PURPOSE: Consideration of the Preliminary Plan for the division
of lot 18R in New Hope Springs Subdivision, Section
One-Phase B.
BACKGROUND: The property is located in Chapel Hill Township at the
southwest corner of Davis Road (SR 1129) and Hope
Valley Drive on the north side of New Hope Springs
Drive. Phase B of Section One is zoned Residential-1,
with a small portion in the Protected Watershed of the
Upper Eno River.
The Land Use Plan designations are Rural Residential
and Water Supply Watershed. Adjacent land use is
residential. The most recent (1987) traffic count
information for this portion of Davis Road is 100
trips per day.
The Final Plat of New Hope Springs, Section One
Phase B was approved in October. In November, lot
18 was recombined to include approximately two
acres to the west and a portion of lot 12 . The
proposed subdivision involves creating two new lots
(three total) from lot 18 which is now 4 . 14 acres in
size.

The new residential lots average 1. 38 acres in size
and will be served by new public roads, individual
wells, and individual septic tanks. The irregular
configuration of lots 18A and 18B is based on the
location of soils suitable for subsurface sewage
disposal.
Access to lot 18C is restricted to Hope Valley Drive.
Hope Valley Drive and New Hope Springs Drive are under
construction. An approved letter of credit is on file
at the Planning Department, to guarantee completion
according to State standards.
On January 24, the Planning Board recommended approval
of the Preliminary Plan for the division of lot 18R,
New Hope Springs.
RECOMMENDATION: The Administration recommends approval of the
Preliminary Plan for the division of lot 18R New Hope
Springs subject to the conditions contained in the
attached Resolution of Approval.

The Board of County Commissioners hereby approves the subdivision of Lot 18R New Hope
Springs preliminary plat, dated December 15, 1993 and containing 3 lots, subject to the
fulfillment of requirements specified herein.
A. Sewage Disposal
1. Each residential lot shall contain an adequate area for septic disposal, and
repair area, approved by the Orange County Division of Environmental
Health.
2. Disclosure that the septic system location may restrict the size and location of
improvements. This disclosure shall be included in a document describing
development restrictions to be recorded concurrently with the Final Plat. The
document shall also disclose that information regarding the tentative location of
septic systems is available from the Orange County Health Department,
Division of Environmental Health.
B. Roads and Access
1. Lot 18C shall access onto Hope Valley Drive. All lots shall access onto the
new subdivision roads. This restriction shall be stated in a document
describing development restrictions and requirements to be prepared by
Planning Staff and recorded concurrently with the Final Plat.
C. Land Use Buffers and Landscaping
1. Landscaping shall be installed or preserved as indicated on the approved
landscape plan, and must be inspected and approved by the Planning and
Inspections Department.

The applicant shall secure landscape requirement installation and preservation
through a letter of credit, escrow agreement, or bond. An estimate of the cost

for required preservation, plantings and their installation must be provided.
The financial guarantee shall reflect 110% of the estimate and be issued by an
accredited financial institution licensed to do business in North Carolina.
2. Provisions for protection of existing trees as shown on the approved landscape
plan shall be included in a document describing development restrictions and
requirements to be prepared by Planning Staff and recorded concurrently with
the Final Plat.
3. A Type A Land Use Buffer shall be provided on lot 18C along the right-of-
way for Davis Road. The buffer shall be 3�0 feet in width and provide
sufficient vegetation to meet the standards of Section IV-B-8-e of the
Subdivision Regulations. Said buffer shall be so noted on the plat, and
described in a document describing development restrictions and requirements
to be prepared by Planning Staff and recorded concurrently with the Final
Plat.
D. Drainage
1. Indicate the boundary of the Upper Eno Watershed.
2. Provide impervious surface calculations for the portions of lots 18A and 18B
located in the Protected Watershed. Impervious surface data, as pursuant to
Article 6.23 of the Zoning Ordinance shall be included in a document '
describing development restrictions and requirements to be prepared by
Planning Staff and recorded concurrently with the Final Plat.
E. Parkland
1. Cash in the amount of$784.00 ($13,724/acre x 2/35 acre) shall be paid to
Orange County as payment in lieu of parkland dedication.
F. Miscellaneous
1. The Final Plat shall contain a title block and vicinity map in accordance with
Section V-D-2 and V-D-3 of the Orange County Subdivision Regulations.
2. A setback of 40 feet shall be maintained as measured from the edge of right-
of-way of Davis Road, Hope Valley Drive, and New Hope Springs Drive.
Side yards shall be a minimum of 20 feet, and rear yards a minimum of 20
feet. These setback requirements shall be stated on the plat, and in a
document describing development restrictions and requirements to be prepared
by Planning Staff and recorded concurrently with the Final Plat.
G. Certifications
1. A Certificate of Survey and Accuracy signed by a registered Land Surveyor
shall be notarized on the face of the Final Plat.

2. A Certificate of Declaration and Maintenance in the form provided in Section
V-D-6-b of the Orange County Subdivision Regulations signed by the
landowner and developer shall be on the face of the plat and included in a
document describing development restrictions to be recorded concurrently with
the Final Plat.
3. The Department of Environmental Health shall certify that each lot contains a
suitable area for septic disposal.
4. A Certificate of Approval signed by the Orange County Planning and
Inspections Department.

C. OTHER SUBMITTAL REQUIREMENTS
1. Twenty-five (25) copies of the preliminary plat.

Subdivision Regulations).
5. Auxiliary documents, in draft form, prepared in accordance with Section VI of this Ordinance which assure
completion and/or maintenance of improvements required by this Ordinance. Such documents may include, but
not be limited to, a private road maintenance agreement, and articles of incorporation and restrictive

The Preliminary Plan for Section One of the
U Village of the Oaks was approved by the County
-- ` - Commissioners on August 4, 1993. Section Two was
approved in Alamance County.
The Planning Board reviewed and approved the
Concept Plan for Section Three and Four The
Village of the Oaks at its August 16, 1993
meeting. Agency comments were received from
Emergency Management, Erosion Control, and
Recreation and Parks. Applicable comments have
been incorporated into the Resolution of
Approval.
The Planning Staff recommends approval of the
Preliminary Plan for Section Three and Four The
Village of the Oaks subject to the conditions
contained in the Resolution of Approval. (A copy
of the resolution is an attachment to these
minutes on pages . )
The Board had asked a question regarding
emergency services to the subdivision. Kirk
indicated he had spoken with the Fire Marshall
and he had said that Orange County would provide
emergency services. However, at such a location,
it is most likely that both Orange and Alamance
would respond.
Kirk also reminded the Board of the question
asked when the concept plan was presented
regarding which school system would serve the
subdivision. He noted that the Orange County
Board of Education had responded that residents
could attend either Orange or Alamance County
Schools. Anyone living within one mile of the
county line can choose the school system which
they prefer. Kirk continued that it is usually
the case that children within a subdivision
prefer to attend the same schools as their
neighbors and friends.
MOTION: Boland moved approval as recommended by the
Planning Staff. Seconded by Hoecke.
VOTE: Unanimous.

There was discussion about the irregular shaped
lots and concern was expressed that problems
could occur in the future. Willis responded that
the only alternative to the odd shaped lots would
be a septic easement. An easement requires a
separate document to be drawn up and recorded.
Reid noted that he had seen other cases in
surrounding counties of such odd shaped lots due
to septic easements and indicated he felt Orange
County would be having more subdivisions with
such lots.
Willis noted that another issue is the extent to
which septic easements can be used. She
indicated that was an issue to be discussed later
in the meeting.
MOTION: Reid moved approval as recommended by the
Planning Staff. Seconded by Hoecke.

AGENDA ITEM #11: MATTERS HEARD AT PUBLIC HEARING (11/22/93)
a, Zoning Atlas Amendments
( 1) Z-10-93 Paliouras Enterprises
On December 20, 1993, the Planning Staff advised
that the Planning Board withhold making a
recommendation on this rezoning request to the
Board of County Commissioners for a period of at
least one month. Staff suggested this in
response to a reported request made of Paliouras
Enterprises, Inc. to allow the Town of
Hillsborough to annex its property on the
southeast quadrant of the I-85/NC 86 Interchange.
Based on information provided by the County
Attorney and reports from Hillsborough Planning
Staff, the Paliouras property is a "key link" to
the University Station property. Voluntary
annexation would be part of the University
Station proposal. The County Attorney sought
supporting correspondence to verify this move on
the part of the firm and the Town. Verification
of imminent annexation, however, was not
forthcoming.
The County Attorney reported that annexation
would nullify the need to proceed further with
rezoning efforts. The Planning Board removed the
rezoning request from its agenda.
Eric Swanson, Hillsborough Town Manager,
estimated to Planning Staff that annexation of
the Paliouras property could be considered no
earlier than midsummer. The annexation would be
effected in conjunction with the University
Station new community.
The Planning Staff recommends that the Planning
Board endorse the rezoning from CC-3, Community
Commercial and R1, rural Residential, to GC-4
General Commercial as requested by Paliouras
Enterprises, Inc. for their 37 .97-acre parcel on
the southeast portion of the I-85/NC 86
Interchange for two reasons:
1. To accommodate uses more appropriately
permitted at Interstate Highway
Interchanges; and
