PURPOSE: To authorize the Chair of the Board of Commissioners to
adopt a resolution authorizing the execution of Replacement Annual
Contributions Contracts and Form 50071, Certification for Contracts,
Loans and Cooperative Agreements for the Section 8 Certificate Program
after review and approval of the County Attorney. To authorize the
County Manager to approve and submit the Section 8 Administrative Plan
for the agency.
BACKGROUND: The County Housing and Community Development Department
presently administers the Section 8 Housing Voucher, Certificate and
Moderate Rehabilitation Program for approximately 600 families in Orange
County. Authority to administer this program is provided through an
agreement with HUD known as an Annual Contributions Contract (ACC) for
the aforementioned three different programs. The ACC provides funding
for the provision of housing assistance payments for eligible
participants according to HUD regulations.
The term of the ACCS are approximately five (5) years. At the end of the
term HUD provides replacement funds and requires the execution of another
ACC for an additional five or more years. Over the past year, we have
received replacement ACCs at approximately three different times during
the year. It is anticipated that this will continue to occur in the
coming fiscal year and in order to simplify this routine process,
authorization for the Chair to execute these documents on behalf of the
Board with the Attorney's approval is requested.
Further, due to many changes in Program regulations it has become
necessary to revise the Administrative Plan for the Section 8 Program.
This document outlines the program management procedures which will be
followed by this agency and must be approved by HUD. County staff is
requesting that the County Manager be authorized to submit the revised
document to HUD for approval as well as any necessary minor revisions in

the future. Minor plan revisions may be necessary in the future to
incorporate comments received from HUD after their review. In
addition, future HUD regulation changes related to landlord/tenant
eligibility and/or Housing Quality Standards may require minor
amendments to ensure that the Administrative Plan is consistent
with current HUD requirements.
RECOMMNDATION:
To adopt the resolution authorizing the execution of Replacement
Annual Contributions Contracts and Form 50071, Certification for
Contracts, Loans and Cooperative Agreements for the Section 8
Certificate Program after review and approval of the County
Attorney. To authorize the County Manager to approve and submit
the Section 8 Program Administrative Plan and future minor
revisions to HUD for approval.

RESOLUTION AUTHORIZING THE EXECUTION OF REPLACE1rIENT ANNUAL
CONTRIBUTIONS CONTRACTS
Whereas the Orange County Housing Authority (herein called the
"PHA" ) anticipates entering into Replacement Annual Contributions
Contracts (herein called the "Contracts" ) from time to time with
the United States of America, Department of Housing and Urban
Development (herein called the "Government" ) for expiring
certificates and vouchers in the Section 8 Existing Program.
NOW, THEREFORE, BE IT RESOLVED BY THE PHA AS FOLLOWS:
Section 1. The Chair of the Orange County Board of
Commissioners is hereby authorized to execute, on behalf of the
PHA, following review and approval of the County Attorney, future.
replacement contracts for Section 8 Housing Projects numbered 2903-
E and 2903-V. The Clerk to the Board of Commissioners is hereby
authorized and directed to impress and attest the official seal of
the PHA on each such replacement contract and to forward executed
replacement contracts to the Government together with such other
documents evidencing the approval and authorizing the execution
thereof as may be required by the Government.
Section 2. The County Manager is hereby authorized to file with
the Government from time to time, as monies are required,
requisitions together with the necessary supporting documentation,
for payment under the Contracts.
Section 3. This Resolution shall take effect immediately.
