Map of Study Area Margaret Hauth, Hillsborough Planning Director - 732-1270 Ext 86 PURPOSE: To consider establishment of Orange County component of an Interlocal Agreement Committee (IAC) to assist staff and Clarion Associates on Phase II of the Hillsborough Area-Orange County Strategic Growth Plan. BACKGROUND: Over the last few years, Orange County and the Town of Hillsborough have been jointly working on a Hillsborough Area strategic growth plan or 'Small Area Plan'. Phase I included: • General purpose of the planning study area; • Examine the present conditions of planning issues such as land use patterns, utility and roadway infrastructure, etc. and trend future conditions; • Plan for the future within the sustainability constraints of resources (natural, fiscal, and public service) which are then programmed for location and intensity; • Jurisdictional planning review guidelines to promote an efficient and coordinated orderly pattern of growth - in this case, a cooperative planning agreement between the Town of Hillsborough and Orange County; and • Implementation strategy, but not the actual regulatory land use and zoning changes or interlocal agreements which are the next formal stage (i.e., Phase Two). This 22 page Small Area Plan was approved on February 20, 2007 by the Board of County Commissioners and previously by the Town of Hillsborough. The strategy to complete recommendations noted in Phase I was to develop an interlocal agreement in Phase II which would set forth the specific implementation aspects and responsibilities. Monies for this Phase II work were apportioned in the 2007-08 budget year. On January 15, 2008 the BOCC approved a "Proposal for Services - Draft Interlocal Agreement" (Attachment 1) as an addendum to the contract with Clarion Associates for 2 preparation of the Hillsborough Area-Orange County Strategic Growth Plan (SGP) Phase II. The proposal suggests establishment of an Interlocal Agreement Committee (IAC) to guide and review staffs and Clarion's work on the agreement. An option for the IAC is to consider the former Strategic Growth Plan Phase I Steering Committee and/or recruiting a cross-section of members from that group with 2 additional at- large to form the IAC. An IAC composed of members already familiar with the SGP process should result in less start-up time - a distinct advantage given the Interlocal Agreement is targeted for the May 19 Quarterly Public Hearing. Phase I included a steering committee which led to its success. Commissioner Jacobs was on the original committee. The Orange County component of a Phase 2 steering committee could include: Orange County SGP Phase 11 Steering Committee 1. Board of Count Commissioners Representative 2. Orange Count Planning Board Representative 3. Economic Development Commission Representative 4. Commission for the Environment Representative 5. At-large 6. ETJ or At-large This phase since it includes an important focus on the peripheral area around Hillsborough (i.e the urban fringe and coordinated planning area in the `middle' Eno watershed) would include 2 additional at-large or ETJ members. The Town of Hillsborough is considering 6 or less appointments also. Consideration of 6 appointments to this Orange County component of the IAC could occur on March 6, 2008. FINANCIAL IMPACT: No additional costs over those already budgeted for Phase II consultant work. Staffing of the committee would be handled by the existing planning staff of Orange County and Town of Hillsborough. RECOMMENDATION(S): The Manager recommends that the Board establish the IAC with 6 representative position slots, as noted above, from Orange County for the Strategic Growth Plan Phase 11 and ask the clerk to advertise and/or notify advisory boards for possible appointments. Attachment 1 0 Excerpt from Clarion List of Services as Initial IAC Mission Statement a. Preparation of a map indicating formal and legally-binding changes to Hillsborough's Extraterritorial Jurisdiction (ETJ). The starting point for discussion about these changes shall be recommendations in the November 2006 Strategic Growth Plan Report. b. Preparation of a ma indicating a jointly agreed-upon boundary for land that can be considered for future annexation by the Town of Hillsborough. The starting point for discussion about this boundary shall be the Annexation Boundary recommended in the November 2006 Strategic Growth Plan Report. c. Preparation of a map indicating, for areas outside Hillsborough's new ETJ boundary but within the newly defined Future Annexation Boundary, areas called "Proposed Hillsborough Services/Future Annexation Area" in which Hillsborough's municipal land use regulations as they may be jointly agreed upon, should be applied, to two specific interest areas with delegation of authority to the Town of Hillsborough for administering regulations in one area and Orange County, the other. d. Preparation of a ma indicating areas that are outside of Hillsborough's jurisdictional interest (i.e., Town Limits, ETJ, "Proposed Hillsborough Services/Future Annexation Area"), which are part of the Orange County/Town of Hillsborough peripheral Coordinated Planning Area, where mechanisms will be established for courtesy review and information-sharing as development proposals are considered. e. Provisions specifying that, for areas identified as called for in item (c) above, Orange County shall retain jurisdiction for land use management and regulation, but shall enact Hillsborough's zoning regulations for application to those areas. f. Provisions for courtesy review and information-sharing between Hillsborough and Orange County for areas that are designated as described in items (c) and (d) above. 05- 99 Y ?'
