PURPOSE: To consider resolutions providing comments regarding the Draft 2009-2015 State
Transportation Improvement Program (STIP) - one to the North Carolina Department of
Transportation (NCDOT) and one to the Transportation Advisory Committee (TAC) of the
Durham-Chapel Hill-Carrboro Metropolitan Planning Organization (DCHC MPO).
BACKGROUND: The North Carolina Board of Transportation (NCBOT) released the Draft
STIP on October 30, 2007 for public comment. The STIP, which is updated every two years, is
a seven-year program that schedules and funds transportation improvements in North Carolina.
The Transportation Improvement Program (TIP) for areas within a Metropolitan Planning
Organization (MPO) must be approved by the MPO and the Governor (the Secretary of
Transportation is the Governor's representative in this case) and the Metropolitan TIP must be
consistent with the STIP for the first four years of the funding period. The TIP for all other areas
is approved by the NC Department of Transportation (Board of Transportation).
The Transportation Advisory Committee (TAC) of the Durham-Chapel Hill-Carrboro (DCHC)
MPO, at its meeting on January 9, released the local supplement of the STIP as the Draft
Metropolitan TIP (MTIP) for public comment, along with the adopted Regional Priority List for
comparison of programmed projects with local priorities. The TAC will hold a public hearing to
receive comments on the Draft MTIP at its regular meeting on February 13, 2008, which has
been scheduled for 7:00 p.m. (instead of regular meeting time of 9:00 a.m.) to encourage public
participation.

The TAC plans to adopt the 2009-2015 MTIP in March, after TAC members and staff have
had a one-on-one discussion with the BOT members for Divisions 5 and 7 regarding issues in
their respective local jurisdictions.
The NCDOT has scheduled a public comment meeting for the Draft Division 7 STIP on
Wednesday February 20 from 2:00 - 4:00 p.m. at the Robert and Pearl Seymour Senior Center
at the Southern Human Services Campus in Chapel Hill. The latest schedule anticipates that
the NCDOT will adopt the 2009-2015 STIP in July 2008.
Attachments 1 and 2 are draft resolutions with comments regarding, respectively, the TIP for
Orange County to be submitted to the North Carolina Department of Transportation and the
MTIP for projects within the metropolitan area boundary (MAB) to be submitted to the DCHC
MPO TAC.
Attachment 3 contains comments approved by the Orange Unified Transportation Board
(OUTBoard) at its meeting on January 16, 2008.
Attachment 4 is the Draft 2009-2015 TIP for Orange County. This document includes the
Transportation Program for Rural Projects, Urban Projects, Strategic Highway Corridor Projects,
Feasibility Studies, Federal Bridge Projects, Mitigation Projects, (Independent) Bicycle and
Pedestrian Projects, Congestion Mitigation Projects, Enhancement Projects, Hazard Elimination
Projects, and Passenger Rail Projects and the Public Transportation Program for Chapel Hill,
Orange County and the Triangle Transit Authority (TTA).
Attachment 5 lists changes between the current 2007-2013 TIP and the Draft 2009-2015 TIP for
Orange County (projects in the County's jurisdiction only).
Attachment 6 gives the status of projects in the Orange County Transportation Priority List for
consideration for funding in the 2009-2015 STIP.
FINANCIAL IMPACT: There is no immediate financial impact associated with this item.
RECOMMENDATION(S): The Manager recommends that the Board approve the Resolution
Providing Comments To the North Carolina Department of Transportation Regarding the Draft
2009-2015 State Transportation Improvement Program and the Resolution Providing
Comments To the Durham-Chapel Hill-Carrboro Transportation Advisory Committee Regarding
the Draft 2009-2015 Metropolitan Transportation Improvement Program.

A RESOLUTION PROVIDING COMMENTS TO THE
NORTH CAROLINA DEPARTMENT OF TRANSPORTATION
REGARDING THE
DRAFT 2009 - 2015 STATE TRANSPORTATION IMPROVEMENT PROGRAM
DIVISION 7 PROJECTS IN ORANGE COUNTY
WHEREAS, Orange County welcomes the opportunity to participate in development of
the 2009-2015 North Carolina Transportation Improvement Program, and
WHEREAS, Orange County gives priority to identified safety needs in the vicinity of
schools, on existing roads and bridges, to other transportation projects that encourage
alternatives to automobile travel, to projects that minimize adverse impacts on the natural
environment and cultural sites, and to those projects that foster economic development in the
designated Economic Development Districts; and
WHEREAS, Orange County has submitted a Priority List of transportation projects for
inclusion in the 2009 - 2015 State Transportation Improvement Program (STIP); and
WHEREAS, the North Carolina Department of Transportation has released the Draft
2009 - 2015 STIP for public comment; and
. WHEREAS, Orange County, as a member of the Durham-Chapel Hill-Carrboro
(DCHC) Metropolitan Planning Organization (MPO) has submitted comments to the
Transportation Advisory Committee of the DCHC MPO regarding transportation projects
within the Metropolitan Area Boundary, which are attached to this resolution; and
WHEREAS, the North Carolina Board of Transportation is the sole approving authority
for the STIP for areas of the State outside Metropolitan Area Boundaries; and
WHEREAS, a large portion of Orange County lies outside the DCHC MPO MAB;
NOW, THEREFORE, BE IT RESOLVED by the Orange County Board of
Commissioners that Orange County submits the following comments regarding transportation
projects in areas of the County outside the DCHC MPO MAB, as submitted in the attached
recommendation of the Orange County Unified Transportation Board, for consideration by the
North Carolina Department of Transportation in development of the 2009- 2015 State
Transportation Improvement Program:
1. Orange County is concerned that cuts in appropriated federal transportation funds to
North Carolina coupled with the rapid increase in construction costs have reduced funding
sources for bicycle and pedestrian projects in order to prevent further delay of highway
projects. Orange County supports greater funding for alternative modes for

transportation, particularly for independent bicycle projects and improvements that make
bicycling safer on County roads.
2. Orange County requests that the NCDOT Division of Bicycle and Pedestrian
Transportation consider funding an independent bicycle project to construct 4-ft. paved
shoulders along Dairyland Road to accommodate bicycle traffic from Union Grove Church
Road (SR 1111) to Orange Grove Road (SR 1006). This area experiences high levels of
bicycle traffic from Carrboro and Chapel, Hill to rural routes. This route is a portion of the
number 3 priority listed in Orange County's Priority List for the 2009-2015 TIP for projects
outside the MAB. The entire project would connect the urbanized areas of Carrboro and
Chapel Hill to Efland and Mebane via Dairyland Road, Orange Grove Road, and
Buckhorn Road. The portion from Union Grove Church Road to Orange Grove Road is
part of a loop that, along with Old NC 86, has been designated as a North Carolina Scenic
Corridor. NCDOT, through the Moving Ahead Program and the Resurfacing Program has
included provisions for 2-ft. paved shoulders on Orange Grove Road that will improve
conditions for bicyclists on that road. (Moving Ahead provided 2-ft. paved shoulders on
SR 1006 from Old NC 86 to SR 1199, Tree Farm Rd.; 2008 Resurfacing Program will
provide 2-ft. shoulders along SR 1006 from SR 1199 to SR 1102, Dodson's Crossroads
and resurface and provide 2-ft. paved shoulders on SR 1006 from Dodson's Crossroads
to SR 1177, Dairyland Road.)
BE IT FURTHER RESOLVED, that Orange County, while acknowledging that cuts in
appropriated federal transportation funds to North Carolina coupled with the rapid increase in
construction costs make it unlikely that the NCDOT can add new projects to the STIP in this
update, the County requests that the NCDOT consider all funding possibilities for priority
needs identified in the Orange County Priority List for the 2009-2015 Transportation
Improvement Program.

A RESOLUTION PROVIDING COMMENTS TO THE DURHAM-CHAPEL HILL-
CARRBORO TRANSPORTATION ADVISORY COMMITTEE REGARDING THE
DRAFT 2009 -2015 TRANSPORTATION IMPROVEMENT PROGRAM
WHEREAS, Orange County, as a member of the DCHC MPO, has participated
in the development of the Durham-Chapel Hill- Carrboro (DCHC) Metropolitan Priority
List for the 2009 -2015 State Transportation Improvement Program (STIP); and
WHEREAS, the North Carolina Department of Transportation has released the
Draft 2009 -2015 STIP for public comment; and
WHEREAS, the DCHC MPO Transportation Advisory Committee (TAC) is
charged with the development of the Metropolitan Transportation Improvement Program
(MTIP) consistent with the STIP, and has released the draft MTIP for public comment;
and
WHEREAS, the Board of County Commissioners has reviewed the draft 2009-
201.5 DCHC Metropolitan Transportation Improvement Program;
NOW, THEREFORE, BE IT RESOLVED by the Orange County Board of
Commissioners that the Orange County submits the following comments to the DCHC
Transportation Advisory Committee to be considered in the development of the final
2009 -2015 DCHC Metropolitan Transportation Improvement Program:
1. Orange County is concerned that cuts in appropriated federal transportation funds to
North Carolina coupled with the rapid increase in construction costs have reduced
funding sources for bicycle and pedestrian projects in order to prevent further delay
of highway projects. Orange County supports increasing funding for alternative
modes for transportation, particularly for improvements that make bicycling safer on
County roads.
2. TIP Project E-4980, a pedestrian bridge on Orange Grove Road (SR 1006) over
1-40, continues to be the County's number one priority. Orange County requests that
the NCDOT proceed without delay to execute a feasibility study for this project.
3. Phase TIP Project 1-0305, 1-85 - widen to six lanes and reconstruct interchanges and
structures from 1-40 at Hillsborough to Durham County: Program in phases, with
Phase A being reconstruction of the interchanges followed by widening in Phase B.
a. Use the funding programmed for right-of-way acquisition in FY 11 and FY 12 for
right-of-way acquisition needed for the interchanges.
b. Orange bounty would also like to know the status of the environmental study for
this project, and be consulted during the study as well as during the design
process as stated in comments previously submitted by Orange County.

4. Correct the funding split for TIP Project C-4932. The project funds for C-4932 come
from Congestion Mitigation and Air Quality (CMAQ) funding apportioned to the
DCHC MPO and the Triangle Area Rural Planning Organization (TARPO), according
to an agreement between those two organizations and the NCDOT. The Draft 2009-
2015 STIP shows funding for C-4932A (the DHCD MPO apportionment) of $41,000
for each year for FY 09-11. A later agreement assigns all funding for FY 09-11 to
the TARPO CMAQ apportionment; so all funding for this project for years FY 09-011,
$99,000 each year, should come from the TARPO apportionment.

At its meeting on January 16, 2008, the Orange Unified Transportation Board received
an overview of the Draft 2009-2015 State Transportation Improvement Program for
Orange County, and approved the attached comments to recommend that the Board of
County Commissioners include in Orange County's comments to the North Carolina
Department of Transportation and the Transportation Advisory Committee (TAC) of the
Durham-Chapel Hill-Carrboro (DCHC) Metropolitan Planning Organization (MPO)
regarding the Draft 2008-2015 STIP for Orange County.

COMMENTS REGARDING THE
DRAFT 2009 -2015 TRANSPORTATION IMPROVEMENT PROGRAM
The Orange Unified Transportation Board (OUTBoard) is concerned that cuts. in
appropriated federal transportation funds to North Carolina coupled with the rapid
increase in construction costs have reduced funding sources for bicycle and pedestrian
projects in order to prevent further delay of highway projects. The OUTBoard supports
greater funding for alternative modes for transportation, particularly for improvements
that make bicycling safer on County roads.
The OUTBoard would also like to submit comment regarding three projects in particular:
TIP Proiect E-4980 pedestrian bridge on Orange Grove Road over 1-40: The North
Carolina Department of Transportation (NCDOT) should proceed without delay to
execute a feasibility study for this project. A feasibility study for this project was
included as "scheduled" in the 2007-2013 TIP but to date, there has been no time
indicated as to when the feasibility study will be funded. The existing bridge over
1-40 is too narrow to accommodate a pedestrian walkway. The Orange County
Priority List for the 2009-2015 TIP lists this project as its number 1 priority, which is
the same priority Orange County gave this project in its Priority Lists for the 2006-
2012 TIP and 2007-2013 TIP. In 2006, there were 131 students at Grady Brown
Elementary and Cedar Ridge High School that lived east of the 1-40 overpass within
a one-mile drive of the schools and there were 238 students that lived within a one-
mile radius east of 1-40. Grady Brown Elementary School administration noted in a
letter of support for a Safe Routes to School Action Plan Service Award application
that there are 225 students living within two miles of the school. Enrollment to botho--
schools from this area is expected to increase as recently built residential
developments on Oakdale Drive and Orange Grove Road become fully settled.
Also, many residents living in this vicinity on the west side of 1-40 walk or bicycle
along Orange Grove Road to access commercial areas on South Churton Street,
which are a little over 1.25 miles and 1.5 miles from Orange Grove Road west of the
bridge over 1-40.
2. The NCDOT Division of Bicycle and Pedestrian Transportation consider funding for
paved shoulders along Dairyland Road to accommodate bicycle traffic from Union
Grove Church Road (SR 1111) to Orange Grove Road (SR 1006). This area
experiences high levels of bicycle traffic from Carrboro and Chapel Hill to rural

structures: The OUTBoard requests that NCDOT change the phase descriptions to
prioritize the rebuilding of interchanges at NC 86, SR 1009 (Old NC 86) and US 70,
so that the interchanges be built in Phase A, followed by widening the interstate in
Phase B.
