PURPOSE: Consideration of the Preliminary Plan for Old Heritage
Pointe Subdivision.
BACKGROUND: The property is located in the northwest portion of
Chapel Hill Township on the west side of Old NC 86 (SR
1009/Old Chapel Hill-Hillsborough Road) 0.3 mile south
of Davis Road (SR 1129) .
The current zoning is Rural Residential (R-1) with the
same designation in the Land Use Element of the
Comprehensive Plan. The total acreage of the tract is
11.35 acres. The land slopes gently from an
approximate elevation of 722 feet at the western
boundary to 675 feet at Old NC 86.
The soils are predominantly of the Georgeville series
which is well-drained -and favorable for -building site
development, roads, and septic systems. The property
is all wooded.

Nine (9) one-acre residential lots are proposed. Each
lot will be served by an individual well and septic
system. A new public road ending in a cul-de-sac is
proposed to provide access for all nine lots to Old NC
86, which is classified as a minor arterial in the
Comprehensive Plan.
Because of the road classification, an additional
twenty (20) feet of right-of-way is required on Old NC
86 as well as a 75-foot land use buffer adjacent to the
new right-of-way. Septic systems, wells, utilities,
and driveways are allowed in the buffer; however,
structures and clearing of trees are not permitted.
The Planning Board reviewed the Preliminary Plan for
Old Heritage Pointe on August 21, 1995. They voted
unanimously to recommend approval of the Preliminary
Plan with a public road built to NCDOT standards and
the conditions contained in the attached Resolution of
Approval.
RECOMMENDATION: The Administration recommends approval of the
Preliminary Plan for Old Heritage Pointe as per the
Planning Board recommendation.

ORANGE COUNTY BOARD OF COUNTY COMIVIISSIONERS

The Board of County Commissioners hereby approves Old Heritage Pointe subdivision
Preliminary Plat, dated April 11, 1995 and containing nine (9) lots, subject to the fulfillment
of requirements specified herein.
The road shall be irrevocably dedicated to the general public and be constructed to standards
of the North Carolina Department of Transportation. The approval of this resolution
authorizes and directs the Orange County Manager to accept for Orange County and on
behalf of the public generally, the offer of dedication of Old Heritage Court. This
acceptance by Orange County of the dedication to the general public of Old Heritage Court
shall be without maintenance responsibility. The road shall be maintained by the
owner/applicant until such time as it is accepted for maintenance by the North Carolina
Department of Transportation or some other governmental body. Before the Final Plat of
Old Heritage Pointe can be recorded:
A. Sewage Disposal
1. Each residential lot shall contain an adequate area for septic disposal, and
repair area, approved by the Orange County Division of Environmental
Health.,
2. Disclosure that the septic system location may restrict the size and location of
improvements. This disclosure shall be included in a document describing
development restrictions to be recorded concurrently with the Final Plat. The
document shall also disclose that information regarding the tentative location of
septic systems is available from the Orange County Health Department,
Division of Environmental Health.
B. Roads and Access
1. Old Heritage Court shall be constructed to standards of the North Carolina
Department of Transportation, within a 60-foot right-of-way, and the
construction shall be inspected and approved by NCDOT.

A letter of credit, escrow agreement, or bond shall be submitted to secure
construction of Old Heritage Court to the standards of the North Carolina
Department of Transportation. An estimate of the construction cost must be
prepared by a certified/licensed engineer or grading contractor and submitted
to the Planning and Inspections Department. The financial guarantee must
reflect 110% of that estimate and be issued by an accredited financial
institution licensed to do business in North Carolina.
The document describing development restrictions to be recorded with the
Final Plat shall state that the financial guarantee will not be released until the
road construction has been inspected and approved by NCDOT.
2. An erosion control plan for construction of the road shall be approved by the
Orange County Erosion Control Division.
3. A 10' by 70' sight triangle shall be shown at the entrance of the subdivision.
4. All lots shall access onto the new subdivision road. This restriction shall be
stated in a document describing development restrictions and requirements to
be prepared by Planning Staff and recorded concurrently with the Final Plat.
5. Approved street name signs shall be erected at the intersection of streets as
required in Section IV-B-3-c-12 of the Orange County Subdivision
Regulations. Evidence shall be submitted by the applicant that the sign is in
place or a copy of the receipt for purchase of the sign shall be submitted to the
Planning Department.
C. Land Use Buffers and Landscaping
1. Landscaping shall be preserved as indicated on the approved landscape plan,
and must be inspected and approved by the Planning and Inspections
Department.
2. Provisions for protection of existing trees as shown on the approved landscape
plan shall be included in a document describing development restrictions and
requirements to be prepared by Planning Staff and recorded concurrently with
the Final Plat.
3. A Type E Land Use Buffer shall be provided adjacent to the new right-of-way
of Old NC 86 (SR 1009). The buffer shall be 75 feet in width and provide
sufficient vegetation to meet the standards of Section IV-B-8-e of the
Subdivision Regulations. Said buffer shall be so noted on the plat, and
described in a document describing development restrictions and requirements
to be prepared by Planning Staff and recorded concurrently with the Final
Plat.

D. Drainage
1. Indicate a 30-foot drainage easement in place of the 15-foot easements shown
on the Preliminary Plat. Locate additional drainage easements as required
following review and approval of the Erosion Control Plan.
E. Parkland
1. Cash in the amount of$1,604 ($6,239/acre x 9/35 acre) shall be paid to
Orange County as payment in lieu of parkland dedication.
F. Miscellaneous
1. The Final Plat shall contain a title block and vicinity map in accordance with
Section V-D-2 and V-D-3 of the Orange County Subdivision Regulations.
2. The following easements shall be shown on the plat:
a. 30-foot drainage easements on lots 2, 3 and 4
3. A setback of 40 feet shall be maintained as measured from the edge of
right-of-way of Old Heritage Court. Side yards shall be a minimum of 20
feet, and rear yards a minimum of 20 feet. These setback requirements shall
be stated on the plat, and in a document describing development restrictions
and requirements to be prepared by Planning Staff and recorded concurrently
with the Final Plat.
G. Certifications
1. A Certificate of Survey and Accuracy signed by a registered Land Surveyor
shall be notarized on the face of the Final Plat.
2. A Certificate of Declaration and Maintenance in the form provided in Section
V-D-6-b of the Orange County Subdivision Regulations signed by the
landowner and developer shall be on the face of the plat and included in a
document describing development restrictions to be recorded concurrently with
the Final Plat.
3. The Department of Environmental Health shall certify that each lot contains a
suitable area for septic disposal.
4. The North Carolina Department of Transportation shall certify that Old
Heritage Court has been constructed to State standards or that construction
plans have been approved.

5. A Certificate of Approval signed by the Orange County Planning and
Inspections Department.

C. OTHER SUBMITTAL REQUIREMENTS
1. Twenty-five (25) copies of the preliminary plat.
2. One full size copy.of an Orange County Tax map (with tax parcels involved clearly marked in
pencil).
3. Where municipal or OWASA sewer is not available, a copy of the Preliminary Plat indicating
Health Department soils analysis approval/denial for each lot shown thereon.
4. Where a private road is proposed a written statement by the applicant or his/her authorized
representative which sets forth the justification for a private road (see Section IV-B-3-d-1 of the
Orange County Subdivision Regulations).
5. Auxiliary documents, in draft form, prepared in accordance with Section-VI.of.this Ordinance
which assure completion and/or maintenance of improvements required by this Ordinance.
Such documents may include, but not be limited to, a private road maintenance agreement, and
articles of incorporation and restrictive covenants pertaining to a homeowner's association.
These documents may be required as necessary as evidence that the ordinance requirements
are being met.

Callemyn indicated that restrictive covenants
would provide protection for the open space so
that it would remain "wildlife open space" .
He also noted additional tree buffers to provide
protection for specimen trees. Open space has
also been set aside for future recycling center
and joint mailboxes.
Callemyn asked that, in the future, the Planning
Board consider reducing the required amount of
payment-in-lieu if a developer was providing open
space such as in this subdivision.
Barrows asked about the total percentage of open
space for the entire 81 acres and the response
was about 5% on the previous concept plan. The
revised concept plan has more than 5%
but Callemyn indicated he wasn't sure of the
exact acreage.
MOTION: Jobsis moved approval as recommended by the
Planning Staff. Seconded by Hoecke.
VOTE: Unanimous.

The Planning Board reviewed the Concept Plan for
Old Heritage Pointe on May 15, 1995. The
Preliminary Plan is essentially the same as the
Concept Plan. During the Concept Plan review, a
question came up regarding proposed widening of
SR 1009. No improvements to Old 86 are scheduled
in the State Transportation Improvements Plan
1996-2002 or proposed in any state or local
thoroughfare plan.
The Planning Staff recommends approval of the
Preliminary Plan for Old Heritage Pointe with a
public road built to NCDOT standards and the
conditions contained in the Resolution of
Approval (an attachment to these minutes on
pages ) .
There were no Board questions or comments.
MOTION: Reid moved approval. Seconded by Hoecke.
VOTE: Unanimous.
(3) Maple View II
Waddell asked that Jobsis chair this item due to
the potential for perception of conflict of
interest. He also abstained from the vote.
Presentation by Emily Cameron.
The property is located on the north side of
Dairyland Road (SR 1177) one-half mile east of
Dodson's Crossroads. It is zoned Rural Buffer and
University Lake Protected Watershed. On the Joint
Planning Area Land Use Plan the tract is
designated as Rural Buffer and Water Supply
Watershed.
Adjacent land uses are residential and
agriculture. Two ponds and two streams are
located on the property. The streams join to form
the headwaters of Morgan Creek.
The total acreage of the tract is 54 .28 acres.
Nine (9) lots are proposed that average five (5)
acres in size. . The lots are required to have
