PURPOSE: To authorize publication of a Notice of Intent to Request
a Release of Funds and execution of the Request for Release of Funds.
BACKGROUND: As a condition of the County' s 1995 CDBG award, the N.C.
Department of Commerce requires that an environmental review be conducted
prior to the expenditure of program funds. County staff has reviewed the
regulations and determined the proposed activities are exempt from the
environmental review process. Therefore, the County can request the
release of funds for this activity utilizing the attached Request for
Release of Funds form. The County is also required to publish a Notice
of Intent to Request a Release of Funds in a newspaper of general
circulation. The notice attached, in a format prescribed by the Division
ofd Community Assistance will accomplish this task. Upon approval, this
notice will be published on or about December 21, 1995 in the Durham
Morning Herald. The public will have a seven (7) day comment period.
RECOMMENDATION:
The Manager recommends authorizing the publication of a Notice of Intent
to Request a Release of Funds in the Durham Morning Herald on or about
December 21, 1995 and authorize the Chair to sign the Request for Release
of Funds on behalf of the Board.

TO ALL INTERESTED AGENCIES, GROUPS AND PERSONS:
On or about December 29, 1995, Orange County will request the N.C. Department of
Commerce to release Federal funds under Title I of the Housing and Community
Development Act of 1974 (PL 93-383)for the following project:
PROJECT TITLE
Orange County Scattered Site Housing Rehabilitation Program
PURPOSE/NATURE OF PROJECT
Housing Rehabilitation of seventeen (17) substandard houses in Orange County
occupied and/or owned by persons at or below 60% of median income.
Total Project Cost = $396,870; Total CDBG Cost = $378,495; CDBG/Total Cost% = 95%
LOCATION OF THE PROJECT
Orange County, North Carolina

All Census Tracts in Orange County.
An Environmental Review Record applicable to the above project has been made by
Orange County which documents the environmental review of the project. This
Environmental Review Record is on file at the above address and is available for public
examination and copying, upon request and payment of any authorized copying charges.
Orange County will undertake the project described above with Community Development
Block Grant funds from the North Carolina Division of Community Assistance under Title I
of the Housing and Community Development Act of 1974. Orange County is certifying to
DCA that Moses Carey, Jr., in his official capacity as Chair of the Orange County Board of
Commissioners consent to accept the jurisdiction of the Federal courts if an action is
brought to enforce responsibilities in relation to environmental reviews, decision-making
and action; and that these responsibilities have been satisfied. The legal effect of the

certification is that upon its approval Orange County may use the Block Grant funds and
DCA will have satisfied its responsibilities under the National Environmental Policy Act of
1969.
DCA will accept an objection to its approval of the release of funds and acceptance of the
certification only if it is on one of the following bases: (a) that the certification was not in fact
executed by the certifying official or other officer of applicant approved by DCA; or (b) that
applicant's environmental review record for the project indicates omission of a required
decision, finding or step applicable to the project in the environmental review process.
Objections must be prepared and submitted in accordance with the required procedure (24
CFR Part 58) and may be addressed to DCA at P.O. Box 12600, Raleigh, North Carolina
27605-2600.
Objections to the release of funds on bases other than those stated above will not be
considered by DCA. No objection received after January 13, 19% will be considered by
DCA.

Environmental Policy Act of 1969; that the recipient has with the
environmental procedures, permit requirements and the statutory obligations
under such laws cited in 24 CFR Part 58.5; that the recipient has taken into
account the environmental criteria, standards, permit requirements and other

obligations applicable to the project under the other related laws and authorities cited
in 24 CFR Part 58; and that the recipient has complied with all applicable regulations
of the North Carolina Department of Commerce; that the level of environmental
clearance carried out by recipient in connection with this said project() did () did not

That the dates upon which all statutory and regulatory time periods for review,
comment, or other response or action in regard to this clearance began and
ended as indicated below; and that with the expiration of each of the time

That the undersigned officer is authorized to, and does consent to assume the status of
responsible federal official under the National Environmental Policy Act of 1969 and each
provision of law specified in 24 CFR 58 insofar as the provisions of these laws apply to
DCA/CFC's responsibility for environmental review, decision-making and action assumed
and carried out by the recipient; that by so consenting, assumes the responsibilities, where

applicable, for the conduct of environmental review, decision-making and action as to
environmental issues, preparation and circulation of draft, final and supplemental
environmental impact statements, and assumption of lead agency or cooperating agency
responsibilities for preparation of such statements on behalf of Federal and State agencies
including HUD, when these agencies consent to such assumption;
That the undersigned officer is authorized to consent to, and does accept on behalf of the
recipient and personally, the jurisdiction of the Federal courts for the enforcement of all
these responsibilities, in his/her official capacity as certifying officer to the recipient.

Warning Section 1001 of Title 18 of the United States Code and Criminal Procedure shall
apply to this certification. Title 18 provides among other things, that whoever knowingly
and willfully makes or uses a document or writing containing any false, fictitious, or
fraudulent statement or entry in any matter within the jurisdiction of any department or
agency of the United States, shall be fined not more than $10,000 or imprisoned not more
than five years or both.
