PURPOSE: To consider establishing a fee for the disposal of certain
scrap tires, not eligible under State law for free disposal.
BACKGROUND: The State of North Carolina collects a 2% tax on new tires
sold in North Carolina and distributes 68 percent of the proceeds of
this tax on a per capita basis to the 100 counties to offset the costs
of scrap tire disposal. The State prohibits local governments from
imposing a local fee for disposal of scrap tires, with a few
exceptions: for example, for tires originating from outside of North
Carolina.
As outlined in the attached LOG staff memorandum, the proceeds from the
2% tax have been insufficient to cover the costs incurred by the Orange
Regional Landfill to dispose of scrap tires. Landfill Owners' Group
(LOG) staff believe that some of these tires are not eligible for free
disposal under the requirements set out in the State statutes. At
their April 6 meeting, the LOG unanimously approved a staff
recommendation to the governing boards of Chapel Hill, Carrboro, and
Orange County that a disposal fee of 75 cents per tire or $75 per ton
be imposed on scrap tires not eligible for free disposal. The fee
would be implemented as soon as approved by all three governing boards.
RECOMMENDATION: The Manager recommends that the Board approve the
scrap tire disposal fee at 75 cents per tire or $75 per ton for those
scrap tires not eligible for free disposal under State law.
