Edwards, NCDOT Craig Benedict, 245-2592 SR Investigation Report for North Scotswood Blvd. PURPOSE: To make a recommendation to the North Carolina Department of Transportation (NCDOT) concerning a petition to add North Scotswood Blvd. in Churton Grove Subdivision to the State Maintained Secondary Road System. BACKGROUND: Churton Grove Planned Development was approved by the Board of County Commissioners (BOCC) through the Class A Special Use process, rezoning process and major subdivision process. The roads within Churton Grove were originally platted and approved as public roads. The BOCC has previously recommended that the NCDOT accept maintenance of roads platted in Phase I (Churton Grove Blvd., Dunn Place, McRae Place, Foreman Street, Patrick Henry Lane and James Madison Place) .and Phase II-A (Churton Grove Blvd. Ext., Ainsworth Drive, East Bromfield Drive, West Bromfield Drive, Hadfield Drive and Cavell Gourt) of the planned development. The developer of Churton Grove Planned Development has petitioned the North Carolina Department of Transportation (NCDOT) to accept maintenance responsibilities for North Scotswood Blvd., the major access street off US Highway 70 (US 70) into the planned development. Churton Grove is located in the Northeast quadrant of US 70 and St. Mary's Road in Hillsborough and Eno Townships. The Board of .County Commissioners (BOCC) approved a Class A Special Use Permit fora 410 single-family lot, 216 multi-family unit and 65,460 square foot commercial complex Planned Development for Churton Grove in May 1986 with the stipulation that the rezoning and effective date of the special use permit would occur upon approval by the Water Resources Division of the N.C. Department of Natural Resources and Community Development of a water allocation plan developed by and for the Town of Hillsborough. The change in the zoning of the property and the Special Use Permit for the Planned Development became active in March 1998. North Scotswood Blvd. is a four-lane divided street constructed in Phase II of the development and serves as a subdivision access road and as access to the commercial complex and multi-family units of the development. 2 NCDOT has investigated this request (please refer to attached Secondary Road Addition Report) and has submitted the petition to the Board of Commissioners for its review and recommendation. In accordance with North Carolina General Statute §136-62*, the Board is required to make a recommendation regarding the petitions to the North Carolina Board of Transportation (NCBOT) before the NCBOT can consider the petitions. A requirement of the Special Use Permit for the development states that the applicant shall request annexation by the Town of. Hillsborough for each phase of the development following the construction of required improvements. The Town may eventually act on the voluntary request for annexation. FINANCIAL IMPACT: There is no direct financial impact to the County associated with this item. NCDOT will incur additional maintenance responsibilities and costs. RECOMMENDATION(S): The Manager recommends that the Board forward the Petition for Addition to the State Maintained system for North Scotswood Blvd. to the NCDOT with a recommendation that the Board of Transportation accept North Scotswood Blvd. for maintenance as a State secondary road. North Carolina General Statute §136-62 directs that "The citizens of the State shall have the right to present petitions to the board of county commissioners, and through the board to the Department of Transportation, concerning additions to the system and improvement of roads. The board of county commissioners shall receive such petitions, forwarding them on to the Board of Transportation with their recommendations." This right-or-way will extend the entire length of the road that is requested to be added to the state maintained system and will include the necessary areas outside of the right- of way for cut and fill slopes and drainage. Also, we agree to dedicate'additional right-of--way at intersections far sight distance and design purposes and to execute said right-of--way agreement forms that will be submitted to us by representatives of the NCDOT.
