PURPOSE: To consider a proposed Zoning Atlas amendment.
BACKGROUND: The property in question is located southwest of
Cornwallis Hills Subdivisio"nd 11 have access to
Oakdale Drive (SR 1133 and Old'�apel Hill-Hillsborough
Road (SR 1009) through Cornwallis Hills. The total area
proposed for rezoning contains 48.68 acres and is
described as Lot 1, Block C of Tax Map 42 in Hillsborough
Township.
In the adopted Land Use Element of the Comprehensive Plan,
the property is designated Ten Year Transition. The
current zoning is Residential-1 (R-1) . The zoning
district proposed is Residential-4 (R-4) . A portion of
the property is in the Major Transportation Corridor (MTC)
overlay district. Adjacent property to the south and west
is zoned Residential-1 and undeveloped. Cornwallis Hills
Subdivision is north and east, which is zoned Residential-
3 (R-3) .
The property will have access to public water and sewer
from the Town of Hillsborough. The existing development
of Cornwallis Hills is served by public water and sgel_q
The property will have access to Oakdale Drive and Oil
Chapel Hill-Hillsborough Road through Cornwallis Hills.
Oakdale Drive is considered a collector and had an average
daily traffic count of 1,700 in 1991. Old Chapel Hill-
Hillsborough Road is considered an arterial and had a 1991
traffic count of 11,000 trips per day. Under R-4 zoning,
discounting 12% for roads and recreation area, the maximum
number of residential units allowed would be approximately
149, resulting in 1,490 trips per day.

The Sheriff, EMS, fire protection, water and sewer service
providers have each responded that service is available to
the property in question. The Sheriff indicated
additional personnel would be needed to provide proper
service to the area. The Planning Staff findings as
required by Article 20 and Article 4 of the Zoning
Ordinance are included in the attachments.
The proposed Zoning Atlas amendment was presented for
citizen comment at the public hearing on November 22,
1993. There were no comments in opposition to the
request. The proposal was referred to the Planning Board
for a recommendation to be presented to the County
Commissioners no sooner than January 4, 1994.
On December 20, 1993 the Planning Board considered the
proposed rezoning and made positive findings on Article 4
and 20 except Item C which states that vehicular access
must consist of direct access to a street classified as
either arterial or collector. The Planning Board did not
consider this property as having direct access to an
arterial or collector street. The Planning Board did
recommend approval of the rezoning in a 9 to 1 vote
indicating that the original plans called for this area to
be considered for future development and that this was an
extension of the existing development.
RECONKENDATIONz If the Board of Commissioners approves the findings as
recommended by the Planning Board, the Administration
recommends approval of the request for a Zoning Atlas
amendment from Residential-1 to Residential-4.

Hillsborough Township, Orange County, North Carolina, being a
portion of the lands of Old 86 Limited Partnership as described in
Deed Book 344 , Page 631 of the Orange County Registry and being
further described as follows:
Beginning at. an existing iron rod located in the line of old 86
Limited Partnership, said iron rod being the South East corner of
Phase II, Cornwallis Hills Subdivision and the rear lot corner of
lot 29 of said subdivision as recorded in Plat Book 45, Page 121 of
the orange County Registry;
Thence running with the said line of Old 86 Limited Partnership
S 88°59110" W, 2376.95 feet to a rock;
Thence N 00 009149" E, 982 . 44 feet to an existing iron pipe;
Thence S 88 001144" W, 100.00 feet to an existing iron rod, a corner
with Oakdale Associates;

Pursuant to your request for coordination from the Town regarding
public water and sewer availability, I offer the following:
Based on Preliminary Site Plan dated 5/8/85 the Town has
. the plant capacity to handle the grater and sewage demands for the
proposed 150 residences within the area designated as "Future
Development."
- Plans for onsite and offsite water and sewer facilities
must be approved by this office prior to seeking permits or starting
construction,
All fees must be paid pursuant to Chapter 14 of the Town
code prior to water and sewer service being provided by the Town.

The intent of the Residential-4 (R-4) District is provided in Article 4.2.4 of the Zoning
Ordinance.
Intent
The purpose of the low and medium intensity Residential (R-2, R-3, R-4) Districts is to
provide locations for low and moderate intensity residential development and supporting
recreational, community service and educational uses in areas where urban services are
available or are to be provided as part of the development process.
Application Criteria
This district will usually be applied where the following conditions exist:
1. Designated by the adopted Comprehensive Plan as a Transition Area, which can
reasonably be expected to be annexed by a municipality in the ensuing 10-20 years.
2. Water and sewer lines should exist at the site or be assured of installation as part of
the development process.

Per your request, I have done some preliminary trip generation work
for the two parcels you discussed with me this morning. These
numbers are solely based on acreage and potential zoning
classification, but can be used as general guides to potential trip
generation for each site.
Parcel 1 - 49 acres zoned to R-4 (4 units per acre,)
I did two scenarios for this parcel since the developer many not
develop out to full 4 units/acre potential (given topo problems) .
1) 49 acres at 4 units/acre - 196 units total
average SFR - 10 trips/day
196 x 10 - 1960 trips/day
2) 49 acres at 3 units/acre - 147 units total
147 x 10 - 1470 trips/day
Once this property comes in for subdivision, it will be required to
do a Traffic Impact Study.
Parcel 2 - 6 acres zoned to I-1
6 acres
typical light industrial generation - 51.803 trips/acre
6 x 51.803 - 310.8 trips per- aerfi

I mandated watershed protection standards . The items below are related
2 to the watershed protection provisions and the zoning of Little River
3 and Cedar Grove Townships. Seven additional existing business have
4 been identified in Little River and Cedar. Grove Townships since the
5 August public hearing. The Tables located in the permanent agenda
6 file in the Cleric's office list all of the parcels proposed to be
7 rezoned to a non-residential zoning district with the zoning of Little
8 River and Cedar Grove Townships . The State mandate allows a non-
9 residential impervious surface limit of 470% in a portion of WS-II
10 watersheds without construction of detention ponds , provided that
11 residential development in excess of 1 dwelling unit per acre does not
12 occur . If residential density for any Project exceeds 1 du/acre , then
13 both residential and non-residential developments which exceed 12%
14 impervious surface are required to construct detention ponds .

19 PLANNING BOARD CHAIR CAROL CANTRELL mentioned that citizens need

23 After January 1st, all uses not - listed will be considered non-
24 conforming.

26 CHAIR MOSES CAREY commented that the reason Back Creek Watershed
27 is on the agenda is that it is the only development currently allowing
28 one unit per acre .
30 COMMISSIONER ALICE GORDON asked tha the two watersheds be
31 clearly listed as allowing the high density option .

39 This item was presented by Eddie Kirk for the purpose of
40 receiving citizen comment on a proposed Zoning Atlas amendment . The
41 property in question is located southwest of Cornwallis Hills
42 Subdivision and will have access to Oakdale Drive (SR 1133 ) and Old
43 Chapel Hill-Hillsborough Road ( SR 1009 ) through Cornwallis Hills . The
44 total area proposed for rezoning contains 48 .68 acres and is described
45 as Lot 1 , Blo;k C of Tax Map 42 in Hillsborough Township . In the
46 adopted Land Use Element of the Comprehensive plan , the property is
47 designated Ten Year Transition . The current zoning is Residential-1
48 (R-1 ) . The zoning district proposed isl Residential-4 ( R-4 ) , A
49 portion of the property is in the Transportation Corridor ( MTC )
50 overlay district. Adjacent property to the south and west is zoned
S1 Residential-1 and undeveloped. Cornwallis :Hills Subdivision is north
52 and east, which is zoned Residential-3 (R-3 ) . The property will have

1 access to public water and sewer from the Town of Hillsborough. The
2 existing development of Cornwallis Hills is served by public water and
3 sewer . The property will have access to Oakdale Drive and Old Chapel
4 Hill-Hillsborough Road through Cornwallis ! Hills . Oakdale Drive is
5 considered a collector and had an average daily traffic count of 1 ,700
6 in 1991 . Old Chapel Hill-Hillsborough Road is considered an arterial
7 and had a 1991 traffic count of 11 ,000 trlps per day . Under R-4
8 zoning , discounting 12% for roads and recreation area, the maximum
9 number of resider,:,ial units allowed would be approximately 149 ,
10 resulting in 1 ,490 trips per day. The Sheriff , EMS, fire protection,
11 water and sewer service providers have each responded that service is
12 available to the property in question .{ The Sheriff indicated
13 additional personnel would be needed to provide proper service to the

23 EDDIE KIRK stated that Oakdale Driveris considered a collector
24 road in the Comprehensive Plan. Old Chapel Hill-Hillsborough Road is
25 considered an arterial road. There are presently two streets that
26 dead end into this property that are in Cornwallis Hills . Traffic
27 from both of those streets would have to use the Cornwallis
28 Subdivision to pet to an arterial or collector street .

33 indicated that this proJect has been under development for the 'last
34 10/12 years. When the original approval was given certain conditions
35 were tied to the approval of the plat . Only one-half of the property
36 was included in the original plat. He indicated that R-4 is being
37 requested, rather than R-3, because the topography is different and
38 flexibility will be needed in order to work around that topography.
39 The density will not be increased as a result of the R-4 designation.
