Wilson Industrial Access Road Petition Information INFORMATION CONTACT: Abigaile Pittman, 245 -2567 Tom Altieri, 245 -2575 Craig Benedict, 245 -2585 PURPOSE: To make a recommendation to the North Carolina Department of Transportation (NCDOT), and the North Carolina Board of Transportation (NC BOT) on two petitions to add one (1) subdivision road in Triple Crown Estates Subdivision, and one (1) industrial access road to the State Maintained Secondary Road System. BACKGROUND: This request includes two (2) petitions for two (2) road additions to the State Maintained Secondary Road System. The roads and their respective lengths and widths are as follows: Triple Crown Estates Subdivision Triple Crown Drive is approximately 0.66 mile in length. One (1) platted lot for single - family residential use currently has frontage along Triple Crown Drive. The road is situated west of Dairyland Road and north of NC 54 (Attachment 1a), and is located in Orange County's zoning and subdivision jurisdiction. The road is a private road constructed to public road standards as part of several minor and exempt subdivisions approved by staff in the early 2000's, and recorded in the Orange County Register of Deeds Office. The public right -of -way dedication plat for the road was Pavement/Right -of -way Road Name Length in Miles Widths in Feet Triple Crown Drive 0.24 22/60 Wilson Road 0.43 24/80 Triple Crown Estates Subdivision Triple Crown Drive is approximately 0.66 mile in length. One (1) platted lot for single - family residential use currently has frontage along Triple Crown Drive. The road is situated west of Dairyland Road and north of NC 54 (Attachment 1a), and is located in Orange County's zoning and subdivision jurisdiction. The road is a private road constructed to public road standards as part of several minor and exempt subdivisions approved by staff in the early 2000's, and recorded in the Orange County Register of Deeds Office. The public right -of -way dedication plat for the road was P� signed by the NCDOT District 7 Engineer on July 19, 2013 and recorded on July 31, 2013 (Attachment 2a). The Developer / homeowners have built and maintained the roadway to a public road standard. NCDOT has investigated this request and has submitted a petition to the Board of County Commissioners (BOCC) for its recommendation (Attachment 3a). Wilson Road Wilson Road is an industrial access road totaling approximately 0.43 mile. The road is located south of Interstate 40/85 and east of Ben Wilson Road (Attachment 1b). The road was constructed by NCDOT in 2014 to provide access to the Morinaga Candy Factory facility, and will ultimately be a component of the larger access network serving economic development efforts in this area. On December 2, 2013 the BOCC approved a Resolution for an investment of $250,000 in the construction of the road (Attachment 2b). The right -of -way for Wilson Road was dedicated by three (3) plats in December 2013 and May 2014 (Attachment 2c). The road has been built to a public road standard. The driveway permits for the reconfiguration of the intersection of Ben Wilson Road and Wilson Road, and for access to the Morinaga facility from Wilson Road, were managed by NCDOT and the City of Mebane. NCDOT has investigated this request and has submitted a petition to the BOCC for its recommendation (Attachment 3b). Conclusion The above - referenced applications meet the criteria endorsed by the BOCC for recommending acceptance of public roads into the State Maintained System for roads approved through the governing jurisdiction's major subdivision process ( NCDOT Subdivision Roads Minimum Construction Standards, January 2010). The application for Wilson Road is also consistent the Resolution adopted by the BOCC on December 2, 2013. In accordance with North Carolina General Statute §136 -62, the BOCC is required to make a recommendation regarding the petition to the North Carolina Board of Transportation ( NCBOT) before NCDOT can consider the petition. FINANCIAL IMPACT: There is no direct financial impact to the County associated with this item. NCDOT will incur additional maintenance responsibilities and costs. RECOMMENDATION(S): The Manager recommends the Board: 1. Forward the Petition for Addition to the State Maintained System to the North Carolina Department of Transportation for Triple Crown Drive in Triple Crown Estates Subdivision; 2. Forward the Petition for Addition to the State Maintained System to the North Carolina Department of Transportation for Wilson Road; and 3. WHEREAS, Orange County's Board of Commissioners has previously indicated its desire to assist in economic development efforts within the County; and, WHEREAS, the Board of Commissioners has held two public hearings concerning the proposed application for Community Development Block Grant funding to benefit Morinaga America, Inc.; and, WHEREAS, the Board of Commissioners wishes the County to pursue a formal application for Community Development Block Grant funding to benefit Morinaga America, Inc.; and will invest monies up to $250,000 into the project as committed to in the application. WHEREAS, the Board of Commissioners certifies it will meet all federal regulatory and statutory requirements of the Small Cities Community Development Block Grant Program, NOW, THEREFORE BE IT RESOLVED by the Orange County Board of Commissioners that Orange County Economic Development is authorized to submit a formal application to the North Carolina Department of Commerce for approval of a Community Development Block Grant for Economic Development to benefit Morinaga America, Inc. BE IT FURTHER RESOLVED that Michael Talbert, current Interim County Manager, and successors titled Interim County Manager or County Manager, is hereby authorized and directed to furnish such information as the NC Department of Commerce may request in connection with an application or with the project proposed; to make assurances as contained in the, application; and to execute such other documents as may be required in the application. The right -of -way will extend the entire length of the road that is requested to be added to the state maintained system and will include the necessary areas outside of the right -or -way for cut and fill slopes and drainage. Also, we agree to dedicate additional right -of -way at intersections for sight distance and design purposes and execute said right -of -way agreement forms that will be submitted to us by representatives of the NCDOT. The right -of -way shall be cleared at no expense to the NCDOT, which includes the removal of utilities, fences, other obstructions, etc. General Statute 136 -102.6 (see page 29 for Statute) states that any subdivision recorded on or after October 1, 1975, must be built in accordance with NCDOT standards in order to be eligible for addition to the State Road System.
