NORTH CAROLINA
RESOLUTION REGARDING
ORANGE COUNTY LEGISLATIVE MATTERS
BE IT RESOLVED by the Board of Commissioners of Orange County
that the Board hereby requests the Senators and Representatives
representing Orange County to introduce and support the following
legislative matter:
1. AN ACT AUTHORIZING THE ORANGE COUNTY HUMAN RELATIONS
COMMISSION TO ACT AS A FEDERALLY DESIGNATED DEFERRAL AGENCY AND
AUTHORIZING THE NORTH CAROLINA OFFICE OF ADMINISTRATIVE HEARINGS
AND THE NORTH CAROLINA HUMAN RELATIONS COMMISSION TO ACT AS
DEFERRAL AGENCIES FOR CASES FILED PURSUANT TO THE ORANGE COUNTY
CIVIL RIGHTS ORDINANCE WHERE ORANGE COUNTY IS THE NAMED RESPONDENT
(Exhibit A to this Resolution) .
Upon motion of Commissioner Don Willhoit , seconded by
Commissioner Stephen H. Halkiotis , the foregoing resolution was
adopted this the 18th day of April 1 1995.
I, Beverly Blythe, Clerk to the Board of Commissioners for the
County of Orange, North Carolina, DO HEREBY CERTIFY that the
foregoing is a true copy of so much of the proceedings of said
Board at a meeting held on April 18, 1995 as relates
in any way to the adoption of the foregoing and that said
proceedings are recorded in Minute Book No. 28 of the minutes of
said Board.

AMENDMENT TO A BILL ENTITLED AN ACT MAKING FURTHER SUNDRY
AMENDMENTS CONCERNING GOVERNMENTS IN ORANGE COUNTY
PART I. ORANGE COUNTY
Sec. 5. Section 6 of Chapter 246, Session Laws of 1991, as
rewritten by Section 14 of Chapter 358 of the 1993 Session Laws, is
amended by adding a new section (g) and renumbering the existing
sections (g) and (h) to read sections (h) and (i) :
Ng) ( 1) The Board of Commissioners may authorize the
Commission to serve as a deferral agency for cases deferred by the
Equal Employment Opportunity Commission to the Commission as
provided in Section 706 of the Civil Rights Act of 1964, 42 U.S.C.
S 2000e-5, the Age Discrimination in Employment Act, 29 U.S.C. S
621 et seq. , and the Americans with Disabilities Act, 42 U.S.C. S
12101 et seq. , or for cases deferred by the Fair Housing Division
of the United States Department of Housing and Urban Development as
provided in 42 U.S.C. S 3616.
(2) When a complaint is filed with the Commission,
pursuant to the Ordinance which alleges employment discrimination
naming Orange County as a respondent, the Commission may defer the
case to the Office of Administrative Hearings. When a complaint is
filed with the Commission pursuant to the Ordinance which alleges
housing discrimination, discrimination in public accommodations or
other bias related conduct naming Orange County as a respondent,
the Commission may defer the case to the North Carolina Human
Relations Commission.
(3) The Office of Administrative Hearings is designated
to serve as the Commission's deferral agency for cases deferred by
the Commission to the Office of Administrative Hearings as provided
in subsection (g) (2) of this section and as such shall have all of

the powers and authority necessary to function as a deferral agency
including those enumerated in G.S. S7A-759 .
(4) In accordance with the functions and duties
enumerated in G.S. S143B-391, the North Carolina Human Relations
Commission is designated to serve as the Commission's deferral
agency for cases deferred by the Commission to the North Carolina
Human Relations Commission as provided in subsection (g) (2) of this
section and as such shall have all of the powers and authority
necessary to function as a deferral agency.
(5) The Chief Administrative Law Judge for the Office of
Administrative Hearings and the Executive Director of the North
Carolina Human Relations Commission for the North Carolina Human
Relations Commission are authorized to contract with Orange County
to serve as deferral agencies. The Civil Rights Division in the
Office of Administrative Hearings may carry out the functions of a
deferral agency for the Office of Administrative Hearings. "
