BACKGROUND: The property is located in Cheeks Township on the east side of Dimmocks Mill Road (SR 1134) , approximately .01 mile north of the intersection with the southern loop of Moorefields Road (SR 1135) . The total acreage of the tract is 5.22 acres. It is designated as Agricultural-Residential in the Land Use Element of the Comprehensive Plan. The property is zoned Agricultural-Residential (AR) with an overlay zoning designation of Upper Eno Protected Watershed. Adjacent land uses are agricultural and residential. Three (3) lots are proposed which have direct state road frontage and to be served by individual wells and septic tanks. The average lot size is 1.74 acres. Section One was approved through the Minor Subdivision process in February of this year. It consisted of five (5) lots with direct state frontage on Dimmocks Mill Road. This property is actually one of the approved lots. The Concept Plan for Sundance Pond - Section Two was approved with no conditions by the Planning Board on November 21, 1994. • • 2 All agency comments received are attached. The Orange County Health Department has located a suitable area on each lot for a septic tank, drain field and repair area. Comments from the North Carolina Department of Transportation included a recommendation that the driveway for Lot 5 be located as far as possible from Moorefields Road. In response, the Planning Staff recommended a joint driveway for Lots 5 and 6. In the April 17, 1995 meeting, the Planning Board recommended approval of the attached Resolution of Approval. RECOMMENDATION: The Administration recommends approval of the attached Resolution per the Planning Board recommendation. Garrett at 732-8181, extension: 2581 11 RESOLUTION OF THE ORANGE COUNTY BOARD OF COUNTY COMMISSIONERS Date: April 10. 1995 Name of Subdivision: Sundance Pond - Section Two Owner/Applicant: John Hogan The Board of County Commissioners hereby approves Sundance Pond - Section Two subdivision preliminary plat, dated February 7, 1995 and containing 3 lots, subject to the fulfillment of requirements specified herein. Dimmocks Mill Road shall be irrevocably dedicated to the general public. The approval of this resolution authorizes and directs the Orange County Manager to accept for Orange County and on behalf of the public generally, the offer of dedication of Dimmocks Mill Road. This acceptance by Orange County of the dedication to the general public of Dimmocks Mill Road shall be without maintenance responsibility. Before the Final Plat of Sundance Pond - Section Two can be recorded: A. Sewage Disposal 1. Each residential lot shall contain an adequate area for septic disposal, and repair area, approved by the Orange County Division of Environmental Health. 2. Disclosure that the septic system location may restrict the size and location of improvements. This disclosure shall be included in a document describing development restrictions to be recorded concurrently with the Final Plat. The document shall also disclose that information regarding the tentative location of tic systems is available from the Orange County Health Department, Division of Environmental Health. B. Land Use Buffers and Landscaping 1. Landscaping shall be installed or preserved as indicated on the approved landscape plan, and must be inspected and approved by the Planning and Inspections Department. 12 The applicant shall secure landscape requirement installation and preservation through a letter of credit, escrow agreement, or bond. An estimate of the cost for required preservation, plantings and their installation must be provided. The financial guarantee shall reflect 110% of the estimate and be issued by an accredited financial institution licensed to do business in North Carolina. 2. Provisions for protection of existing trees as shown on the approved landscape plan shall be included in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. C. Drainage 1. Impervious surface data, as pursuant to Article 6.23 of the Zoning Ordinance shall be included in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. D. Parkland 1. Cash in the amount of$245.00 shall be paid to Orange County as payment in lieu of parkland dedication. E. Miscellaneous 1. The Final Plat shall contain a title block and vicinity map in accordance with Section V-D-2 and V-D-3 of the Orange County Subdivision Regulations. 2. A setback of 40 feet shall be maintained as measured from the edge of right-of-way. Side yards shall be a minimum of 20 feet, and rear yards a minimum of 20 feet. These setback requirements shall be stated on the plat, and in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. 3. Lots 5 and 6 m ust share a joint driveway to eliminate access conflict at the intersection with Moorefields Road (SR 1135). Show the driveway location on the Final Plat. F. Certitididions 1. A Certificate of Survey and Accuracy signed by a registered Land Surveyor shall be notarized on the face of the Final Plat. 2. A Certificate of Declaration and Maintenance in the form provided in Section V-D-6-b of the Orange County Subdivision Regulations signed by the landowner and developer shall be on the face of the plat and included in a document describing development restrictions to be recorded concurrently with the Final Plat. 13 3. The Division of Environmental Health shall certify that each lot contains a suitable area for septic disposal. The Planning Staff recommends approval of the Concept Plan for Stoney Creek Farms - Section 2 with public roads built to State standards and 6 conditions: 1. Choose another name for the proposed subdivision (required with previous Concept Plan reviews) to avoid confusion with Stoney Creek Subdivision; 2. Recombine lots as necessary to assure that each lot contains adequate buildable area and sewage disposal/repair area outside steep slopes and stream buffers; 3. The proposed road must meet the NCDOT minimum centerline curve radius; 4. All lots must meet minimum lot width of 130 feet; 5. Road crossings of the stream buffer must be perpendicular to the stream; and 6. The applicant should investigate obtaining access to New Hope Church Road via Blunderbuss Lane, an existing private road. b. Preliminary Plans ( 1) Sundance Pond - Section Two (3 Lots - Cheeks Township) Presentation by Mary Willis. The property is located in Cheeks Township on the east side of Dimmocks Mill Road (SR 1134 ) , approximately .01 mile north of the intersection with the southern loop of Moorefields Road (SR 1135) . The total acreage of the tract is 5.22 ;: acres. It is designated as Agricultural- Residential (AR) with an overlay zoning designation of Upper Eno Protected Watershed. Adjacent land uses are agricultural and residential. Three lots are proposed which have direct state road frontage and are to be served by individual wells and septic tanks. This direct state fronts property is actually one of the approved lots. The Concept Plan for Sundance Pond - Section Two was approved with no conditions by the Planning Board on November 21, 1994. The North Carolina Department of Transportation has approved the Preliminary Plan based on six conditions: 1. Dedicate as right-of-way and move the property lines to proposed right-of-way line on Dimmocks Mill Road (SR 1134) . 2. Recommend location of Lot 5 driveway as far as possible from SR 1135. 3. Need book and page numbers for Sundance Pond, Lot 4R. 4. Need property designation. 5. Need Surveyor Certification. 6. Need Surveyor Classification. These conditions have been included in the Resolution of Approval. Willis noted that there will be a joint driveway for lots 5 & 6 to minimize the number of access points and also to keep the driveway for lot 5 as far as possible from the intersection of Moorefields Road as possible. Willis indicated the Planning Staff wished to make one change to the Resolution of Approval - Section E, item 3 which states "Move the property line to the edge of the road right-of-way line for Dimmocks Mill Road. In this case the existing deed goes to the centerline of Dimmocks Mill Road but the right-of-way is dedicated. In some older deeds, the property line goes to the centerline of the roadway. The intent is to keep that from happening with new roads, and not force the developer to change those deeds at this point. The Planning Staff recommends that the Preliminary Plan for Sundance Pond -Section Two be approved with the Resolution of Approval with the elimination of Item #3 in Section E. The Resolution of Approval is an attachment to these minutes on pages ) . 16 0 O W Steve Yuhasz, surveyor, stated that Section E D Item 5, "Provide Plat Book and Page number for Sundance Pond, Lot 4R" should also be eliminated since it already exists on the subdivision plat. Willis agreed that this condition has already been met. Waddell asked Mr. Yuhasz if it would be all right to leave the condition as is even though it has been met and he agreed. MOTION: Barrows moved approval with the elimination of Section E, Item 3 as recommended by Willis. Seconded by Hoecke. VOTE: Unanimous. Public Input Meetings - Community Goals for the Historic Preservation Element of the Comprehensive Plan Presentation by Donald Belk. This item is to notify the Planning Board of the schedule of Public Input Meetings regarding Community Goals for the Historic Preservation Plan. Three meetings have been scheduled for the first week of May: Tuesday, May 2 at Cane Creek Church Activity Center; Wednesday, May 3 at New Hope Elementary School; Thursday, May 4 at Walnut Grove United Methodist Church. All meetings will begin at 7:30 p.m. Public participation will be the key element in developing the plan.
