PURPOSE: To consider approving the transfer of a small parcel of
County owned real property to the Town of Chapel Hill for affordable
housing uses .
BACKGROUND: In 1977, the County obtained by tax foreclosure a small
parcel of land on Scarlette Drive in Chapel Hill (Tax Reference Number
7 . 27A.B. 7) . This property measures roughly 25 by 275 feet and is
immediately adjacent to the Chapel Hill Cemetery and another parcel
owned by the Town that is slightly smaller than one acre in size . The
approximate tax value of the County owned parcel is $3 , 000 . In its
present configuration, the parcel is of no practical use to the County.
At the October 17 meeting, the Board adopted a resolution authorizing
the staff to pursue the process to convey this property to the Town of
Chapel Hill for use in an affordable housing demonstration project .
Chapel Hill Town staff have discussed with Orange Community Housing
Corporation the prospects for building a number of small starter homes
on their parcel .
The County Attorney has prepared a resolution that approves the land
transfer offer to the Town of Chapel Hill, and authorizes the Chair to
execute a deed, in a form approved by the County Attorney,
accomplishing the transfer. If the Board approves the land transfer
offer, the Town would subsequently consider a similar resolution
accepting the offer of the transfer of the lot .
RECOMMENDATION: The Manager recommends that the Board approve the
resolution offering to transfer the County-owned lot to the Town of
Chapel Hill .

PUBLIC NOTICE
OF LAND TRANSFER
Pursuant to N.C. Gen. Stat . §160A-274 and §160A-267, the
Orange County Board of Commissioners hereby gives notice of its
authorization by passage of a resolution at its regular meeting
held on December 14 , 1995, to transfer land owned by Orange County
to the Town of Chapel Hill .
The property being transferred is located in Chapel Hill,
Orange County, North Carolina, off of Henderson Street (aka
Scarlette Drive) , is Orange County tax parcel 7 . 27A.B. 7 and is more
particularly described as follows :
All that certain lot or parcel of land situated, lying and being on
the West side of Henderson Street in the town of Chapel Hill, North
Carolina, and known and designated as Lot No. 19 in Block "A" of
the University Heights as surveyed by F. M. Carlisle on May 21,
1947, Plot of which is on file in the Office of the Register of
Deeds of Orange County in Plot Book 4, at Page 17, and more
particularly described as BEGINNING at a stake in the West property
line of the said street, the Southeast corner of Lot No. 18;
running thence with the line of the said Lot South 680 37' West
274 . 3 feet to a stake; running thence South 190 09' East 25 feet to
a stake, the Northwest corner of Lot No. 20; running thence with
the line of the said Lot North 690 37' East 275 . 7 feet to a stake
in the West property line of Henderson Street; running thence along
the West property line of said Street North 210 23 ' West 25 feet to
the BEGINNING, PIN # 9799-68-2079,
This property is adjacent to land owned by the Town of Chapel
Hill . This transfer has been done so that the lot owned by Orange
County can be merged with the lot owned by the Town of Chapel Hill .
This merged lot will then be used to develop starter homes as part
of an affordable housing project .
This transfer shall be completed no sooner than 10 days after
publication of this notice.

WHEREAS, Orange County owns a tract or parcel of land located
in Chapel Hill, Orange County, North Carolina, off of Henderson
Street (aka Scarlette Drive) , is Orange County tax parcel 7 . 27A.B. 7
and is more particularly described as follows :
All that certain lot or parcel of land situated, lying and
being on the West side of Henderson Street in the town of
Chapel Hill, North Carolina, and known and designated as Lot
No. 19 in Block "A" of the University Heights as surveyed by
F. M. Carlisle on May 21, 1947, Plot of which is on file in
the Office of the Register of Deeds of Orange County in Plot
Book 4 , at Page 17, and more particularly described as
BEGINNING at a stake in the West property line of the said
street, the Southeast corner of Lot No. 18 ; running thence
with the line of the said Lot South 680 37' West 274 . 3 feet to
a stake; running thence South 190 09' East 25 feet to a stake,
the Northwest corner of Lot No. 20; running thence with the
line of the said Lot North 690 37' East 275 . 7 feet to a stake

This property is hereafter referred to as the County owned lot, and
WHEREAS, the Town of Chapel Hill owns a tract or parcel of
land directly adjacent to the County owned lot which is Orange
County tax parcel 7 .27A.B. 8 and is more particularly described as
follows :
All those certain lots or parcels of land situated, lying and
being on the West side of Henderson Street in the town of
Chapel Hill, North Carolina, and known and designated as Lots
Nos . 20, 21, 22 and 23 in Block "A" of UNIVERSITY HEIGHTS as
surveyed by F. M. Carlisle on May 21, 1947, plot of which is
on file in the Office. of the Register of Deeds of Orange
County in Plot Book 4, at Page 17, and more particularly
described as BEGINNING at a stake in the West property line of
Henderson Street, the Northeast corner of Lot No. 24; running
thence along the West property line of Henderson Street North
210 23 ' West 100 feet to a stake , the Southeast corner of Lot

No. 19; running thence with the line of the said lot South 680
37' West 275 . 7 feet to a stake; running thence South 190 09'
East 100 feet to a stake, the Northwest corner of Lot No. 24 ;
running thence with the line of the said lot North 680 37'

This property is hereafter referred to as the Town owned lot, and
WHEREAS, the Town of Chapel Hill wishes to acquire the County
owned lot to join with the Town owned lot so the Town owned lot may
be developed for use in an affordable housing demonstration project
which will involve the building of starter homes on the combined
parcel, and
WHEREAS, the development of affordable housing is a benefit to
the people of Orange County, and
WHEREAS, Orange County wishes to convey the County owned lot
to the Town of Chapel Hill for the purpose described herein, and
WHEREAS, Orange County is receiving full and fair
consideration for the land it owns, and
WHEREAS, in accordance with North Carolina General Statutes
§160A-267, Orange County shall cause to be published a notice
summarizing the contents of this resolution once after its adoption
with the exchange of title to the County owned lot occurring no
earlier than 10 days of this publication, and
WHEREAS, North Carolina General Statutes §160A-274 , authorizes
Orange County to sell any real property belonging to Orange County
to any other governmental unit upon such terms and conditions as
Orange County deems wise, with or without consideration.
IT IS THEREFORE RESOLVED THAT
1 . Orange County, pursuant to North Carolina General
Statutes §160A-274 , offers to transfer to the Town of Chapel Hill

the County owned lot .
2 . The Orange County Attorney' s office is authorized to
cause to be published notice of this resolution in accordance with
North Carolina General Statutes §160A-267 .
3 . The Chair of the Board of County Commissioners is
authorized to execute a deed for The Orange County lot, on behalf
of Orange County (and the Clerk to the Board of Commissioners is
authorized to attest this deed) , in a form approved by the Orange
County attorney, naming as grantee the Town of Chapel Hill .

2 . The Chapel Hill Attorney is authorized to accept on
behalf of the Town of Chapel Hill, the deed for the County owned
lot, in a form approved by the Chapel Hill attorney.
