AGREEMENT BETWEEN ORANGE COUNTY PARTNERSHIP FOR YOUNG CHILDREN AND ORANGE COUNTY The Board approved and authorized the Chair to sign an agreement with the Partnership for Young Children (Smart Start) for establishing a comprehensive automated information and referral system for human services. ADDED ITEM CC. FIREWORKS PERMIT FOR THE ORANGE COUNTY SPEEDWAY The Board instructed County Staff to issue this permit if it is in accordance with the regulations as set forth in policy dated January 18, 1994 . VOTE ON THE CONSENT AGENDA: UNANIMOUS ITEMS REMOVED FROM THE CONSENT AGENDA T. LEASE RENEWAL FOR THE MOODY BUILDING Commissioner Gordon indicated that the outside of the Moody Building is in need of repair. Purchasing Director Pam Jones said that the landlord is responsible for the upkeep of the outside of the building. She will ask the landlord to respond accordingly. A motion was made by Commissioner Crowther, seconded by Commissioner Willhoit to approve and authorize the Chair to sign a lease renewal for the Moody Building, 103 Laurel Avenue, Carrboro through June 30, 1998 . VOTE: UNANIMOUS IX. ITEMS FOR DECISION - REGULAR AGENDA A. I-40/OLD N.C. 86 ECONOMIC DEVELOPMENT DISTRICT Planning Director Marvin Collins presented for Board consideration of approval an amendment to the I-40/Old NC Highway 86 Economic Development District (EDD) to include the area on the west side of NC 86 between Cates Creek and Oakdale Drive. He made reference to page three of the agenda abstract which gave a comparison of permitted use options showing the staff proposal, Old NC 86 group proposal, Cornwallis group proposal, Planning Board proposal and Planning Board vote. A motion was made by Commissioner Gordon to include the area in the EDD with secondary status instead of primary. MOTION DIED FOR LACK OF A SECOND Dick Cunningham, Vice-president of the Cornwallis Homeowners Association, presented a petition signed by 89 households which read as follows: PETITION REQUEST FROM CORNWALLIS HILLS SUBDIVISION MEMORANDUM TO: JOHN LINK,COUNTY MANAGER BOARD OF COMMISSIONERS FROM: PAM JONES,DIRECTOR OF PURCHASING AND CENTRAL SERVICES RE: PYROTECHNICS PERMIT DATE: JANUARY 4, 1994 Pursuant to G.S.14-413,Commissioners in North Carolina Counties are empowered to authorize and issue permits for the use of pyrotechnics in connection with"...shows of all descriptions...but only after satisfactory evidence is produced to the effect that said pyrotechnics will be used for the aforementioned purposes and none other." For an event which utilizes "Indoor Fireworks Special Effects", the Standard Fire Prevention Code requires the following: 1. That no fireworks as defined by this Code shall be discharged inside any building without a permit(Section 2006.1.1). 2. That the Fire Official in the jurisdiction be responsible for certifying "that the operator for which application has been made is capable of discharging such fireworks as described to the satisfaction of the Fire Official",(Section 2006.1.2). 3. Permit is non-transferable to alternate locations or alternate operators. If the circumstances upon which original approval was given change,the permit is then void,(Section 2006.1.3). 4. That no permit shall be issued until the show set up is approved by the Fire Official or his designee prior to the first show,(Section 2006.1.4). 5. That no permit shall be issued unless the facility in which the event is being held holds a current fire inspection,(Section 2006.1.5). The approval criteria which the Board has set includes the following: 1. Letters from the public safety agencies covering the event indicating that they will provide service for the event. 2. Qualifications of the operator. 3. Evidence of general liability insurance with a minimum of$1,000,000 liability limit;the County to be listed as a named insured on the policy. In order to document that the necessary assurances have been met, the County requires that the following information be provided prior to Board action: 1. A letter of request from the sponsoring agency,which outlines the details of the event (who,what,when,etc.). 2. A letter from the Public Safety personnel who will be involved in providing public safety to the event. 3. Proof of the qualifications/licensing as may be applicable,of the pyrotechnic company as well as the individual actually"shooting"the show. 4. Certificates of insurance which include the County as a named insured. A minimum liability of$1,000,000 is required. The permit(see attached), lists the criteria and provides signature lines for persons responsible for ensuring that the criteria is met. For example, 1 do not sign off on the permit until the insurance provision has been met. The last person to sign and deliver the permit to the sponsoring agency would be the County's EMS Director,who will coordinate the final inspection of the setup with the local Fire Official.
