BACKGROUND: The North Carolina Legislature changed the state personnel law a few years ago to permit area mental health agencies serving multiple counties to apply for substantial equivalency under the State Personnel Act. OPC Board of Directors approved the attached resolution on April 25, 1995 seeking substantial equivalency. The Board of Directors are requesting that the Board of Commissioners approve the same resolution. The State will not entertain this request without the specific approval of all three Boards of Commissioners from the three county programs. The Person and Chatham Boards of Commissioners have adopted the resolution. Tom Maynard, Are Director, OPC Mental Health, will present the resolution and discuss the issues regarding substantial equivalency. 2 s RECOMMENDATION(S) : The Manager recommends that Board adopt the resolution to grant permission to the Orange- Person-Chatham Mental Health Agency to seek exemption from certain provisions of the State Personnel Act and authorize Chair to sign. ORANGE COUNTY HILLSBOROUGH 3 NORTH CAROLINA �11a�« Q rce taMd,ed 17" RESOLUTION TO GRANT PERMISSION TO THE ORANGE-PERSON-CHATHAM MENTAL HEALTH, MENTAL RETARDATION,AND SUBSTANCE ABUSE AUTHORITY TO SEEK EXEMPTION FROM CERTAIN PROVISIONS OF THE STATE PERSONNEL ACT WHEREAS, in 1991 the North Carolina General Assembly amended Section 126-11 of the General Statutes to allow Area Mental Health Authorities to establish "substantially equivalent" personnel systems; and WHEREAS,the Orange-Person-Chatham Area Authority has expressed a desire to develop a "substantially equivalent" personnel system; and WHEREAS,the County Commissioners bOieve that it would be,in the best interest of the Orange-Person-Chatham Area Mental Health Authority to develop a "substantially equivalent" personnel system.
