PURPOSE: To adopt a resolution in opposition of the proposed site for
the Low Level Waste Site at Holly Springs in Wake County.
BACKGROUND: The County has been requested by Chatham County and
Congressman Fred Heineman to approve a resolution against the Low Level
Waste site at Holly Springs. Congressman Heineman feels the impact in
this district could be catastrophic. In his letter to the Orange
County Board of County Commissioners, he states his concerns.
RECOMMENDATION: Approve the resolution and authorize the Chair to sign

ORANGE COUNTY BOARD OF COMMISSIONERS
TO
OPPOSE SITING OF RADIOACTIVE WASTE FACILITY
WHEREAS, a site on the Wake side of the border with Chatham County is under
consideration for a "low-level" radioactive waste disposal facility and a license
application has been submitted by Chem-Nuclear Systems, Inc. for the Wake/Chatham
site; and
WHEREAS, Chatham County Board of Commissioners have appointed a citizens
committee and staff that have sought expert opinion from consultants in hydrogeology
and other relevant fields on the proposed site and have closely monitored the site
studies and license review process for over 4 years; and
WHEREAS, the opinion of these consultants is that the site does not meet licensing
requirements that would reasonably assure the health, safety and welfare of Chatham
citizens now and in the future; and
WHEREAS, others including Wake County's consultants, state regulators ;and state
reviewers are in substantial agreement that the site and the Chem-Nuclear license
application do not currently and may never meet license requirements; and
WHEREAS, it would cost tens of millions more dollars of public money to continue
consideration of this site according to state reviewers;
NOW, THEREFORE BE IT RESOLVED by the Board of Commissioners of Orange
County that the Board opposes the continued consideration of the Wake/Chatham site
for a radioactive waste disposal facility.
Adopted this, the 2nd day of October, 1995.

Dear Mr. Carey:
I thank you for receiving Mr. Bob Dilks and Mrs. Beverly Slagle of my staff last week. Due to
other commitments, I regretfully was unable to be there.
As you are aware, I have committed to the constituents of my district opposition to the proposed site
for the Low Level Waste Site at Holly Springs in Wake County. In this quest, I would like to have
a united stand of all three counties in the district. Wake and Chatham Counties have already
resolved against the proposed site. To complete the united stand, I respectfully request your support
also.
The impact on our district could be catastrophic. The concerns are several. Industry and real estate
could be adversely affected, with the overall economy being degraded. Quality of life considerations
are paramount if our area is to remain as a desired place to live. Transportation of low level waste
through the district could have negative results. And the site has not yet been proven safe without
a massive additional cost to the tax paying public.
No one questions the need of a low level waste site. But it must be safe and it must be
environmentally sound. There is sufficient evidence on hand now that casts serious doubt on putting
the site at Holly Springs. With that in mind, I respectfully request a resolution from the Orange
County Commission against the site at Holly Springs.
