PURPOSE: To receive citizen comment on a rezoning request
submitted by Robert D. McBroom.
BACKGROUND: The proposed zoning lot is located on the 5-acre
tract owned by Robert D. McBroom at 1709 NC 86
North (Tax Map No. 4.3. .20) . approximately 1,600
feet north of the southern entrance to Coleman
Loop Road (SR 1332) . The lot proposed for
rezoning contains approximately 2.98 acres which
is currently zoned AR Agricultural-Residential.
The zoning designation requested is for I-1 Light
Industrial. Access to the proposed zoning lot is
from the east side of NC 86 North.
All surrounding properties lie within Orange
County's jurisdiction and are zoned AR
Agricultural-Residential.
In the Land Use Element of the Comprehensive Plan,
this property is shown to be in a Rural Industrial
Activity Node. The Element states that this is
land focused on designated road intersections
within a Rural Residential or Agricultural-
U32:
Residential area that is appropriate for small
scale industrial uses which do not require urban-
type services.
Comments were received from the Orange Rural
Volunteer Fire Department and Orange County 911
stating that an I-1 Industrial zoning lot as
described in the above can be served. Information
from the Sheriff's Department is pending.
Therefore, the proposed rezoning to I-1 Light
Industrial would be consistent with the
Comprehensive Plan.
RECOMMENDATION: Article 20.3.3 of the Orange County Zoning
Ordinance requires that the Zoning Officer's
recommendation be presented to the Planning
Board within 30 days of receipt of an
application. The 30-day period may be
extended up to 60 days with the written
consent of the applicant. The public hearing
is the time scheduled for presentation of the
Zoning Officer's recommendation.
Zoning Officer Recommendation
The Zoning Officer has reviewed the
application, the site plan, and all
supporting documentation and has found that
the proposed rezoning by the proposed
amendment would be consistent with the
Comprehensive Plan. Provided the Planning
Board and County Commissioners find in the
affirmative, the Zoning Officer recommends
approval of the request.
No decision on the application is made by
either the Planning Board or Board of
Commissioners at the public hearing.
Instead, the Planning Board has 60 days
within which to prepare and submit a
recommendation to the Board of Commissioners.
Failure of the Planning Board to submit a
recommendation within the required time shall
be considered a favorable recommendation,
without conditions.
Administration Recommendation
The Administration recommends that the
proposed Zoning Atlas amendment be referred
to the Planning Board for a recommendation to
be returned no sooner than August 3, 1995.

I, James R. Hinkley, Zoning Officer, Orange County, North
Carolina, DO HEREBY CERTIFY THAT:
On or about May 12, 1995, I sent by Certified Mail, postage
prepaid, a Notice of the Public Hearing to be held on Wednesday,
May 31, 1995, at 7 :30 pm in the Orange Water and Sewer Authority
Operations Center at 400 Jones Ferry Road in Carrboro, North
Carolina, for the purpose of providing all interested citizens an
opportunity to speak for or against Zoning Atlas Amendment Z-2-95
requested by Robert D. McBroom to consider rezoning a 200 ' X 660 '
lot totaling 3.03 acres situated entirely on his 5-acre property
at 1709 NC 86 North (Tax Map No. 4.3. .20) in Hillsborough
Township. The notice was sent to nine property owners who hold
title to the nine parcels which lie within 500 feet of the
McBroom property. A list of these parcels and their owners is
attached.

I-1 Light Industrial
Intent and application criteria of the I-1 Light Industrial District is given in
Article 4.2.21 of the Zoning Ordinance.
(a) Intent
The intent of the Light Industrial (I--1) District is to provide appropriately
located and sized sites for limited industrial uses engaged in manufacturing
processing creating and assembling of goods, merchandise and equipment.
Performance standards will be used to insure the absence of adverse impacts
beyond the immediate space occupied by the building.
(b) The district will usually be applied where the following conditions exist:
1. Site is located within areas designated in the adopted Comprehensive
Plan as either an Industrial Transition Activity Node or a Rural
Industrial Activity Node.
2. Lot size for individual uses shall be appropriate to the method of water
supply and sewage disposal.
3. Access would consist of direct vehicular access to street designated
either as arterial or collector by the adopted Comprehensive Plan.
Access to rail service is desirable but not required
The following is the list of permitted uses in the I-1 Light Industrial District:
Accessory Uses
M1 Manufacturing and processing operations where no adverse impacts occur
beyond the immediate space occupied by the building
P2 Botanical gardens and arboretums
P4 Bus passenger shelter
PS Bus terminals and garages
P7 Church
P10 Governmental protective services (police and fire stations) rescue squads,
volunteer fire departments
P14 Parks, public and non-profit
P24 Governmental facilities and office buildings
