BACKGROUND: The Board of County Commissioners reviews proposals to be considered at public hearing for consistency with general County policy and presentation format. The following items are proposed for consideration at the February 25, 2008 Quarterly Public Hearing. A. PUBLIC HEARING ITEMS 1. Buckhorn Village: Review of a proposed Planned Development (PD)/Special Use Permit (SUP) rezoning/development application proposing the development of a unified commercial development on approximately one hundred thirty (130) acre area that is bordered by Interstate 85 to the north, Buckhorn Road to the west, and West Ten Road to the south. The subject property is located within the 1-85/Buckhorn Road Economic Development (ED) zoning district. The Planned Development proposes to offer a variety of retail, service, office, and limited residential uses all under unified development control pursuant to a master planned land use, utilities/stormwater, multi-modal transportation, and open space program. (A map is included with this agenda item which shows the specific area and vicinity) 2. Zoning Ordinance Text Amendments: a. Telecommunications Towers: Session Law 2007-526 made revisions to North Carolina General Statute Chapter 153A--Article 18, part 3B-- Wireless Telecommunications Facilities effective December 1, 2007. To ensure Orange County's wireless telecommunications regulations continue to be consistent with state statutes, the followings sections and sub-sections should be revised. Some of the proposed amendments are derived from revised state statute wording; the others are Center for Municipal Solutions' (a telecommunications consulting firm who represents local government interests) suggestions. Proposed amendments include: 1. Sub-section 6.18 -- Telecommunications Towers and Equipment, 2. Sub-section 8.4.1b) --Annual Telecommunications Projection Meeting, 3. Sub-section 8.8.17a -- Telecommunications Towers, and 4. Article 22 -- Definitions. b. Planned Development: Amendments to articles 7.2.4 (Imposed Conditions), 7.2.5 (Special Use Required for Each Planned Development), Section 7.5.4 (Zoning Officer's Recommendations), and Section 7.5.5 (Actions by Planning Board; Board of County Commissioners) to address inconsistencies between existing ordinance requirements and North Carolina General Statutes (NCGS), specifically the requirement that imposed conditions be mutually agreed upon by the County and the petitioner. B. NON-PUBLIC HEARING ITEMS 1. Recommendations Regarding Water Conservation Priorities and Initiatives: A working group from the Towns of Chapel Hill and Carrboro, Orange County and OWASA has prepared a multi-paged report with a series of draft recommendations to the governing/policy boards of Chapel Hill, Carrboro, Orange County and OWASA regarding near term and long term actions and priorities. The recommendations complement the staff recommendations of the "Orange Turning Green" report previously submitted the BOCC. FINANCIAL IMPACT: Other than advertising costs, which are included in the FY 2007-08 Budget, there are no direct financial impacts associated with the approval of this item. RECOMMENDATION(S): The Administration recommends approval of the proposed February 25, 2008 Quarterly Public Hearing legal advertisement. Attachment 1 NOTICE OF JOINT PUBLIC HEARING ORANGE COUNTY BOARD OF COMMISSIONERS ORANGE COUNTY PLANNING BOARD A joint public hearing will be held in the Judge F. Gordon Battle Superior Courtroom of the New Orange County Courthouse, 106 E. Margaret Lane, Hillsborough, North Carolina, on Monday, February 25, 2008, at 7:30 PM for the purpose of giving all interested citizens an opportunity to speak for or against the following items: A. PUBLIC HEARING ITEMS 1. Buckhorn Village Planned Development: PUBLIC NOTICE OF PROPOSED ZONING ATLAS AMENDMENT by Buckhorn Road Associates LLC to review a rezoning request to rezone parcels along Buckhorn Road FROM: 1-85/Buckhorn Road Economic Development (ED) District TO: Buckhorn Village Planned Development Economic Development District (BVPD-ED). The properties that are subject to the request for rezoning are bordered by 1-85 to the north, Buckhorn Road to the west, and West Ten Road to the south (please see map below). Proposed Rezoning N Mebane City Limits N Approximate size of map Attachment 1 4 The properties in question total approximately one hundred thirty (130) acres in land area, are located within the 1-85/Buckhorn Road Economic Development District, and are located within the Orange County's Comprehensive Plan urban transition land use area. As part of this rezoning request, the Applicant has submitted, in accordance with the provisions of Article Seven (7) and Article Eight (8) of the Orange County Zoning Ordinance, a request to review a proposed Planned Development /Special Use Permit (PD/SUP) application proposing the development of a unified commercial center on the properties. The PD/SUP application proposes the development of over one million square feet of retail, service, office, and limited residential land uses all under unified development control pursuant to the review and approval of the PD/SUP application that proposes a comprehensive master land use, development standards, utilities, multi-modal transportation, and open space program to develop the Buckhorn Village Planned Development. Purpose: To receive citizen comment on the proposed: 1. Rezoning request seeking to rezone the properties from: 1-85/Buckhorn Road Economic Development (ED) District to Buckhorn Village Planned Development Economic Development District (BVPD-ED), and 2. The submitted PD/SUP application proposing the development of the property as a master planned mixed use commercial site. 2. Zoning Ordinance Text Amendments: a.
