PURPOSE: To consider reappointing the Animal Cruelty Investigator.
BACKGROUND: At the September 6, 1994 Commissioners Meeting
the Board appointed an Orange County Animal Protection
Society staff person to serve as the County Animal
Cruelty Investigator. The appointment was made under
the provisions of North Carolina General Statues 19A.
The animal cruelty investigator was appointed to serve
without any compensation or other employee benefits for
a one year term subject to removal for cause by the the
Commissioners.
The Animal Proctection Society has requested the
reappointment of Amanda Graham, APS Associated
Director, as the County Animal Cruelty Investigator for
another one year term. The APS has investigated 220
reports of animal abuse or neglect and in three cases
animals were seized under the General Statues 19A
appointment. The designation has made the animal
cruelty investigation process more efficient for APS.
The Animal Control Division of the County Health
Department concurs with the reappointment.

RECOMMENDATION(S) : The Manager recommends that the Board approve
the reappointment of the County Animal
Cruelty Investigator under N.C.G.S. 19A with
the understanding that as, appointee of the
County, the investigator will continue to
follow the cruelty investigation protocol as
agreed to by the County and APS, and will be
subject to County review as is customary for
any County appointed representative.

RE: RECAP OF YEAR OF APS ANIMAL CRUELTY INVESTIGATIONS
On September 5, 1994, you appointed me as a County Appointed
Cruelty Investigator under N.C. General Statute 19A-45, and I was
sworn in on September 21 . Since that time the APS has
investigated 220 reports of animal abuse or neglect under my
supervision. I have been responsible for guiding the direction
of these investigations and have been directly involved (in the
field) in approximately 25 of these cases.
Fortunately, we were able to resolve the majority of these
cases educationally without having to prosecute. We did file
criminal charges in one case and won a conviction. There have
been three other cases where I have used my 19A appointment to
seize the animals and pursue a civil complaint . The civil case
against Ray Butler of Butlers Garage in Carrboro (successfully
resolved in May 1995) was a joint effort between Carrboro Animal
Control and the APS, and William Morgan, the Town Attorney,
handled the case for us . We continue to have a successful
cooperative agreement with that agency.
I know that the appointment has strengthened the APS
investigation program and has enhanced our ability to help
animals throughout the county.
