PURPOSE: To receive Administration and Planning Board recommendations on and consider
approval for the Preliminary Plan for The Bluffs at Moorefields Subdivision.

21 lots follows the Concept Plan review by Planning Board, then a Preliminary Plan review
by Planning Board and Preliminary Plan decision by the Board of County Commissioners
• Within 1.5 miles of Hillsborough municipal limit.
Existing and Proposed Conditions
Existing:
• Zoning: Agricultural Residential (AR) (min. lot size = 40,000 sq. ft.)
• Pursuant to a Superior Court Consent Order issued in the case of Christopher Road Realty,
Inc. vs. Orange County Board of Adjustment, Orange County and the Owner of the subject
property have agreed as follows: for purposes of the proposed subdivision, there is a
maximum residential density of 17 lots on the property; an impervious surface limit of twelve
percent (12%) shall apply to the property in accordance with the requirements for the Upper
Eno Protected Watershed; and the proposed subdivision must comply with all other
applicable Zoning Ordinance and Orange County Subdivision Regulation requirements.
Physical Features:
• The two designated streams on the property will be protected with stream buffers.
• The site is mostly wooded with a mixture of pines and hardwoods; a meadow is in the center.
• The topography is gently rolling with steeper slopes along the streams.
Adjacent Land Use:
• Sundance Pond Subdivision with an average lot size of 1.89 acres is located across
Dimmocks Mill road to the east [ 5 lot minor subdivision with no common open space-1994]
• Rocky Run Subdivision with an average lot size of 2.38 acres is located to the west. [10-lot
major subdivision under conventional option with no common open space -1988]
• Olive Creek Subdivision with an average lot size of 2.26 acres is located to the north. [3-lot
minor subdivision and an exempt subdivision - 2006; recorded under the Olive Creek name
with no common open space]
• Two residential tracts-one 4.89 acres and one 13.27 acres-are located across Moorefields
Road to the south. [minor and existing lot of record]
• Surrounding lots are generally less dense than The Bluffs at Moorefields, which has an
average density of 2.07 acres; the reason these lot sizes are smaller is that they are
following the flexible development guidelines which allows the maximum density under
watershed regulations, yet maximizes open space by allowing for minimum zoning lot sizes
to be platted:
Proposed:
Roads:
• Access is from Moorefields Road (SR 1135), an existing paved local public road.
• One proposed cul-de-sac street (Peninsula Lane) extends north from Moorefields Road and
provides access to a majority of the lots. Grassland Court extends off Peninsula Lane and
provides access to the remaining lots. The reason that the street does not continue to the
northern property line is that there is a wide stream swale that would have required a large
amount of fill. Erosion Control recommended that a street not cross the stream.
• All roads are to be constructed to NCDOT standards.
• NCDOT comments indicate it has previously acquired right-of-way along Moorefields Road
and an additional sight triangle at the Moorefields Road and Dimmocks Mill Road
intersection. Sight distance at the main entrance has been field verified and approved. A
driveway permit will be required for the new street entrance. (see NCDOT comments)
• Emergency Services has reviewed the preliminary plat and found the plans and locations of
the proposed roads to be acceptable. (see agency review)
• In order to protect the streams, Low Impact Design methods will be used (i.e. rain garden,
grass swales, infiltration devices)

Open Space/Buffers:
• The open space is provided along the stream corridors and along the road frontages. Its
purpose is to help maintain rural character.
• 14.95 acres (44.49%) of common area open space is proposed. All of the open space is
heavily wooded with hardwood and evergreen, except for the area along Moorefields Road at
the southern side of the property where a buffer will have to be created.
• ERCD has indicated the proposed plan "appears consistent with the County's desire to
minimize adverse environmental impacts with respect to the protection of floodplains,
wetlands, natural areas and wildlife habitat."
• Homeowners Association will own and maintain open space, buffers, and signage.
• A 50-foot Pedestrian Open Space Area (POSA) is provided near the center of the
subdivision.
• A ten foot wide open space pedestrian access strip is being recommended between lots 11
and 12 consistent with the Planning Board recommendation from its review of the concept
plan.
Water-Sewer:
• Individual wells.
• Individual septic systems.
• Public water and sewer is not available pursuant to Water and Sewer Management, Planning
and Boundary Agreement
Recreation•
• Cheeks District Park
• No public parkland dedication is recommended because there are no County recreation
and/or open space sites as designated in the Comprehensive Plan on the property. The
payment-in-lieu option is recommended (17 lots x $455/lot = $7,735).
• The Recreation and Parks Advisory Council is recommending payment-in-lieu of publicly
dedicated land.
Court Decision:
• The Owner, Christopher Road Realty, Inc., appealed the Orange County Zoning Officer's
determination concerning watershed designations and impervious surface requirements
applicable to the property to the Orange County Board of Adjustment on July 19, 2006.
• The Orange County Board of Adjustment upheld the Orange County Zoning Officer's
interpretation of the Watershed classification and Impervious Surface Requirements.
• Christopher Road Reality, Inc, appealed the decision.of the Board of Adjustment in Orange
County Superior Court on August 21, 2006.
• Orange County Superior Court issued a Consent Order on September 20, 2007 in the case
of Chistopher Road Realty, Inc. vs. Orange County Board of Adjustment, as explained in
more detail in the "Existing Conditions" section above.
Development Process, Schedule, and Action
Planning Board:
• First Action: A Neighborhood Information Meeting was held on November 20, 2006.
Individuals in attendance: Applicants, Steve Yuhasz and Kevin Huggins; John
Swanson, Steve Rankin, Wilson Lamb, John Cotterman, Chris Lamb, Chris
Quinn
• Second Action: The Concept Plan was approved by the Planning Board on December 6,

2006 with the following conditions:
1. The intersection and road alignments on the Preliminary Plan shall meet NCDOT
standards.
2. Homeowners Association documents that provide for maintenance of the Open Space
shall be submitted with the preliminary plan. Provisions shall be included in the
Homeowners Association documents that would prohibit tree cutting in the Open
Space except for maintenance purposes.
3. Show proposed dedication of an additional 5 feet of right-of-way, or 35 feet from C/L
of existing R/W, whichever is greater, along Dimmocks Mill Road on the Preliminary
Plan.
4. Show five-foot utility easements along both sides of new street rights-of-way.
5. Show location of subdivision sign on Preliminary Plan.
6. Any proposed lighting shall meet Orange County Lighting Standards.
7. A minimum 10-foot wide Open Space Area shall be provided between lots 11 and 12.
8. The Developer shall plant in the buffer area along Moorefields Road.
The Planning Staff recommended approval, in accordance with the attached Resolution of
Approval.
• Third Action: The Planning Board reviewed the Preliminary Plan on November 7, 2007 and
recommended approval in a 5 to 2 vote.
Sandra Quinn and Sam Lasris voted against the proposal indicating water and sewer
concerns. They felt like the development should be on water and sewer.
Two individuals, John Swanson and Wilson Lamb, spoke against the proposal citing
concerns with lighting, density issues and meeting notification. Mr. Swanson and Mr. Lamb
had attended the Neighborhood Information meeting (see attached Planning Board Minutes).
RECOMMENDATION: The Administration Recommends Approval, in accordance with the
attached Resolution of Approval.

THIS CAUSE being heard by the undersigned, the Petitioner and Respondent, and
counsel of each acknowledging as follows:
Petitioner filed a Petition For Judicial Review on August 21, 2006 seeking: (1) judicial
review, in accordance with N.C. Gen. Stat. § 153A-345, of the July 25, 2006 decision of the
Orange County Board of Adjustment ("the Board"); anal (2) a reversal of the Board's decision to
uphold the Planning Director's decision that the 35 acre tract of land owned by Petitioner that is
located at the northwest corner of the southern most intersection of Dimmocks Mill Road and
Moorefields Road, in Orange County, North Carolina (the "Property") is located within the
Upper Eno Critical Area Watershed District.
2. The parties, having agreed that all matters and things in controversy are settled according
to the terms hereinafter recited, consent to the following:
a) For purposes of development, the allowable residential density of the Property
shall be limited to seventeen (17) lots.
b) For purposes of development, the impervious surface limits of the Property shall
be twelve percent (12%) in accordance with the impervious surface requirements

for the Upper Eno Protected Watershed District as specified in Section 6.23.3(c)1
of the Orange County Zoning Ordinance (the "Zoning Ordinance").
c) Except as specifically set forth herein, Petitioner, in the development of the
Property, must comply with all Zoning Ordinance and Orange County
Subdivision Regulations ("the Subdivision Regulations") in effect at the time
Petitioner submits a development application deemed complete as prescribed in
.the Zoning Ordinance and the Subdivision Regulations.
WHEREFORE, IT IS ORDERED, ADJUDGED AND DECREED, by and with the
consent of the parties:
1. For purposes of development, the allowable residential density of the Property shall be
limited to seventeen (17) lots.
2. For purposes of development, the impervious surface limits of the Property shall be
twelve percent (12%) in accordance with the impervious surface requirements for the Upper Eno
Protected Watershed District as specified in Section 6.23.3(c)1 of the Zoning Ordinance.
3. Except as specifically set forth herein, Petitioner, in the development of the Property,
must comply with all Zoning Ordinance and Orange County Subdivision Regulations ("the
Subdivision Regulations") in effect at the time Petitioner submits a development application

RESOLUTION
OF THE
ORANGE COUNTY BOARD OF COUNTY COMII~ISSIONERS
Date: January 15, 2008
Name of Subdivision: The Bluffs at Moorefields
Owner/Applicant: Christopher Road Realty, Inc.
The Board of County Commissioners hereby approves The Bluffs at Moorefields
subdivision preliminary plat, dated April 17, 2006 as revised by surveyor Steve F.
Yuhasz on April 18, 2007 containing 17 lots, subject to the fulfillment of requirements
specified herein.
Peninsula Lane and Grassland Court shall be irrevocably dedicated to the general
public and constructed to standards of the North Carolina Department of
Transportation. The approval of this resolution authorizes and directs the Orange
County Manager to accept for Orange County and on behalf of the public generally, the
offer of dedication of Peninsula Lane and Grassland Court. This acceptance by
Orange County of the dedication to the general public of Peninsula Lane and Grassland
Court shall be without maintenance responsibility. These roads shall be maintained by
the ownerlapplicantuvtil such time as they are accepted for maintenance by the North
Carolina Department of Transportation or some other governmental body. Before the
Final Plat of The Bluffs at Moorefields can be recorded:
A. Sewage Disposal
Each residential lot shall contain an adequate area for septic disposal,
and repair area, approved by the Orange County Division of
Environmental Health.
2. The septic system location may restrict the size and location of
improvements. This disclosure shall be included in a document
describing development restrictions to be recorded concurrently with the
Final Plat. The document shall also disclose that information regarding
'the tentative location of septic systems is available from the Orange
County Health Department, Division of Environmental Health.
B. Roads and Access
Peninsula Lane and Grassland Court shall be constructed to standards of
the North Carolina Department of Transportation, within a 50-foot
right-of-way with 5-foot utility easements on each side, and the
construction shall be inspected and approved by NCDOT.
OR
A letter of credit or escrow agreement shall be submitted and approved by
the County Attorney to secure construction of Peninsula Lane and
Grassland Court to the standards of the North Carolina Department of
Transportation. An estimate of the construction cost must be prepared by
a certified/licensed engineer or grading contractor and submitted to the
Planning and Inspections Department. The financial guarantee must
reflect 110%.of that estimate and be issued by an accredited financial
institution licensed to do business in North Carolina.
The document describing development restrictions to be recorded with the
Final Plat shall state that the financial guarantee will not be released until
the road construction has been inspected and approved by NCDOT.
2. All lots shall receive access from the internal subdivision roads. No
driveway shall be permitted within 50' of a street intersection. The final
plat shall contain No Vehicular Access Areas for all portions of the
subdivision abutting Moorefields Road and Dimmocks Mill Road except
for the proposed intersection of Peninsula Lane and Moorefields Road.
3. An erosion control plan for construction of Peninsula Lane and Grassland
Court shall be submitted by the applicant to the Orange County Erosion
Control Division for review and approval prior to any land disturbing
activity occurring on the site.
4. Approved double-bladed street name signs shall be erected at the
intersections of Moorefields Road and Peninsula Lane and Peninsula
Lane and Grassland Court prior to Planning Department signatures on the
final plat or prior to issuance of any building permit if road construction is
not completed prior to recording of the final plat.
5. Prior to any construction.or alteration of any existing access within the
right-of-way of Moorefields Road, the owner/applicant shall secure~a
driveway permit from the NCDOT District Office. The owner/applicant shall
submit a copy of the NCDOT-approved permit and NCDOT approval letter
to the Planning Department prior to or at the same time as the request for
a grading permit is made, or before Planning Department signatures are
affixed on the Final Plat, whichever is first.
6. Sight triangles (10'x 70') shall be shown on the Final Plat at the
intersection of Peninsula Lane with Moorefields Road.
7. Dedicate, in fee simple, five (5) feet of additional right-of-way, or 35 feet
from the centerline of the existing right-of-way, whichever is greater, along
the frontage of Dimmocks Mill Road. Said dedication shall meet major
.collector road right-of-way standards as identified in the Comprehensive
Plan and required in Section IV-B-3-c-1 of the Subdivision Regulations.
C. Land Use Buffers and Landscaping
1. Landscaping shall be installed or preserved as indicated on the approved
landscape plan, and shall be inspected and approved by the Planning and
Inspections Department prior to signatures on final plat. No part of the
landscaping shall encroach into the 10' x 70' sight triangles at
intersections.
OR
Guaranteed financially through a letter of credit or escrow agreement
submitted to secure required landscape installation and preservation. An
estimate of the cost for required preservation, plantings and their
installation must be provided. The financial guarantee shall reflect 110
percent of the estimate and be issued by an accredited financial institution
licensed to do business in North Carolina in a form approved by the
County Attorney.
Provisions for protection of existing trees as shown on the approved
landscape plan shall be included in a document describing development
restrictions and requirements to be prepared by Planning Staff and
recorded concurrently with the Final Plat. No clear cutting on individual
lots is permitted pursuant to section IV-B-8-c of the Orange County
Subdivision Regulations.
2. The applicant shall provide additional plantings along Moorefields Road
as indicated on the Preliminary Plan.
D. ®rainage
1. Drainage Easements shall be located on the final plat as required
following review and approval of the Erosion Control Plan by County staff.
2. Drainage culverts shall be sized and located appropriately by a licensed
North Carolina Professional Engineer as required by NCDOT and Orange
County Erosion Control.
3. Low Impact Design devices (LID) shall be incorporated into drainage-way
to lessen the stormwater impact to the streams.
4. ,Impervious surface data, as pursuant to Article 6.23.3c.1 of the Zoning
Ordinance shall be included in a document describing development
restrictions and requirements to be prepared by Planning Staff and
recorded concurrently with the Final Plat. The impervious surface for each
lot shall indicate the maximum impervious surface for each lot, net of the
roadway (i.e. excluding roadway).
5. Impervious surface coverage for the subdivision is limited to twelve
percent (12%) for a maximum of 176,470 square feet.
E. Parkland
LawFul currency of the United States in the amount of $7.735.00 shall be
paid to Orange County as payment in lieu of parkland dedication prior to
recordation of the final plat.
2. The developer has offered and shall transfer in fee simple a total of 14.95
acres of open space (44.49%) to the Homeowner's Association. This open
space shall be shown and labeled accordingly on the final, plat. All
maintenance responsibilities for the open space shall be with the
. Homeowner's Association.
3. The second paragraph of Section IV-B-7-b of the Orange County
Subdivision Regulations references the required minimum recreation
space ratio in the Orange County Zoning Ordinance, Article 5.1.1, which
requires 0.028 square feet of recreation space per land area dedicated to
residential use [0.028 * 35.22= .98 acres or 42,688.8 square feet]..In
those cases where the required minimum recreation space results in a
larger amount than the public recreation space requirement of 1/20 acre
per lot, the difference shall be established as private recreation space for
the use of the residents of the development (42,688.8 - 37,026 = 5,662.8
square feet (.13 acres). The developer has planned 14.95 acres of open
space (44.49%) to be owned and maintained by the Homeowner's
Association.
4. Developer shall provide a minimum of 5,662.8 square feet of private
recreation area (e.g. trails, all-purpose field, etc.).
5.. An Open Space area with a minimum width of ten (10) feet shall be
provided between lots 11 and 12 in order to provide access from
Grassland Court to the open space along the eastern boundary of the
property.
F. Construction Waste
1. Per the Orange County Solid Waste Ordinance, clean wood waste, scrap
metal and corrugated cardboard, all present construction waste, shall be
recycled.
2. All haulers of construction waste shall be properly licensed. Developer
shall confirm that hauling contractors are licensed to haul waste in Orange
County.
3. Prior to any demolition or construction activity on the site the applicant
shall hold apre-demolition/pre-construction conference with the County's
.Solid Waste staff. This may be the same meeting held with other
development officials.
G. IVliscellaneous
The Final Plat shall contain a title block and vicinity map in accordance
with Section V-D-2 and V-D-3 of the Orange County Subdivision
Regulations.
2. The open space shall be conveyed into the Homeowner's Association
before Planning Department signatures are affixed to the final plat. Tree
cutting in the roadside Open Space is prohibited except for necessary
maintenance purposes that have been approved by County staff prior to
any such tree cutting taking place. The restrictive covenants applicable to
the property shall be approved by the County Attorney.
3. If street lighting is proposed, then a lighting plan shall be submitted to the
planning office for review and approval prior to purchase of lighting
fixtures from the utility provider or other vender. Any lighting shall meet the
Outdoor Lighting Standards as set forth in section 6.31 of the Orange
County Zoning Ordinance.
4. A sign permit shall be obtained from Orange County for the subdivision
sign located at or near the entrance of the subdivision prior to beginning
construction.
5. Methods of disposal of trees, limbs, stumps and construction debris
associated with construction activity shall be by some method other than
open burning as required in the Orange County Zoning Ordinance.
6. The correct PIN number for the property shall be listed on the Final Plat.
D. Certifications
A Certificate of Survey and Accuracy signed by a Professional Land
Surveyor shall be notarized on the face of the Final Plat in the form
provided in Section V-D-6-a of the Orange County Subdivision
Regulations.
2. A Certificate of Declaration and Maintenance in the form provided in
Section V-D-6-b of the Orange County Subdivision Regulations signed by
the landowner and developer shall be on the face of the plat and included
in a document describing development restrictions to be recorded.

3. The North Carolina Department of Transportation shall certify that the
platted portion of Peninsula Lane and Grassland Court have been entirely
constructed to State standards or that construction plans have been
approved prior to Planning Department signatures on final plat.

4. A Certificate of Approval signed by the Orange County Planning and
Inspections Department and the Orange County Environmental Health
Department shall appear on the face of the final plat in accordance with
Section V-D-6-c of the Orange County Subdivision Regulations.
NOW THEREFORE BE IT RESOLVED by the Board of Orange County
Commissioners that the Preliminary Plan for The Bluffs at Moorefields .Subdivision is
approved in accordance with the above mentioned conditions and attached Preliminary
Plat dated April 17, 2006 as revised by surveyor Steve F. Yuhasz on April 18, 2007.

The Planning Board hereby recommends that the Orange County Board of County
Commissioners approve The Bluffs at Moorefields subdivision preliminary plat, dated
April 17,2006 as revised by surveyor Steve F. Yuhasz on April 18, 2007 for the
construction of Peninsula Lane and Grassland Court, public roads in Orange County,
subject to the fulfillment of conditions specified herein.
Before the Final Plat of The Bluffs at Moorefields can be recorded the following
conditions must be satisfied:
A. Sewage Disposal
1. Each residential lot shall contain an adequate area for septic disposal,
and repair area, approved by the Orange County Division of
Environmental Health.

subdivision abutting Moorefields Road and Dimmocks Mill Road except
for the proposed intersection of Penninsula Lane and Moorefields Road.
3. An erosion control plan for construction of Peninsula Lane and Grassland
Court shall be submitted by the applicant to the Orange County Erosion
Control Division for review and approval prior to any land disturbing
activity occurring on the site.
4. Approved double-bladed street name signs sha{I be erected at the
intersections of Moorefields Road and Peninsula Lane and Peninsula
Lane and Grassland Court prior to Planning Department signatures on the
final plat or prior to issuance of any building permit if road construction is
not completed prior to recording of the final plat.
5. Prior fo any construction or alteration of any existing access within the
right-of-way of Moorefields Road, the owner/applicant shall secure a
driveway permit from the NCDOT District Office. The owner/applicant shall
submit a copy of the NCDOT-approved permit and NCDOT approval letter
to the Planning Department prior to or at the same time as the request for
a grading permit is made, or before Planning Department signatures are
affixed on the Final Plat, whichever is first.
6. Sight triangles (10'x 70') shall be shown on the Final Plat at the
intersection of Peninsula Lane with Moorefields Road.
7. Dedicate, in fee simple, five (5) feet of additional right-of-way, or 35 feet
from the centerline of the existing right-of-way, whichever is greater, along
the frontage of Dimmocks Mill Road: Said dedication shall meet major
collector road right-of-way standards as identified in the Comprehensive
Plan and required in Section IV-B-3-c-1 of the Subdivision Regulations.
C. Land Use Buffers and Landscaping
1. Landscaping shall be installed or preserved as indicated on the approved
landscape plan, and shall be inspected and approved by the Planning and
Inspections Department prior to signatures on final plat. No part of the
landscaping shall encroach into the 10' x 70' sight triangles at
intersections.
OR
Guaranteed financially through a letter of credifi or escrow agreement
submitted to secure required landscape installation and preservation. An
estimate of the cost for required preservation, plantings and their

installation must be provided. The financial guarantee shall reflect 110
percent of the estimate and be issued by an accredited financial institution
licensed to do business in North Carolina in a form approved by the
County Attorney.
Provisions for protection of existing trees as shown on the approved
landscape plan shall be included in a document describing development
restrictions and requirements to be prepared by Planning Staff and
recorded concurrently with the Final Plat. No clear cutting on individual
lots is permitted pursuant to Section IV-B-S-c of the Orange County
Subdivision Regulations.
2. The applicant shall provide additional plantings along Moorefields Road
as indicated on the Preliminary Plan.
D. Drainage
1. Drainage Easements shall be located on the final plat as required
following review and approval of the Erosion Control Plan by County staff.
2. Drainage culverts shall be sized and located appropriately by a licensed
North Carolina Professional Engineer as required by NCDOT and Orange
County Erosion Control.
3. Low Impact Design devices (LID) shall be incorporated into drainage-way
~to lessen the stormwater impact to the streams.
4. Impervious surface data, as pursuant to Article 6.23.3c.1 of the Zoning
Ordinance shall be included in a document describing development
restrictions and requirements to be prepared by Planning Staff and
recorded concurrently with the Final Plat. The impervious surface for each
lot shall indicate the maximum impervious surface for each lot, net of the
roadway (i.e. excluding roadway)..
5. Impervious surface coverage for the subdivision is limited to twelve
percent (12%) for a maximum of 176,470 square feet.
E. Parkland
1. Lawful currency of the United States in the amount of $7,735.00 shat( be
paid to Orange County as payment in lieu of parkland dedication prior to
recordation of the final plat.
2. The developer has offered and shall transfer in fee simple a total of 14.95
acres of open space (44.49%) to the Homeowner's Association. This open
space shall be shown and labeled accordingly on the final plat. All
maintenance responsibilities for the open space shall be with the
Homeowner's Association.
3. The second paragraph of Section IV-B-7-b of the Orange County
Subdivision Regulations references the required minimum recreation

space ratio in the Orange County Zoning Ordinance, Article 5.1.1, which
requires 0.028 square feet of recreation space per land area dedicated to
residential use [0.028 * 35.22= .98 acres or 42,688.8 square feet]. In
those cases where the required minimum recreation space results in a
larger amount than the public recreation space requirement of 1/20 acre
per lot, the difference shall be established as private recreation space for
the use of the residents of the development (42,688.8 - 37,026 = 5,662.8
square feet (.13 acres). The developer has planned 14.95 acres of open
space (.44.49%) to be owned and maintained by the Homeowner's
Association.
4. Developer shall provide a minimum of 5,662.8 square feet of private
recreation area (e.g. trails, ,all-purpose field, etc.).
5. An Open Space area with a minimum width of ten (10) feet shall be
provided between lots 11 and 12 in order to provide access from
Grassland Court to the open space along the eastern boundary of the
property.
F. Construction Waste
1. Per the Orange County Solid Waste Ordinance, clean wood waste, scrap
metal and corrugated cardboard, all present construction waste, shall be
recycled.
2. All haulers of construction waste shall be properly licensed. Developer
shall confirm that hauling contractors are licensed to haul waste in Orange
County.
3. Prior to any demolition or construction activity on the site the applicant
shall hold apre-demolition/pre-construction conference with the County's
Solid Waste staff. This may be the same meeting held with other
development officials.
G. Miscellaneous
1. The Final Plat shall contain a title block and vicinity map in accordance
with Section V-D-2 and V-D-3 of the Orange County Subdivision
Regulations.
2. The open space shall be conveyed into the Homeowner's Association
before Planning Department signatures are affixed to the final plat. Tree
cutting in the roadside Open Space is prohibited except for necessary
maintenance purposes that have been approved by County staff prior to
any such tree cutting taking place, The restrictive covenants applicable to
the property shall be approved by the County Attorney.
3. If street lighting is proposed, then a lighting plan shall be submitted to the
planning office for review and approval prior to purchase of lighting
fixtures from the utility provider or other vender. Any lighting shall meet
the Outdoor Lighting Standards as set forth in section 6.31 of the Orange
County Zoning Ordinance. .
4. A sign permit shall be obtained from Orange County for the subdivision

sign located at or near the entrance of the subdivision prior to beginning
construction.
5. Methods of disposal of trees, limbs, stumps and construction debris
associated with construction activity shall be by some method other than
open burning as required in the Orange County Zoning Ordinance.
6. The correct PIN number for the property shall be listed on the Final Plat.
H. Certifications
1. A Certificate of Survey and Accuracy signed by a Professional Land
Surveyor shall be notarized on the face of the Final Plat in the form
provided in Section V-D-6-a of the Orange County Subdivision
Regulations.
2. A Certificate of Declaration and Maintenance in the form provided in
Section V-D-6-b of the Orange County Subdivision Regulations signed by
the landowner and developer shall be on the face of the plat and included
in a document describing development restrictions to be recorded
concurrently with the Final Plat.
3. The North Carolina Department of Transportation shall certify that the
platted portion of Peninsula Lane and Grassland Court have been entirely
constructed to State standards or that construction plans have been
approved prior to Planning Department signatures on final plat.
4. A Certificate of Approval signed by the Orange County Planning and
Inspections Department and the Orange County Environmental Health
Department shall appear on the face of the final plat.in accordance with
Section V-D-6-c of the Orange County Subdivision Regulations.
NOW THEREFORE BE IT RESOLVED by the Planning Board recommends that
the Board of Orange County Commissioners approve the Preliminary Plat for The Bluffs
at Moorefields Subdivision in accordance with the conditions referenced herein and the
attached Preliminary Plat dated April 17, 2006 as revised by surveyor Steve F. Yuhasz
on April 18, 2007.

Thank you for the opportunity to review a Preliminary Plan for the "Bluffs at Moorefields"
subdivision proposal. The proposal would create 17 lots on 35.22 acres. (33.76 excluding
public road ROW) located at the southern end of Moorefields Road at Dimmocks Mills Road
(Cheeks Township).
ERCD staff comments on subdivisions are generally to a) address any concerns with respect
tci potential impacts on important natural or cultural resources, and b) identify any areas
that might be desirable for possible dedication to the County for public recreation/open
space pursuant to Section TV-B-7-b of the Orange County Subdivision Ordinance. .
My comments on this proposal are based on an examination of the Preliminary Plan (dated
April l7, 2006) fora "Conservation Cluster" subdivision and a review of ERCD's
comprehensive resource database.
The plan would set aside 15.11 acres of Open Space (44.76%) along streams and public
roadways-considerably more than the required 33% (11.1 acres), although the vast
majority of the Open Space is comprised of land in the 100-year floodplain adjacent to
Rocky Run (an Eno River tributary) and a riparian buffer to a feeder stream.
There is no natural heritage site or proposed county wildlife corridor within or adjacent to
this property. There are no adopted plans for proposed greenway corridors associated with
this property. (Nor are there any historic sites identified in the county's inventory.)
The preliminary plan appears consistent with the County's desire to minimiize
adverse environmental impacts with respect to the protection of floodplains,
wetlands, natural areas and wildlife habitat.
ERCD recommends that the proposed Open Space remain in private ownership
and managed as common land (wildlife habitat and low-impact recreation) by
the homeowners association.

Thank you for the opportunity to review the concept plan for this, subdivision.
The preliminary plan for this 17 lot, 35.22 acre subdivision proposes 15.11 acres (44.76%) be set
aside for open space to be conveyecl~to a homeowners association. Mast of the area
recommended far open space.appears to consist of stream. buffer and flood plain.
The Recreation acid Parks Advisory Council (RPAC) concurs with the proposal for open space as
described on the plan. In addition, RPAC finds that the area would be suitable for a recreational
trail (natural surface) or certain other recreational facilities that would enhance the community if
desired by the developer.
RPAC finds that there is no land within or adjacent to the subdivision that has been identified as
part of a future park, trail network, wildlife corridor network or future greenway in existing and
approved plans, maps or reports. Therefore, the Council recommends that the County accept
payment in lieu of publicly dedicated land.

The design flow is based upon the number of bedrooms applied for by the properly
owner or developer. The design flow for a bedroom is 120 gallons/day (gpd).
(e.g. 480 gpd = 4 bedrooms)
Proposed house locations are provided by tb.e property owner or developer as
required by 15A NCAC 18A .1900 - .1969 (The Laws and Rules.far Sewage
Treatment and Disposal Systems). .
The design flow, type system, and pump requirement are subject to change based
upon the application and site plan or plat submitted for the Wastewater
Construction Authorization.
The blocked areas on the accompanying plat are the limits of the provisionally
suitable soils as evaluated by the Orange County Health Department.
It should be noted that all lots having aconventional-type or innovative drain field
with pump are reviewed at a minimum of every five years by the health department
as required by 15A NCAC 1$A .1961 (Maintenance of Sewage Systems).
Ultra Shallow Trench Conventional Systems are placed iri areas with 24 inches or
more of provisionally suitable soiUsite characteristics and a 6-10" soil cap is placed
over the trenches.
Shallow Trench Conventional Systems are placed in areas with 30 inches or more
of provisionally suitable soiUsite characteristics.
Conventional Trench Systems are placed in areas with 36" inches or more of
provisionally suitable soiUsite characteristics.
Innovative Trench Systems can be used in areas with 24-36 "of provisionally
suitable soiUsite characteristics.
PPBPS (Prefabricated Porous Block Panel Systems) can be used in areas with 42"
or more of provisionally suitable soiUsite characteristics.
The approved septic areas should be kept free of vehicular traffic, IORRin~,
uradinR, and compacting activities. It is the responsibility of the property owner
or developer to maintain the integrity of the septic areas prior to system
construction and installation. We recommend installing tree protection fencing
around the approved septic areas to limit site disturbance during construction. No
parking, cutting or filling shall be allowed in or around the drain field areas.
Drainage ways and easements should be utilized to convey storm water run-off to
the storm water retention areas. These conveyances should not be located through
designated septic drain field areas.
This report is for planning purposes only and does not constitute any approval. Lot
approval is granted by the health department only in the form of an Improvement
Permit.

Per your request, this office has reviewed the second site plan submittal and provide the
following comments:
1. The location of the proposed access provides satisfactory sight distance and sufficient
spacing relative to existing intersections.
2. The plat has indicated the existing 60' right of way on Moorefield. Road and has
dedicated right of way 35' from the center of Dimmock's Mill Road, however the plat does
not indicate the existing 150' X150' sight distance triangle at the intersection of
Moorefield Road and Dimmocks Mill Road as recorded in DB 1433, PG180. The plat does not
clearly indicate the right of way dimension on Grassland Court. A minimum 50'
public right of way is required per NCDOT specs.
3. No detailed engineering drawings were provided for NCDOT review of the internal
streets. If the Developer wishes for these
roads to be eligible for State Maintenance, then it is necessary for him to submit
complete engineering drawings for NCDOT review and approval.
4. The Developer shall obtain an approved NCDOT driveway permit and/or encroachment
agreements prior to beginning work within the
NCDOT right of way. Permits will be issued upon receipt of approved plans, inspections
fees, and any necessary bonds.

The Solid Waste Department Staff reviewed the most recent set. of plans received and conditionally approve the plans
based on the following comments ALL REMAINING ISSUES MAY BE ADDRESSED DURING FINAL PLAN REVIEW:
Need Solid Waste Management Plan:
We recommend that a Solid Waste Management Plan Sections 1 and 2 be developed for the LANDCLEARING
PORTIONS of this project. Specifically, this plan should address how landclearing debris will be managed. We
recommend that this plan be initiated as soon as possible so that the collection of ~ecyclables can be considered as the
site plan is being developed. We recommend the applicant contact Solid Waste Staff at 968-2800 x163 for assistance in
developing the Solid Waste Management Plan if necessary. .
Pre-construction Meeting Stipulation:
We recommend that the applicant be stipulated as a condition of permit issuance to hold the pre-demolition and pre-
construction conferences with Orange County Solid Waste staff.
Curbside Recycling:
If roads are public streets, constructed to DOT standards, Orange Community Recycling intends fo provide regular
curbside recycling services to all single=family-type residences in this proposed development at such time it is included in
the Orange County recycling program collection service area. Until such time when curbside recycling services are
available to this development, residents may deliver recyclables to a drop off site located at any Solid Waste Convenience
Center.
LCID:
We recommend the applicant provide the name(s) of the permitted waste disposal facilit(ies) to which any landclearing or
demolition waste will be delivered. This information should be supplied, as soon as determined and prior to start of work,
in a letter to the Solid Waste Department or at the pre-construction conference.
NOTES TO BE PLACED ON RESOLUTION OF APPROVAL:
Construction Waste:
1. By Orange County Ordinance, clean wood waste, scrap metal and corrugated cardboard, all present in
construction waste; must be recycled.
2. By Orange County Ordinance, all haulers of construction waste must be properly licensed.
3. Prior to any demolition or construction activity on the site the applicant will hold apre-demolition/pre-construction

Eddie Kirk: You had reviewed the concept -plan on December 6, 2006 and this is the preliminary version. Reviewed
.Abstract.
Jay Bryan: Please show Moorefield on the map.
Eddie Kirk: It is not on that map. Reviewed map. Most of the property is wooded.
Jay Bryan: On page 54, regarding the landscaping, in terms of the guarantee to secure required landscape
preservation. Has that been identified?
Eddie Kirk: The only area that there is required planting is the buffer along Moorefield in that open space. The rest is
wooded.
Jay Bryan: There is a stream and that does not appear on the plan for dedication or walking trail.
Eddie Kirk: We are recommending, as the ordinance requires a private recreation area.
Jay Bryan: They would be for this development, not the public?
Eddie Kirk: Yes.
Sam Lasris: At the December meeting, there was question about the soil quality, has that been resolved?
Eddie Kirk: On page 66, there is a report from Environmental Health.
Sam Lasris: There would be suitable space for repair?

Sam Lasris: Where would that come from?
Eddie Kirk: They have identified enough land on each lot for the septic and repair.
Jay Bryan: On page 67, the approved septic area item, are those recommendations are required?
Eddie Kirk: Yes by Environmental Health.
Steve Yuhasz: This is almost identical to the concept plan in layout. The only real change is that we added one
more access to the open space which this board has asked for.
Sam Lasris: How do you get to lot 13?
Steve Yuhasz: There is 30 foot wide strip that runs from the cul-de-sac and there would be a driveway installed
there.
Jay Bryan: Is there any public comment.
Wilson Lamb: I wish they would not build these houses. I am concerned about lights. I would like highly shielded
lights.
Jay Bryan: There is a recommendation that if street lighting is proposed that a lighting plan be submitted and has to
be in compliance with the Orange County Zoning ordinance.
Steve Yuhasz: At this point, there is no plan to install street lights.
Wilson Lamb:' Would a prohibition be possible?
Steve Yuhasz: I am not opposed to that but I can't speak for the owners or the Sheriffs department. I know the
Orange County lighting requirements are down facing.
Wilson Lamb: You need to look at Cedar Ridge.
Joe Swanson: I have concerns about the lighting also. I feel like I have walked into something that was already
decided. In talking to my neighbors, I don't feel like I didn't have adequate notice. The 17 lots are out of character
with the area. Many of the landowners in our neighborhood own two lots. I understand there are slave cemeteries in
that area. In the past, Mr. Cranford mentioned larger lots. Sandra Quinn also opposed the project due to water
concerns. The land is high in the center and the water will drain on both sides.
Renee Price: Mr. Swanson, are you on the east side?
Joe Swanson: I am at where Dimmicks and Moorefield meet.
Renee Price: You are saying that most of the lots on the east side are shown as small acreage.
Joe Swanson: My one lot is 2.02 acres and my lot is 2.19 acres. My other lot is 1.54 acres and they are showing
1.85 acres. My neighbors have five acres or more: This is basically the same plan that was denied by the previous

developer with five less houses. If the board wants to give definiteness to what it had decided eight or nine years
ago.
Craufurd Goodwin: Did you receive notification?
Joe Swanson: There was a very small sign on Moorefield. Most people did not even see it.
Jay Bryan: Was there a neighborhood meeting to meet with the developer'?
Joe Swanson: The first time I got involved was at that meeting. It seemed it was already decided. I don't think I had
adequate time to voice their concerns.
Sam Lasris: Are there regulations that determine repair fields.
Eddie Kirk: They require a minimum of 40,000 square feet and'enough space on the property plus the septic field
and a complete repair.
Sam Lasris: That has been determined on every lot.
Steve Yuhasz: To install a septic system for a four bedroom house is 10,000 square feet. The septic and repair
usually require 20,000 square feet. There was a meeting and this gentleman was at the meeting. The lots that he
owns are still separate property. There is one inaccuracy. The previous subdivision that was turned down had 25
lots on 30 acres and this has 17 lots on 35 acres.
Brian Crawford: My recollection was that the concept plan was well attended. There were two plans, correct?
Eddie Kirk: No, this is the flexible plan you saw.
Renee Price: I am concerned about the western portion towards the stream; would the septic system go downhill
into the stream?
Steve Yuhasz: In general, that is true. The idea of identifying particular soils for a septic system is so it will not go
into neighboring streams.
Renee Price: I am looking at the proximity. We don't have'a footprint of the house.
Steve Yuhasz: I think that is the purpose of having a buffer.
Wilson Lamb: I. don't remember receiving any mail. There were 8.5 x 11 signs posted about 20 feet off the road.
Craufurd Goodwin: Could we have a response from staff about notifying the neighborhood.
Robert Davis: The ordinance requires that all property owners within 500 feet of the outside perimeter of the
subdivision be notified. It is generated by Land Records. They are mailed a notice.
Jay Bryan: The gross density for this project is 2.7 acres, could you explain that number?
Robert Davis: Generally, the gross density is the total acreage divided by the number of lots proposed. All of these
lots came through the minor subdivisions or the major subdivision under the conventional options. That means that
no open space was required. You get a smaller lot size and the difference goes to the common open space. If you
look at the map on page 60, most of the lots are in the same range. The map is not a reason to deny a subdivision.

Jay Bryan: Is type "C" the most intense buffering?
Robert Davis: No. Type "C" is a 30 foot buffer that will give you asemi-opaque screen.
Jay Bryan: There is no requirement about the buffer?
Robert Davis: No.
Jay Bryan: The next step would be "C" to "A"?
Robert Davis: It goes "A, B, C, D".
Jay Bryan: "D" is how far?
Robert Davis: 75 feet.
Sam Lasris: I see the map because we do have a concept plan.
Robert Davis: Under flexible development, one of those characteristics is the buffer. From the density standpoint, it
is somewhat similar because the lots are one acre. In this case, we require a buffer along the stream.
Wilson Lamb: The association owns the open space, will there be public access?
Steve Yuhasz: There is not planned public access.
Wilson Lamb: I wondered about people who wanted to take a walk.
MOTION made by Brian Crawford to approve the plan with recommendations. Craufurd Goodwin seconded the
motion.

Sandra Quinn: I am sure it meets County Ordinance. I think it is out of character and until there is public water and
sewer available we do not need this type of dense development.
Jay Bryan: Is there any interest to say we do not want street lighting? They are not planning any street lighting.
Craufurd Goodwin: Are you suggested we change the zoning requirements?
Renee Price: You wanted to specify it in the plan?
Jay Bryan: No.
Eddie Kirk: This will go to the Board of County Commissioners in December or January.
Jay Bryan: Will you let them know when that will be.
Joe Swanson: When will be the next item?
Jay Bryan: It could be the next meeting in December or Janurry. The staff has agreed to let you know when that
meeting will be.

Renee Price: A question to staff; when we get these maps, could we show ownership instead of these lot lines?
Craufurd Goodwin: It doesn't matter.
Eddie Kirk: It would be hard to get a map with the owners on each lot.
Jay Bryan: I would like the issue of notification and the signs to come back to the board before the board.
Sam Lasris: We did have an answer on page 8.
Craufurd Goodwin: Suppose the board decided to vote against this on Sandy's grounds?
Sandra Quinn: This is an advisory board.
Brian Crawford: There is a plan and this fits within the ordinance.
Sandra Quinn: I have the right to disagree.
Brian Crawford: We have already been sued on this project.
Sandra Quinn: If we have voted on it, it meets the law, then why ask us.
Jay Bryan: For anyone who feels the ordinance or regulations are not the way they should be for a particular issue,
you could raise a motion that would ask that a particular situation be re-examined regarding the regulations.
Regarding the regulations and ordinance, there are sections that could be used to justify turning down a development
based on some public welfare issues.
Brian Crawford: It does raise a point, one thing we have to push the whole issue of alternatives of another site for
water and sewer.
Jeffrey Schmitt: That opportunity presents itself with the Comprehensive Plan.
Sandra Quinn: I would not want to punish this developer. I feel this is an advisory board and I think this should send
a signal to the Board of County Commissioners that we are not in agreement with this. I will continue to say it. It you
are telling me I can't vote that way, I won't be here.

Renee Price: There was supposed to be an ordinance review committee that was put on hold. Separate issue
before we go on...Jay; you had asked about the Courtesy Review and it is supposed to be discussed at the Board of
County Commissioners meeting review in November., Will that be addressed?
Robert Davis: I'll ask Gene.
Jay Bryan: Maybe a status report on where that issue is regarding Hillsborough, Garrboro and Chapel Hill.
