Edwards, NCDOT Craig Benedict, 245-2592 Letter from Carrboro Zoning Department PURPOSE: To make a recommendation to the North Carolina Department of Transportation (NCDOT) concerning a petition to add Antler Point Road to the State Maintained Secondary Road System. BACKGROUND: Richardson Subdivision was approved by the Carrboro Board of Adjustment through the Special Use Permit process on December 2, 1987. Antler Point Road was originally platted and approved as a public road. Please refer to the attached letter from Carrboro staff. The plat designates Antler Point Road as a "Public R/W", and includes a stub out from the end of the cul-de-sac that is designated as a "future public right-of-way". The NCDOT District Engineer at that time signed a certificate on the plat stating that the road met NCDOT construction standards. Property owners within the subdivision (5 homes) have petitioned the NCDOT to accept maintenance responsibilities for Antler Point Road. Richardson Subdivision is located off the west side of Smith Level Road, Chapel Hill Township, in the Town of Carrboro's Extraterritorial Planning Jurisdiction, outside the municipal limits of the Town. This application meets the intent of criteria endorsed by the Board of County Commissioners for recommending acceptance of a public road into the State Maintained System for roads approved through the governing jurisdiction's major subdivision process. Those criteria are: 1. Right-of-way extended to allow connectivity; 2. Irons have been set at the edge of right-of-way to mark the corners of the lots; 3. Plat includes appropriate certificates of dedication of the right-of-way and acceptance of the public right-of-way signed by the appropriate entities. However, the subdivision was not subject to Orange County subdivision regulations, as the subdivision is Iodated in Carrboro's planning jurisdiction. The plat lacks the acceptance of the public right-of-way certificates signed by a governing body. The plat, approved in 1987, would not have contained that certificate if Orange County had reviewed it because that requirement was not included in Orange County's Subdivision Regulations until a 1990 amendment. 2 NCDOT has investigated this BqU8Gt (please refer to attached Secondary Road Addition R8pOFf\' and has submitted the petition to the Board Df Commissioners for its review and FeCODlm8nd8[iOn. North Carolina General Statute §136-62 directs that "The citizens of the State shall have the right to present petitions tothe board of county commissioners, and through the board to the Department of Transportation, concerning additions to the system and improvement of roads. The board of county commissioners shall receive such petitions, forwarding them on to the Board of Transportation with their recommendations." Dear Ms. Lincoln, The Town of Carrboro Zoning Division has received your request to review the permit history of the Richardson Subdivision as it pertains to Antler Point Road. A Special Use Permit for the Richardson Subdivision (which is also referred to as Antler Point subdivision) was issued on December 2"d, 1987. The Special Use Permit archives (as well as our GIS records) show that Antler Point Road was intended for public dedication to NCDOT for state maintenance and ownership. The Special Use Permit does not show a private road. Instead but a public road within a 60' right of way is dedicated to NCDOT. In order for Antler Point to become a private road the Special Use Permit would need to be formally modified with the approval of the permit issuing authority and the Richardson Subdivision Homeowner's Association.
