reporting milestones included in
the contract cannot be changed without prior written
approval from the HPO.
4. LOBBYING PROHIBITED: Subgrantees must conform with the
following text of 18 U.S.C. 1913 , which prohibits the use
of the subgrant funds for lobbying: No part of. the money
appropriated by any enactment of Congress shall , in the
absence of express authorization by Congress, be used
directly or indirectly to pay for any personal service,
advertisement, telegram, telephone, letter, printed or
written matter, or other device, intended or designated
to influence in any manner a Member of Congress, to favor
or oppose by vote or otherwise, any legislation or
appropriation by Congress, whether before or after the
introduction of any bill or resolution proposing such
legislation or appropriation; but this shall not prevent
officers or employees of the United States or its
Department or agencies from communication to Members of
Congress on the request of any Member or to Congress,
through the proper official channels, requests for
legislation or appropriations which they deem necessary
for the efficient conduct of the public business.

5. NONFEDERAL AUDIT: Subgrantees are responsible for
obtaining audits in accordance with the Single Audit Act
of 1984 for State or local governments, or the audit
requirements of OMB Circular A-110 for universities and
nonprofit organizations. The audits shall be made by an
independent auditor in accordance with generally accepted
government auditing standards covering financial and
compliance audits.
6 . PUBLICATIONS: Acknowledgment of federal grant assistance
should be made in connection with the publication of any
material based on, or developed under, any activity
supported by HPF grant funds, as follows: The activity
that is the subject of this ( type of publication) has
been financed ( in part/entirely) with federal funds from
the National Park Service, Department of the Interior.
However, the contents and opinions do not necessarily
reflect the views or policies of the Department of the
Interior, nor does the mention of trade names or
commercial products constitute endorsement or
recommendation by the Department of the Interior.
NOTE: The design and content of any publication
produced from a survey of architectural or
archaeological resources must be reviewed and
approved by the HPO prior to its printing.
7 . SUSPENSION OR TERMINATION OF SUBGRANT: Voluntary and
involuntary suspension or termination of the subgrant , in
whole or in part , by either the State or subgrantee may
occur at any time prior to the date of project
completion.
8. STANDA..^,S FOR FINAL PRODUCTS: Final products which do
not conform to the terms and conditions of the grant
agreement or which do not meet the applicable Secretary
of the Interior 's "Standards" will not be reimbursed.
9 . EQUAL OPPORTUNITY: Subgrantee must comply with Title VI
of the Civil Rights Act of 1964 and Section 504 of the
Rehabilitation Act of 1973 .
10 . OTHER REQUIREMENTS: In addition to the terms detailed in
this Subgrant Agreement , all federal requirements
governing grants are applicable. (OMB Circulars A-87 or

On a separate sheet of paper, please describe in one well developed paragraph exactly what will be
accomplished with the grant and matching funds, including in-kind. Applications for architectural
surveys should include an estimate of the number of acres and properties to be surveyed. Historic
Preservation Office staff are available for assistance in developing the project description, including
an estimated budget.
This abstract may also include one or two other paragraphs describing methods to be employed or
information on how the proposed project fits into an overall plan of preservation activities for your
community. For example, if this is Phase II of a four-phased action plan, what was Phase I and when
was it completed, and how will Phases III and IV build on Phases I and H? PLEASE LIMIT THE

Since the inception of its comprehensive planning program, a goal of Orange County has been the
completion of detailed inventories of its cultural, historical, recreational, biological, and geological resources.
In 1986, the Planning Department completed a general listing of such sites in the unincorporated portions
of the county. In 1988, a Master Recreation and Parks Plan was prepared for Orange County. During the
same year,the Triangle Land Conservancy completed an Inventory of Natural Areas and Wildlife Habitats of
Orange County. These studies provided the detailed inventory of recreational, geological, and biological

sites.
Consistent with the above goal, Orange County applied for Survey and Planning Grant Funds to
undertake inventories of historic and archaeological sites in the unincorporated portions of the
county. These inventories as well as the preparation of a publication manuscript were undertaken in the
following phases:

The results of the archaeological survey as well as the architectural survey were to be used in

completing Phase IV of Orange County's program. That phase consisted of the preparation of a
`. preservation plan; e.g., the Historic Preservation Element of the Comprehensive Plan, and nominations
for the National Register of Historic Places. Rather than a four-phase project, Orange County proposes
to expand the project to five phases. Phase IV will involve the preparation of the Historic Preservation
Element, while Phase V will consist of the preparation of the National Register nominations.
The rationale for this shift in priorities is based on Orange County's long-term use of its
Comprehensive Plan to guide land use decisions.While the Historic Preservation Element is but one part of
that Plan, it will provide a framework within which the Board of Commissioners, the Historic Preservation
Commission, and the Planning Board can work to preserve the county's rural character and heritage.In that
sense, the process and product produced from the project could serve as a prototype for other rural counties
threatened with the loss of historic,architectural,and archaeological resources from growth and development.
It is an overall program approach to preservation rather than piecemeal initiatives which may gain some
immediate benefits but provide limited long-term results.

+ Because of the above mentioned initiatives, the progressive attitude of its governing and advisory
boards, and the experience of its staff(see attached resumes), Orange County feels it is uniquely positioned
to provide what will serve as a model for other jurisdictions. Because of the nature of the project, Orange
County does feel that the full-time efforts of a consultant, supplemented by staff assistance, will be required.

} The attached budget and the level of Orange County's funding reflects this commitment. All phases will be
subject to local funding approval as well as the availability of Planning and Survey Grant Funds. A general
outline of the Historic Preservation Element is provided below.
