BACKGROUND: Habitat For Humanity has received as a donation a triangle shaped parcel of land adjacent to the property leased by the County from the Orange County School Board for the Efland-Cheeks Community Center and a 1.5 acre lot owned by the County. The unusual shaped parcel owned by Habitat makes the lot unsuitable for building. The Habitat For Humanity property is located between the County-owed 1.5 acre lot and Richmond Road. The County' s lot is land locked from the road by Habitat's parcel. The County was unable to purchase this parcel in 1991 when the 1.5 acre lot was purchased as additional open space for the Efland- Cheeks Community Center. Habitat For Humanity has requested a swap that will benefit both parties. Habitat proposes to give the County approximately 5,200 square feet in acreage in exchange for the County giving 3,700 square feet to Habitat. Property given to the County will make the County lot accessible from Richmond Road. Property given to Habitat will make its parcel suitable for building a single family dwelling. 2 The County Attorney has outlined the steps necessary for the land exchange. The first step in the process is determining relative value of the property to be exchanged. The County must receive full and fair consideration in the exchange. Since the County lot is not considered as surplus property, the County must essentially be enhancing the utility and the value of its existing property and facilities in order to accomplish the transfer. The second step is for the properties to be surveyed to determine the acreage of both properties before and after a possible exchange. Also, a title search of Habitat's property must be performed. Finally, the Board must adopt a resolution authorizing the exchange. The resolution must be adopted at a regular meeting of the County Commissioners upon 10 days public notice. The County Engineer has informally identified the square footage to be exchanged by both parties. The County Tax Assessor has determined preliminarily the County will receive full and fair consideration, and the County will enhance the utility and the value of its existing property. Housing and Community Development, Recreation and Parks, and Planning Departments have reviewed the possible land exchange. The exchange would not affect the current and future activities at the Efland-Cheeks Community Center and Park. Staff plans to begin negotiations with Habitat For Humanity immediately and request the County Attorney to perform a title search of the property. A resolution authorizing the exchange of property will be presented at the March 1, 1994 Commissioners' Meeting. RECOMMENDATION(S) : Manager recommends the Board receive the report as information.
