TROSA Contract TELEPHONE NUMBER - Hillsborough - 732-8181 Chapel Hill - 968-4501 Mebane - 227-2031 Durham - 688-7331 ----------------------------------------------------------------- PURPOSE: To enter into contractual arrangements with Orange- Chatham Alternative Sentencing and Triangle Residential Options for Substance Abusers (TROSA) for services outlined by the Orange-Chatham Criminal Justice Partnership Program Advisory Board. BACKGROUND: At the May 16, 1995 BOCC meeting, the Board approved the acceptance of grant monies from the NC Department of Correction Criminal Justice Partnership Program for the implementation of program services. The grant award of $45,486 will be used to contract for substance abuse services and the development of a pre-trial release program. The substance abuse services contract with TROSA will provide residential substance abuse treatment services for approximately eight Orange/Chatham County residents. The contract with Orange- Chatham Alternative Sentencing will provide for the development and implementation of a pre-trial release program for both counties. RECOMMENDATION(S) : The Manager recommends that the Board approve the contracts for pre-trail release and substance abuse services for the Criminal Justice Partnership Program. Equipment $ 8,580.00 - (2)486 Laptop Computer w/Win&DOS - computer Software (Microsoft Office/Pagemaker) - (1) printer - (1) desk& chair - (2) client chairs - (1) lateral file cabinet w/lock - (1) cellular telephone - (1)telephone w/AOC record access modem Administrative-Total $ 11,550.00 Grand-Total $ 45 486.00 a ATTACHMENT H 3 NORTH CAROLINA AGREEMENT BETWEEN ORANGE COUNTY AND ORANGE-CHATHAM ALTERNATIVE ORANGE COUNTY SENTENCING THIS AGREEMENT made and entered into this the day of , 1995 by and between Orange County, North Carolina, on behalf of the Orange-Chatham Criminal Justice Partnership Program, hereinafter referred to as the "County" and the Orange-Chatham Alternative Sentencing, hereinafter referred to as "OCAS" ; WITNESSETH WHEREAS, the County acting as fiscal agent for the Orange- Chatham Criminal Justice Partnership Program has received a grant from the North Carolina Department of Correction Criminal Justice Partnership Program to provide pre-trial release services for individuals in the criminal justice systems of Orange and Chatham Counties and which provides that these grant monies may be spent through contracting with private for-profit/private non-profit agencies to provide these services; and WHEREAS, OCAS is a non-profit agency which provides pre-trial release services within criminal justice systems; and WHEREAS, the County desires to contract with OCAS to develop and implement a pre-trial release program as a part of the Orange- Chatham community based corrections plan; and WHEREAS, OCAS desires to provide these services for the County. NOW THEREFORE in consideration of the premises and of the following mutual promises, covenants and conditions, the County and OCAS agree as follows: 1 4 4 A. OCAS agrees for a period beginning upon signature and ending June 30, 1996 to develop and implement a pre-trial release program. The activities during this period shall include: 1) personnel recruitment; 2) meeting with criminal justice officials to establish preliminary methods and schedules; 3) developing a fiscal accounting system for the operation of this project; 4) establishing an advisory board; 5) developing forms for intake and release; 6) establishing a schedule of interviewing inmates and beginning limited screenings of inmate interviews to determine suitability of the procedures developed. B. OCAS agrees to develop a monitoring and evaluation mechanism for this program to include necessary documentation and records including data collection on: 1) number of offenders confined in jails; 2) number of offenders screened; 3) number of offenders released pre-trial; 4) number of offenders supervised as a condition of release; 5) number of offenders who appear on scheduled court date. C. OCAS further agrees to maintain accurate records regarding the services provided pursuant to this contract. OCAS agrees to allow the County to inspect these records at any time necessary. OCAS agrees to assist the County by providing any 2 J 5 information required pursuant to any audit conducted by the North Carolina Department of Correction Criminal Justice Partnership Program pursuant to the grant award contract between the County and the North Carolina _Department of Correction Criminal Justice Partnership Program. D. OCAS agrees that the County will retain ultimate control and responsibility for the services performed under this agreement. It further agrees to be bound by the conditions set forth in the grant contract between North Carolina Department of Correction Criminal Justice Partnership Program and the County. E. Each party agrees to be responsible for its own liabilities and that of its officers, employees, agents or representatives arising out of this agreement. F. Any equipment purchased by County to be used by OCAS in fulfilling its obligations under this contract will remain the property of the County and will revert back to the control of the County at termination of this contract. G. This agreement may be terminated by either party with or without cause by giving thirty (30) days prior written notice. The thirty (30) day termination period shall commence on the date of receipt of the notice by the affected party. H. The County agrees to reimburse OCAS for the services performed pursuant to this contract until June 30, 1995 in the amount of $10,095 and $55,000 for services from July 1, 1995 through June 30, 1996 . OCAS agrees that these monies to be paid by County pursuant to this paragraph are contingent upon receipt by County from the grant received from the North Carolina Department 3 6 of Correction Criminal Justice Partnership Program and if any monies are not received pursuant to that grant, County will have no further liability for payment. I. This agreement shall run until June 30, 1996 . It is not subject to renewal. J. OCAS and the County agree that each party will comply with such non-discrimination laws as may be applicable to them in the performance of this contract. R. This agreement contains the entire understanding of the parties and shall not be altered, amended or modified except by an agreement in writing executed by the duly authorized officials of both parties . L. The laws of North Carolina shall govern the validity and interpretation of the provisions, terms and conditions of the agreement. Blythe, Clerk to the Board of Commissioners 4 ORANGE-CHATHAM ALTERNATIVE SENTENCING By: ATTEST: lsg\home3\OCAS.con 5 Dp ATTACHMENT III 8 NORTH CAROLINA AGREEMENT BETWEEN ORANGE COUNTY AND TRIANGLE RESIDENTIAL OPTIONS FOR SUBSTANCE ORANGE COUNTY ABUSERS THIS AGREEMENT made and entered into this the day of , 1995 by and between Orange County, North Carolina, on behalf of the Orange-Chatham Criminal Justice Partnership Program, hereinafter referred to as the "County" and the Triangle Residential Options for Substance Abusers, hereinafter referred to as "TROSA; " WITNESSETH WHEREAS, the County acting as fiscal agent for the Orange- Chatham Criminal Justice Partnership Program has received a grant from the North Carolina Department of Correction Criminal Justice Partnership Program to provide substance abuse services for individuals in the criminal justice systems of Orange and Chatham Counties and which provides that these grant monies may be spent through contracting with private for-profit/private non-profit agencies to provide substance abuse services; and WHEREAS, TROSA is a non-profit agency which provides residential services for substance abusers; WHEREAS, the County desires to contract with TROSA to provide self-help services for drug addicted residents of the County as part of the Orange-Chatham community-based corrections plan substance abusers program; and WHEREAS, TROSA desires to provide these services for the County. 1 i 9 NOW THEREFORE in consideration of the premises and of the following mutual promises, covenants and conditions, the County and TROSA agree as follows: A. • TROSA will provide residential substance abuse treatment services for a minimum of eight (8) individuals referred by Orange County. Treatment for these individuals shall include at least the following: 1) educational support including participation in existing educational programs; 2) vocational support including use of existing services to provide skill building and job placement services; 3) participation in individual and group counseling sessions including family involvement and use of self-help groups including Narcotics Anonymous and Alcoholics Anonymous; 4) providing food, shelter and clothing required by residents participating in this program; 5) detoxification support. B. TROSA further agrees to provide the following services pursuant to this contract: 1) provide clinical evaluation, determine presence of addiction, coordinate and monitor the individual's interaction to the substance abuse treatment center; 2) preform random urine screens on all program participants through a contractual arrangement with NIDA Certified Laboratory; 2 t 10 f 3) coordinate with the Orange and Chatham County criminal justice systems to insure any required compliance; 4) provide a report to the Orange-Chatham Criminal Justice Partnership Advisory Board at the conclusion of the contract period to provide an evaluation of the program effectiveness. C. TROSA agrees to maintain accurate records regarding the services provided pursuant to this contract. TROSA further agrees to allow the County to inspect these records at any time necessary. TROSA agrees to assist County by providing any information required pursuant to any audit conducted by the North Carolina Department of Correction Criminal Justice Partnership Program pursuant to the grant award contract between the County and the North Carolina Department of Correction Criminal Justice Partnership Program. D. TROSA agrees that the County will retain ultimate control and responsibility for the services performed under this agreement.
