PUBLIC CHARGE The Board of Commissioners pledgee to the citizens of Orange County its respect. The Board asks its citizens to conduct themselves in a respectful, courteous manner, both with the Board and with fellow citizens. At any time should any member of the Board or any citizen fail to observe this public charge, the Chair will ask the offending member to leave the meeting until that individual regains personal control. Should decorum fail to be restored, the Chair will recess the meeting until such time that a genuine commitment to this public charge is observed C. PUBLIC HEARING ITEMS 1. ADJOURNMENT Note: The Planning Board will make a recommendation no sooner than its meeting of March 21, 1894. The Board of Commissioners will consider the items for decision no sooner than April 4, 1884. a FEBRUARY 28, 1992 PUBLIC HEARING AGENDA SUMMARY PURPOSE OF THE HEARING On January 1, 1994, new Orange County zoning provisions went into effect to implement the State-mandated watershed protection standards. Several property owners have since indicated that a number of lots would be rendered unbuildable or design flexibility lost as a result of some Provisions.At a regular Commissioners' meeting in January, Chair Carey asked that staff review the standards in question. Items C.1(a) and C.1(b) on the agenda have been proposed by the staff to address the property owners' concerns. Two additional text amendments, Items CA(c) and C.1(d) have been proposed to clarify Provisions or include adopted policies in the Zoning Ordinance, based on the recommendation of the County Attorney. TOPICS TO BE CONSIDERED Item CA(a) This amendment would allow staff to approve reductions of the 800 foot septic system setback and 150 foot building setback from reservoirs if needed to allow lots created before the effective date to be developed. Currently, this may only be done through approval of a variance by the Board of Adjustment. Given the number of lots,particularly around Lake Orange, the current provisions could result in a large number of variance requests. Item CA(b) This amendment would allow the use of off-site or off-property septic easements in all protected watersheds except University Lake watershed. Currently,such easements are prohibited. Item CA(c) This amendment clarifies the point at which a lot is "created"for purposes of determining whether or not the lot is subject to amendments made to the Zoning Ordinance and/or Subdivision Regulations. Item C.1(d) This amendment incorporates the provisions of the Water& Sewer Policy into the Zoning Ordinance, including the circumstances under which water and sewer lines may or may not be extended, and the basis on which alternative wastewater treatment systems may be used, i.e., upon approval of a Special Use Permit. I9SUE8&CONCERNS Other than the concern expressed by property owners, the only comment received to date has been from OWASA. That agency opposes any changes to the standards for University Lake and Cane Creek watersheds that are less restrictive than those that went into effect on January 1.
