PURPOSE: To consider approval of a Contract with Clancy & Theys as Orange County's
Construction Manager at Risk ("CMAR") for the construction of the site grading package for the
Orange County Animal Services Facility.
BACKGROUND: On June 12, 2007, the Board approved the project scope and final design
for the Animal Services Facility to be located on Eubanks Road. On October 9, 2007, the Board
approved Clancy & Theys as the CMAR for this project, thereby allowing them to work with the
Project Team on iterative pricing and value engineering exercises and to solicit bids in
anticipation of a final Guaranteed Maximum Price for Board approval.
Since the September inclusion of the CMAR to the project, the Project Team consisting of Dixon
Weinstein Architects (DW) and their sub-consultants, including Animal Arts (AA), a Colorado
architectural firm specializing in the design of animal facilities, Clancy & Theys (CT), the County
Staff, the County Attorney, and the County Construction Manager have worked through several
iterative value engineering exercises and have continued to work through the Town of Chapel
Hill's regulatory approval process. Challenges in this approval process, as well as the
necessary pricing and value engineering exercises, have delayed the anticipated start of the
project and have necessitated the recommendation to allow the CMAR to begin construction on
a site package as a separate but inclusive CMAR contract with its own inclusive Guaranteed
Maximum Price ("GMP"). This contract will allow the CMAR to begin the necessary site work
immediately. The second and inclusive CMAR contract with its related GMP for the remainder
of the project will be presented to the Board for approval in April. This contracting structure will
allow the County to manage the regulatory and budget constraints without sacrificing the
Project's substantial completion target date of December 31, 2008 agreed upon by Chapel Hill
and Orange County.
FINANCIAL IMPACT: The Guaranteed Maximum Price ("GMP") for this site work project is
$1,308,733. This GMP includes a substantial contingency that represents the CMAR's level of
risk assumed within the GMP prior to receiving bids from site and grading contractors for this
phase of the Project. The breakout of this GMP is attached to the CMAR Contract and will
ultimately be included in Appendix E of that Contract. Note that this breakout sums the traffic
control element, the site work elements, the general conditions, overhead, regulatory, and fee
elements of the GMP. If the contingency is not used, those funds are not disbursed to the
CMAR.
This GMP will be added to the second phase GMP that the County expects to receive in April of
this year.
RECOMMENDATION(S): The Manager recommends that the Board approve the Construction
Manager at Risk Contract site work package at the Guaranteed Maximum Price of $1,308,733,
subject to final review and approval of the County Attorney; and authorize the Chair to sign on
behalf of the Board.
