PURPOSE: To receive public comment on a proposed amendment to the Land Use
Element of the Comprehensive Plan.
BACKGROUND: A proposal to expand an existing Twenty-Year Transition Area has been
received from Mr. Charles W. Davis and Mr. James L. Davis for part of
a parcel in their ownership lying between NC 86 and Old Chapel Hill-
Hillsborough Road (Old 86), south of the Town of Hillsborough (please
see map).
The area proposed for re-designation is a 50-acre portion of a 108-acre
parcel on the southeast side of Cates Creek in Hillsborough Township.
The 50-acre portion is currently designated Rural Residential, while the
remainder of the parcel is already designated Twenty-Year Transition. The
property is undeveloped and is adjacent to the I-40/01d 86 Economic
Development District.
The designation of Twenty-Year Transition is applied to land in transition
from rural to urban uses which has or will have access to public water and
sewer service. The proposed designation of Twenty-Year Transition would
allow potential rezoning of the property to higher-density residential uses
in the future. The property is currently zoned R-1, which permits
residential uses with a minimum lot size of 0.92 acres.

RECObIlM MATION: Applications for amendments to the Comprehensive Plan and/or
Zoning Atlas by an individual or agency are treated in the same
manner; e.g., the public hearing is the time for the presentation of
the Zoning Officer's analysis and recommendation concerning the
requests. No decision on the application is made by either the
Planning Board or Board of Commissioners at the public hearing.
Instead, the Planning Board has 60 days within which to prepare
and submit a recommendation to the Board of Commissioners.
Failure of the Planning Board to submit a recommendation within
the required time shall be considered a favorable recommendation,
without conditions.
Zoning Q tcer Recommendation
The Zoning Officer has reviewed the application and all supporting
documentation and has found that changed or changing conditions
cited by the applicant would be addressed by the proposed
amendment. Provided the Planning Board and County
Commissioners find in the affirmative, the Zoning Officer
recommends approval of the request.
Administration Recommendation
The Administration recommends that the proposed amendment be
referred to the Planning Board for a recommendation to be
returned no sooner than January 16, 1996.

Analysis of Proposed Comprehensive Plan Amendment
On October 5, 1995, a petition for amendment to the Land Use Element of the Comprehensive
Plan was submitted by Charles W. Davis and James L. Davis. In accordance with Articles 2 and
20 of the Zoning Ordinance, the proposed amendment is evaluated on the following pages.
A. GENERAL DESC
The property proposed for amendment lies in Hillsborough Township, on the south side of Cates
Creek between NC 86 and Old Chapel Hill-Hillsborough Road (Old NC 86). The site is
undeveloped.
The property in question is a 50-acre portion of a 108-acre parcel and is referenced as part of
parcel 2, tax map 45, Hillsborough Township. The site is adjacent to the Town of Hillsborough
Extra-Territorial Jurisdiction on the north and west, a County Transition Area and Stagecoach
Run subdivision to the east, and the I-40/Old 86 Economic Development District to the south.
The 108-acre parcel which contains this amendment site is currently in split planning jurisdiction
(please see attached map). Approximately 5.5 acres of the parcel (between Cates Creek and Old
Chapel Hill-Hillsborough Road) is in the Town of Hillsborough Extra-Territorial Jurisdiction.
Approximately 102.5 acres of the parcel is in County jurisdiction. The 50-acre portion proposed
for amendment is currently designated Rural Residential, while the 52.5-acre remainder to the
northeast is designated Twenty-Year Transition.
The proposed amendment would redesignate the 50-acre Rural Residential portion of the
property to Twenty-Year Transition, which would place the entire parcel in the Twenty-Year
Transition designation. Twenty-Year Transition is described in the Land Use Element as "land
located in areas that are in the process of changing from rural to urban, that are suitable for
urban-type densities and should be provided with public utilities and services within the second
10-year phase of the Plan.*
The proposed designation of Twenty-Year Transition would allow the potential for rezoning
of the property to higher-density residential zoning in the future. The current zoning is R-1,

which permits residential uses with a minimum lot size of 0.92 acres.
B. APPLICATION RMUMEMENTS
Application requirements for an amendment to the Comprehensive Plan are contained in Articles
2 and 20 of the Zoning Ordinance. Listed below are the applicable requirements, followed by
information provided by the applicants and/or staff comments (shown in bold).
Amendment Rationale
Article 2.2.14 states the reasons for which the Comprehensive Plan may be amended:
a. "Because of changed or changing conditions in a particular area of the County.."
The applicant cites new land uses and urban zoning districts adjacent to the
property. The site is bounded by the R-2 portion of the I-40/Old 86 Economic
Development District to the south, and the Town of Hillsborough jurisdiction to the
north and west across Cates Creek. A 60-acre site across Cates Creek from the site
is being developed as Old Mill Business Park. In addition, the applicant notes the
fact that the remainder of the parcel to the east is already designated Twenty-Year
Transition. Thus, the site is bounded by an urban jurisdiction or future urban
designations on all sides.
b. "To correct an error or omission in the Comprehensive Plan."
No error or omission is cited by the applicants.
C. "In response to a change in policies, objectives, principles or standards governing the
physical development of the County."
The applicant does not reference it directly, but the creation of the I-40/Old 86
Economic Development District to the south may be considered a recent policy
decision by the County towards urban-scale development in the area.
Qualification of Amendment as Princi W or Secondary
Article 2.2.14.2 differentiates between "principal" and "secondary" amendments to the Plan.
This amendment is a secondary amendment under Section 2.2.14.2.b in that secondary
amendments include the expansion of a designated plan area where the additional area is
contiguous to the existing plan designation and does not increase its land area by more than one
hundred (100) acres.
The proposed amendment is contiguous to an existing Twenty-Year Transition Area
(the remainder of the same parcel), and is 50 acres in size.

Additional Information
Article 20.3.2 requires the submission of the following additional information:
a. "A fully-dimensioned map at a scale of not less than one hundred (100) feet to the inch
showing the land which would be covered by the proposed Comprehensive Plan
amendment, and a legal description of the land."

The applicants cite the Land Use Element policy for "infill" development in Section
3.2-1. This section states:
"The infill development strategy is premised on the desirability of encouraging
development to occur fast within the corporate limits of the Town, and then, when
appropriate, within those areas surrounding the Town which are in transition from
rural to urban development patterns."
Located adjacent to the Town of Hillsborough jurisdiction and surrounded by urban
classifications, the applicants note that this area would be in keeping with the infill
strategy by focusing development in transition areas adjacent to urban locales.
Development of the property at an urban density would require extension of
municipal water and sewer from the Town, and eventual annexation of the area
could occur. The applicants note that development of this type would allow for a
more compact and efficient urban form, reducing transportation, energy and public
service costs.
Expanding on this last comment, the creation of residential activity on a site
surrounded by urban-scale uses might also augment the new Economic Development
District (EDD) by providing residential opportunities in close proximity to
employment activities. The portion of the EDD adjacent to this site is slated for
medium-density residential use in the EDD master plan.
C COMPARRSON OF PROPOSED AMENDMENT WITH LOCATIONAL CRITERIA
In analyzing an amendment to the Land Use Element of the Comprehensive Plan, the requested
land use category is to be evaluated for compatibility with all applicable Locational Criteria from
Section 3.4 of the Land Use Element.

D. RAFLICATIONS OF THE PROPOSED AMENDMENT
If the proposed amendment is approved, the applicants may submit a rezoning petition for a residential
zoning district with densities greater than one unit per acre. These districts range from a low of R-2 (two
units per acre) to R-13 (13 units per acre).
The most-dense existing zoning in County jurisdiction is an R-8 district at Timbers Mobile Home Park.
There are three R-5 subdivisions (including Wildwood to the northeast of this site) in County jurisdiction.
The proposed zoning of residential development in the I-40/01d 86 EDD adjacent to this site is R-2.

E. AGENCY CONIIVIENTS
Agency comment has been received from the North Carolina Department of Transportation,
which finds no impact on recommendations of the Hillsborough Thoroughfare Plan.
The correspondence from NCDOT references the Oakdale Drive Extension, which is a proposed
Minor Thoroughfare which would connect NC 86 and Old Chapel Hill-Hillsborough Road north
of this site. This proposed road was first identified in the Central Orange Area Study of 1983,
and is currently on the Town's Thoroughfare Plan.
As noted, corridors are reserved for this thoroughfare to the northeast and northwest of the site.
If constructed, the road would cross the northernmost tip of the Davis parcel (the part already
designated Twenty-Year Transition). The road would not cross the portion of the parcel
proposed in this amendment for redesignation. No other agency comment has been received.
F. RECOMMENDATION
The Planning Department recommends apuroval of the proposed Comprehensive Plan
amendment, for the following reasons:
1. The proposed amendment is consistent with all locational criteria for a Twenty-Year
Transition area.
2. The site lies within an area which has undergone substantial transition to urban uses in
recent years. The Old Mill Business Park, the new commercial activities on Old Chapel
Hill-Hillsborough Road in Town jurisdiction, the I-40 101d 86 Economic
Development District, and the proposed retail center at 1-85 and NC 86 all make a strong
case for the existence of changed conditions and an area in transition.
3. As cited by the applicants, the proposed change to transition for this property is
consistent with the infill strategy of the Land Use Element, since this site is adjacent to
the Town of Hillsborough and is surrounded by urban or future-urban uses.
4. The development of this site may enhance the I-40 101d 86 Economic Development
District, by extending public water and sewer closer to the EDD, and by providing an
expanded residential base to surround the EDD. This type of compact urban residential
development around the economic activity center is consistent with the Land Use
Element's vision for Transition Areas.
S. The proposed Oakdale Drive Extension, if built, would be located to the north of property
in this amendment. NCDOT has indicated that this amendment would not conflict with
the Town's adopted Thoroughfare Plan.
Oakdale Drive Extension has been the focal point of citizen opposition at two Town of
Hillsborough public hearings (September 26 and October 24) on the Town's
Thoroughfare Plan. The Town is scheduled to vote on whether to retain or delete the
proposed road on January 8, 1996.

General Location: The 107.57 acre parcel is located south of I-85, west of new N.C.
86, north of the new Economic Development District and I-40, and east of Old
N.C. 86.

2. Current Land Use Plan Category Designations:
Of the 107.57 acres, approximately 102 acres he east of Cates Creek and are in Orange
County's planning jurisdiction. The remainder of the property, the 5.5 acres that lies to the
west of Cates Creek, is within Hillsborough's Extraterritorial Planning Jurisdiction(ETJ).
The current Orange County land use plan divides the 102 acres within the county's
jurisdiction into two categories. Approximately 52 acres is designated 20-Year Transition
and approximately 50 acres is designated as Rural Residential.
Requested Land Use Plan Category Designations:
The request is to change the approximately 50 acres now designated as Rural
Residential to 20-Year Transition.
3. How This Amendment Will Carry-Out the Intent and Purpose of the Adopted
Comprehensive Plan
The Land Use Element of the Comprehensive Plan recommends "infill" as a
development strategy. "The infill development strategy is premised on the desirability of
encouraging development to occur first within the corporate limits of the Town and then,
when appropriate, within those areas surrounding the Town which are in transition from
rural to urban development patterns." (3.2-1)
The proposed amendment is a necessary first step in the rezoning of the tract. With its
rezoning, the property can be development at an urban residential density. The
amendment would be consistent with the infill development strategy of the Land Use
Element and would allow for a more compact and efficient urban form, and reduce
transportation, energy, and public service costs.
Because the development of the property at an urban density would require the
developer to extend municipal sewer along Cates Creek, it would facilitate the provision
of sewer to the newly created Economic Development District (EDD)which is adjacent to
this property, thereby allowing the EDD to be developed as intended by the
Comprehensive Plan and zoning regulations.
4. Other Circumstances, Factor, and Reasons in Support of the Amendment
The development of this property at an urban density will require the extension of an
expensive 12-inch diameter sewer line from north of I-85 and to the Davis property and
to its boundry with the Economic Development District. The amendment will therefore
expedite the development of the EDD.
A 12-inch diameter water line will also need to be extended across the property.
5. Changed or Changing Conditions in the Area which make the Amendment
Reasonably Necessary
The 50 acres in rural residential is surrounded by new urban zoning districts and land
uses as well as land use catagories that are urban. The southern line of the property is
bounded by the new R-2 residential portion of the Economic Development District. The
western and northern line borders on Cates Creek, which is Hillsborough's ETJ line. The
60 acres across the creek is being developed under Hillsborough's jurisdiction by Mr.
Roger Stephens as a commercial business park. The 50 acres is bounded to the east by the
remainder of the tract, which is already designated 20-Year Transition.
With the development of the EDD to the south and the business park to the north, this
50 acre portion should also be considered as being in an urbanizing area and deserving of
the 20-Year Transition designation.

Subject: Proposed Amendment to the Land Use Element of the
Orange County Comprehensive Plan along NC 86
Dear Mr. Stancil:
Per your request,The Department of Transportation has reviewed the subject. The subject will not
conflict any recommendations on the Hillsborough Thoroughfare Plan
The proposed Oakdale Drive Extension,a minor thoroughfare connecting Old NC 86 with
NC 86,has reserved sections of corridor on both its east and west ends(at Wildwood
subdivision and The Old Mill development respectively). As shown on the attachment,
the alignment of the proposed corridor between these reserved sections crosses Cates Creek north of the
parcel under consideration for amendment. The amendment therefore has no impact on the proposed
corridor,
