SR Investigation Reports for:

PURPOSE: To make a recommendation to the North Carolina Department of Transportation
(NCDOT) concerning a petition to add roads within the New Hope Springs Subdivision to the State
Maintained Secondary Road System.
BACKGROUND: New Hope. Springs Subdivision was approved by the Board of County
Commissioners through the major subdivision process. The roads within New Hope Springs
were originally platted and approved as public roads. The developer of this subdivision has
petitioned the North Carolina Department of Transportation (NCDOT) to accept maintenance
responsibilities for New Hope Springs Drive, Hope Valley Drive and Valley Creek Drive. The roads
are located in New Hope Springs Subdivision off the south side of Davis Road, Chapel Hill Township.
New Hope Springs was developed in three (3) sections. The Board of County Commissioners
(BOCC) approved Section 1 in June 1992, Section 2 in September 1994 and Section 3 in March
2000. All sections were approved with "all roads irrevocably dedicated to the general public" and
"constructed to standards of the North Carolina Department of Transportation". The subdivision also
provides two (unconstructed) stub outs to provide future access to property to the east and south of
the development.
NCDOT has investigated these requests (please refer to attached Secondary Road Addition Reports)
and has submitted the petitions to the Board of Commissioners for its review and recommendation.
In accordance with North Carolina General Statute §136-62*, the Board is required to make a
recommendation regarding the petitions to the North Carolina Board of Transportation (NCBOT)
before the NCBOT can consider the petitions. ,
"North Carolina General Statute §136-62 directs that "The citizens of the State shall have the right to present petitions to'
the board of county commissioners, and through the board to the Department of Transportation, concerning additions to
the system and improvement of roads. The board of county commissioners shall receive such petitions, forwarding them
on to the Board of Transportation with their recommendations."

FINANCIAL IMPACT: There is no direct financial impact to the County associated with this item.
NCDOT will incur additional maintenance responsibilities and costs.
RECOMMENDATION(S): The Manager recommends that the Board forward the Petition for
Addition to the State Maintained system for New Hope Springs Drive, Hope Valley Drive and Valley
Creek Drive to the NCDOT with a recommendation that the Board of Transportation accept those
roads for maintenance.

INSTRUCTIONS FOR COMPLETING PETITION:
1. Complete Information Section
2. Identity Contact Person (This person serves as spokesperson for petitioner{s)).
3. Attach four (4) copies of recorded subdivision plat or property deeds, which refer to candidate road.
4. Adjoining property owners and/or the developer may submit a petition. Subdivision roads with prior NCDOT review and
approval only require the developer's signature.
5. If submitted by the developer, encroachment agreements from all utilities located within the right of way shall be submitted
with the petition for Road addition. However, construction plans may not be required at this time.
6. Submit to District Engineer's Office.

REQ'C.l'IItEMENTS FOR ADDITION
If this road meets the requirements necessary for addition, we agree to grant the Department of Transpo2tation a
right-of-way of the necessary width to construct the road to the minimum construction standards of the NCDOT.
This right~or-way will extend the entire length of the road that is xequested to be added to the state maintained
system and will include the necessary areas outside of the right-of--way for cut and hlI slopes and drainage. Also,
we agree to dedicate additional right-of--way at intersections far sight distance and design puzposes and to execute
said right-of--way agreement forms that will be submitted to us by representatives of the NCDOT. The right-of
way shall be cleared at no expense to the NCDOT, which includes the removal of utilities, fences, other
obstructions, etc.
General Statute 136-102.6 (see page 29 far Statute) states that any subdivision recorded on or after October 1,1975, mast be
built in accordance with NCDOT standards in order to be eligible for addition to the State Road System.
