BACKGROUND: Pursuant to a policy adopted by the Commissioners on January 18,1994 respecting the approval of a pyrotechnics permit, the documents listed above have been submitted by the sponsoring agency as evidence of the completion of criteria established by the Commissioners. While discussions regarding the acceptability of the $1,000,000 general liability insurance have yet to be concluded, it should be noted that the insurance covering this event is $10,000,000. A reiteration of the procedures necessary to complete the checklist and ultimately the approval of a pyrotechnic permit after the Board gives their conditional approval is as follows: ♦ Chair to the Board signs the permit form indicating that the Board has given their approval, contingent upon approval of the Fire Officials following the site-set up inspection on the day of the event; ♦ The permit is delivered by the County Emergency Services Director,or designate,to the site of the pyrotechnic display on the day of the concert; ♦ Chapel Hill Fire Officials perform on site inspection of the pyrotechnics set-up and observe a demonstration of pyrotechnics representative of those which will be used during the event. ♦ Chapel Hill Fire Official signs the permit only after he is satisfied that all safety issues have been successfully addressed and according to his professional expertise about these matters believes the pyrotechnics to be used will in no way jeopardize public safety. ♦ Orange County Emergency Management Director,or his designate,signs permit only after all other signatures are in place and he has been satisfied that all issues of public safety have been addressed. S 2 It is also prudent to note that in the event the Fire Officials on-site during the event deem that the pyrotechnics are in any manner jeopardizing public safety, the use of pyrotechnics will be suspended. RECOMMENDATION: The Manager acknowledges that all criteria for the approval of a pyrotechnics permit, as approved by the Board on January 18, 1994, has been met by the Dean Smith Center for the concert by RUSH on March 6, 1994; and therefore pursuant to the policy, recommends approval of the permit,contingent upon final site approval by the Chapel Hill Fire Officials; and authorize the Chair to sign on behalf of the Board. 3 PYROTECHNICS PERMIT CHECKLIST North Carolina General Statue 14-413 empowers County Commissioners in the State to issue permits for time use of pyrotechnics in connection with shows of all descriptions after satisfactory evidence is produced to the effect that the pyrotechnics will be used for the aforementioned purposes and no others. On January 18, 1994, the Orange County Commissioners adopted a policy which cites the completion of the following criteria as prerequisite to the issuance of a pyrotechnics permit Verification of the receipt of Information will be evidenced by the signak"of the appropriate official on this form. Only after all criteria listed below have been met will the permit be issued It should be further noted that an signs mss must be written on the face of the pennit in order for the permit to be valid. Penalties for use of pyrotechnics wWMd a permit are cited lo the North Carolina Butlding Code,Administration and Enforcement,Volume 1A, Chapter 8.1. CRITERIA APPROVED BY DATE 1. On February 15, 1994, the Dean Smith Center, Chapel Hill, NC, was approved for a pyrotechnic permit to be used in association with a concert by RUSH, on Sunday, March 6, 1994, at the Smith Center. The approval is granted based on the following assurances from the requestor: +Public Safety personnel will be on site during the event to ensure public safety and to provide adequate traffic control; *Proof of Liability insurance which includes the County as a named insured, has been submitted to the Orange County Director of Purchasing and Central Services. Limits of liability are no less than $1,000,000 per occurrence. *Show setup will be approved by the Chapel Hill Fire Chief or designate, prior to the beginning of show. Permitted explosives include those listed on attachment#1,as submitted by Pyrotek Special Effects, Inc. +The Dean Smith Center has a current fire inspection and is in compliance with the Standard Fire Prevention Code, 1988, with North Carolina amendments. Emergency Management Director signs after assurance from Fire Official that requirements of the Standard Fire Prevention Code as it respects the use of pyrotechnics has been met 5. Emergency Management Director provides one copy of permit to show sponsor and returns one copy to the Director of Purchasing for records maintenance.
