Letter from Town of Hillsborough Planning Staff PURPOSE: To make a recommendation to the North Carolina Department of Transportation (NCDOT) concerning a petition to add subdivision roads in Cameron Estates to the State Maintained Secondary Road System. BACKGROUND: Cameron Estates Subdivision is located off the east side of North Carolina Highway 57, Hillsborough Township, in the Town of Hillsborough's Extraterritorial Planning Jurisdiction (outside the municipal limits of the Town). Cameron Estates Subdivision was formed through a recombination plat. This recombination was recorded as an "exempt' plat per North .Carolina General Statute § 153A-335, and was not subject to any local government subdivision regulations. Cameron Estates was originally approved as Governor's Downs subdivision by the Hillsborough Board of Commissioners in July 1995. The Town Board approved the subdivision with public streets. (Please refer to the attached letter from Hillsborough Planning staff.) The recombination plat for this application meets the intent of criteria endorsed by the Board of County Commissioners for recommending acceptance of a public road into the State Maintained System for roads approved through the governing jurisdiction's major subdivision process. Those criteria are: • Right-of-way extended to allow connectivity; • Irons have been set at the edge of right-of-way to mark the corners of the lots; • Plat includes appropriate certificates of dedication of the right-of-way and acceptance of the public right-of--way signed by the appropriate entities. The subdivision was not subject to Orange County subdivision regulations, as the subdivision is located in Hillsborough's planning jurisdiction. The plat lacks the acceptance of the public right-of--way certificates signed by a governing body as that is an Orange County certificate requirement. and is not required by the Town of Hillsborough. The plat does contain proposed 2 subdivision road construction standard certification signed by NCDOT staff, which serves as the certificate of dedication of right-of-way in this case. Orange County expects that the Town of Hillsborough will annex this subdivision in the future, as the area is in the Town's Extraterritorial Jurisdiction and. the Hillsborough Board of Commissioners approves development in this area. NCDOT has investigated this request (please refer to attached Secondary Road Addition Reports) and has submitted the petition to the Board of Gommissioners for its review and recommendation. In accordance with North Carolina General Statute §136-62*, the Board is required to make a recommendation regarding the petitions to the North Carolina Board of Transportation (NCBOT) before the NCBOT can consider the petitions. FINANCIAL IMPACT: There at this time is no direct financial impact to the County associated with this item. NCDOT will incur additional maintenance responsibilities and costs. RECOMMENDATION(S): The Manager recommends that the Board forward the Road Petition for Addition to the State Maintained System for Governor Drive, Dairy Farm Drive, Rock Garden Lane, Silver Fox Circle and Harold Latta Drive to the NCDOT with a recommendation that the Board of Transportation accept those roads for maintenance. `North Carolina General Statute §136-62 directs that "The citizens of the State shall have the right to present petitions to the board of county commissioners, and through the board to the Department of Transportation, concerning additions to the system and improvement of roads. The board of county commissioners shall receive such petitions, forwarding them on to the Board of Transportation with their recommendations." Subdivision roads with prior NCDOT review and approval only require the developer's signature. 5. If submitted by the developer, encroachment agreements from all utilities located within the right of way shall be submitted. with the petition for Road addition. FOR NCi)OT USE ONLY: Please check the appropriate block Rural Road ~SubdiVlslOn established prior to October T, 19'15 ~Subdivlsion established after October I, 1975 REQUIREMENTS FOR .ADDITION Tf this road meets the requirements necessary for addition, we agree to grant the Department of Transpar~tian a right of-way of the necessary width to construct the road to the minimum construction standards of the NCDOT. This zightor--way will extend the entixe length of the road that is requested to be added to the state maintained system and will include the necessary areas outside of the right-of way for cut and fill slopes and drainage. Also, we agree to dedicate additional right-of--way at intersections for sight distance and design purposes and to execute said right~of way agreement forms that will be submitted to us vy representatives of the NCDOT. The right-of- way shall be cleared at no expense to the NCDOT, which includes the removal of utilities, fences, ether obstnactions, etc. General Statute X36-102.6 {see page 29 for Statute) states that any subdivision recorded on or after October 1,1975, must be built in accordance with NGDOT standards in order to he eligible for addition to the State Road System. Box 8181 Hillsborough, NC 27278 VIA HAND DELIVERY Subject: Status of approved roads in Cameron Estates subdivision Ms. Lincoln: Cameron Estates subdivision (formerly Burke's Meadow, Phase 2 and Governor's Downs, Phase 2) is located in the Town of Hillsborough's Extratemtorial Jurisdiction. The. Preliminary Plan for the original subdivision (then Governor's Dawns} was approved by the Town Bvard of Commissioners on July 10,1995. At that time, the roads shown in the subdivision were reviewed by the North Carolina Department of Transportation and approved by the Town as public streets.
