BACKGROUND: The property is located on the east side of Dumont Drive (SR 1595) in Eno Township. It is zoned AR and L- ENO-PW and designated Agricultural Residential and Lower Eno Protected Watershed in the Land Use Element of the Comprehensive Plan. The approved Concept Plan involved 52 lots with a total area of 81.2 acres proposed to be subdivided. This phase includes 18.77 acres. Fifteen (15) lots are proposed which average 1.01 acres in size. One area of open space is proposed, which is .97 acres in size. All lots would have individual wells and septic tanks. All roads are proposed to be public. Alex Drive will be the main entrance road extending northeast off Dumont Drive. Calvert Court will extend off Alex Drive to serve the individual lots. Dumont Drive is a paved State maintained secondary road leading to St. Mary's Road. The Planning Board approved the Concept Plan for Charles' Woods Subdivision on May 15, 1995 subject to the condition that a stubout be provided to the northern property line. This stubout is indicated directly across from Calvert Court. 2 On August 21, 1995 the Planning Board unanimously recommended approval of the Preliminary Plan for Phase I Charles' Woods per the attached Resolution of Approval. RECOMMENDATION: The Administration recommends approval of the Preliminary Plan for Phase I Charles' Woods Subdivision per the attached Resolution of Approval. 3 RESOLUTION OF THE ORANGE COUN'T'Y BOARD OF COUNTY COMMISSIONERS Date September 5. 1995 Name of Subdivision Phase I Charles' Woods Owner/Applicant George W. Thompson The Board of County Commissioners hereby approves Phase I Charles' Woods subdivision preliminary plat, dated June 1, 1995 and containing 15 lots in Orange County, subject to the fulfillment of requirements specified herein. Alex Drive and Calvert Court shall be irrevocably dedicated to the general public and be constructed to standards of the North Carolina Department of Transportation. The approval of this resolution authorizes and directs the Orange County Manager to accept for Orange County and on behalf of the public generally, the offer of dedication of Alex Drive and Calvert Court. This acceptance by Orange County of the dedication to the general public of Alex Drive and Calvert Court shall be without maintenance responsibility. These roads shall be maintained by the owner/applicant until such time as they are accepted for maintenance by the North Carolina Department of Transportation or some other governmental body. Before the Final Plat of Phase I Charles' Woods can be recorded: A. Sewage Disposal 1. Each residential lot shall contain an adequate area for septic disposal, and repair area, approved by the Orange County Division of Environmental Health. 2. The septic system location may restrict the size and location of improvements. This disclosure shall be included in a document describing development restrictions to be recorded concurrently with the Final Plat. The document shall also disclose that information regarding the tentative location of septic systems is available from the Orange County Health Department, Division of Environmental Health. B. Roads and Access 1. Alex Drive shall be constructed to standards of the North Carolina Department of Transportation, within a 60-foot right-of-way, and the construction shall be inspected and approved by NCDOT. Calvert Court shall be constructed to 4 standards of the North Carolina Department of Transportation, within a 50 foot right-of-way and the construction shall be inspected and approved by NCDOT. OR A letter of credit, escrow agreement, or bond shall be submitted to secure construction of Alex Drive and Calvert Court to the standards of the North Carolina Department of Transportation. An estimate of the construction cost must be prepared by a certified/licensed engineer or grading contractor and submitted to the Planning and Inspections Department. The financial guarantee must reflect 110% of that estimate and be issued by an accredited financial institution licensed to do business in North Carolina. The document describing development restrictions to be recorded with the Final Plat shall state that the financial guarantee will not be released until the road construction has been inspected and approved by NCDOT. 2. Submit an erosion control plan for construction of the road. 3. A sight triangle to NCDOT standards shall be shown at the intersection of Alex Drive and Calvert Court and the proposed stubout. 4. An approved street name sign shall be erected at the intersection of streets as required in Section IV-B-3-c-12 of the Orange County Subdivision Regulations. Evidence shall be submitted by the applicant that the sign is in place or a copy of the receipt for purchase of the sign shall be submitted to the Planning Department. 5. All lots shall receive access from Alex Drive or Calvert Court. 6. A turnaround to NCDOT standards shall be provided at the end of Alex Drive. C. Land Use Buffers and Landscaping 1. Landscaping shall be installed or preserved as indicated on the approved landscape plan, and must be inspected and approved by the Planning and Inspections Department. OR Guaranteed financially through a letter of credit, escrow agreement, or bond submitted to secure landscape requirement installation and preservation. An estimate of the cost for required preservation, plantings and their installation must be provided. Provisions for protection of existing trees as shown on the approved landscape plan shall be included in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. D. Drainage 1. A 30 foot drainage easement shall be provided through parcels 13 and the open space area as required by the Orange County Erosion Control Officer. E. Parkland 1. Cash in the amount of$1,018.00 [($2,375/acre x 15/35 acre)] shall be paid to Orange County as payment in lieu of parkland dedication. 2. The entirety of the open space shown on the Final Plat shall be irrevocably dedicated to the homeowners association for recreation/open space use by residents of the subdivision. F. Miscellaneous 1. The Final Plat shall contain a title block and vicinity map in accordance with Section V-D-2 and V-D-3 of the Orange County Subdivision Regulations. G. Certifications 1. A Certificate of Survey and Accuracy signed by a registered Land Surveyor shall be notarized on the face of the Final Plat. 2. A Certificate of Declaration and Maintenance in the form provided in Section V-D-6-b of the Orange County Subdivision Regulations signed by the landowner and developer shall be on the face of the plat and included in a document describing development restrictions to be recorded concurrently with the Final Plat. 3. The Department of Environmental Health shall certify that all lot residential lots contain sufficient area for septic tank disposal and repair. 4. The North Carolina Department of Transportation shall certify that Alex Drive and Calvert Court have been constructed to State standards or that construction plans have been approved. 6 5. A Certificate of Approval signed by the Orange County Planning and Inspections Department. W �W to 001 -3 ' ?> 3i I c A 10 FISCAL IMPACT ANALYSIS FOR CHARLES'WOODS SUBDIVISION, PHASE I RESIDENTIAL SERVICE STANDARD APPROACH Prepared by The Orange County Planning Department August, 1995 PROJECT DESCRIPTION Charles'Woods Subdivision, Phase I, is a proposed 15-lot subdivision located in Eno Township on the east side of Dumont Drive. Dumont Drive is a paved, state-maintained secondary road leading to St. Mary's Road. The Concept Plan included a total of 81 acres, with 52 lots proposed. Phase I includes 15 lots, on 18.8 acres. The current zoning is Aft-Agricultural Residential. Excluding.97-acre acres of open space to be owned and maintained by a homeowners association,the average lot size is approximately 1.01 acres. All lots will be served by individual wells and septic tanks, and public roads. For Phase I of Charles'Woods, project build-out is estimated at five years. Housing units will be constructed, beginning in 1996, with completion of the project scheduled for 2000. Units will consist of detached single-family homes, and the applicant estimates the average sales price to be$150,000 per year, including the lot. METHODOLOGY Fiscal impact analysis is a projection of the direct, current, public costs and revenues associated with residential and non residential growth in the jurisdiction in which the growth is taking place. Fiscal impact analysis considers only direct impact in that it projects only the primary costs that will be incurred and the immediate revenues that will be generated. It calculates the financial effect of a planned development or new subdivision by considering the current costs and revenues such a development would generate if it were completed and occupied today.Fiscal impact analysis does not consider the private costs of public action. It is concerned only with public (governmental) costs and revenues. The method used in preparing the fiscal impact analysis is the Service Standard Approach. While only gross expenditures by service category are derived from the Per Capita Method,the Service Standard method determines the total number of additional employees by service function that will be required as a result of growth. This method employs average county government costs per person, average school costs per pupil, an employee to population ratio, and average operating expenses per employee for each service category and school district. The number of new employees are projected and multiplied times the average operating expenses(includes personnel,operating and capital costs)per employee. Kirk noted that the surveyor has a revised Concept Plan which slightly increases and redistributes the open space to better serve the topography of the property. The Planning Staff recommends approval of the Preliminary Plan for Phase I Charles' Woods Subdivision per the Resolution of Approval (an attachment to these minutes on pages ) . Alois Callemyn, surveyor, presented the revised Concept Plan explaining the changes made to assist with traffic flow and relocation of open space to better serve the subdivision. The changes are not significant enough that the Planning Staff felt re-submittal of the Concept Plan was required. Pedestrian easement/access to the wildlife area at the back of the subdivision 1 1 14 has also been added. Callemyn indicated that restrictive covenants would provide protection for the open space so that it would remain "wildlife open space" . He also noted additional tree buffers to provide protection for specimen trees. Open space has also been set aside for future recycling center and joint mailboxes. Callemyn asked that, in the future, the Planning Board consider reducing the required amount of payment-in-lieu if a developer was providing open space such as in this subdivision. Barrows asked about the total percentage of open space for the entire 81 acres and the response was about 5% on the previous concept plan. The revised concept plan has more than 5% but Callemyn indicated he wasn't sure of the exact acreage. MOTION: Jobsis moved approval as recommended by the Planning Staff. Seconded by Hoecke. VOTE: Unanimous. (2) Old Heritage Pointe Presentation by Emily Cameron. The property is located in the northwest portion of Chapel Hill Township on the west side of Old NC 86 (SR 1009/Old Chapel Hill-Hillsborough Road) 0.3 miles south of Davis Road (SR 1129) . The current zoning is Rural Residential (R-1) with the same designation in the Land Use Element of the Comprehensive Plan. The total acreage of the tract is 11.35 acres. The land slopes gently from an approximate elevation of 722 feet at the western boundary to 675 feet at Old NC 86. The soils are predominantly of the Georgeville series which is well-drained and favorable for building site development, roads, and septic systems. The property is all wooded. Nine (9) one-acre residential lots are proposed. Each lot will be served by an individual well and septic system. A new public road ending in a cul- de-sac is proposed to provide access for all nine lots to Old NC 86, which is classified as a minor arterial in the Comprehensive Plan.
