PURPOSE: To consider the legal advertisement for items to be presented at the Board of
County Commissioners/Planning Board Quarterly Public Hearing scheduled for August 25,
2008.
BACKGROUND: The Board of County Commissioners reviews proposals to be considered at
public hearing for consistency with general County policy and presentation format. The following
items are proposed for consideration at the August 25, 2008 Quarterly Public Hearing.
A. PUBLIC HEARING ITEMS
Zoning Atlas Amendment, Planned Development Petition for Efland Commons Single-
Family Subdivision: Review of a Planned Development (PD)/rezoning petition proposing
the development of asingle-family subdivision on 12.88 acres of land in Cheeks Township at
the northwest intersection of Tinnin Road (SR1313) and School House Road (SR1314). The
applicant has filed both a Conservation Cluster Flexible Development Plan and a
Conventional Subdivision Plan. The Conservation Cluster plan proposes 27 lots with
approximately 45% open space. The Conventional Plan proposes 45 lots with approximately
40.4% open space. The lot sizes range from approximately 5,000 to 19,000 square feet and
are intended for the construction and sale of ,moderately priced homes. The project is
located within the Efland Transition area per the Land Use Element of the Orange County
Comprehensive Plan and will be served by County public sewer and Orange-Alamance
Water System, Inc., a private water utility provider. Transition areas are identified areas in
Orange County that are targeted for higher density development due to availability of, and
proximity to, public services and transportation infrastructure. The Planned Development
rezoning approach is a method of achieving higher densities while allowing area property
owners greater access to information on any specific proposal than would be the case under
a general use rezoning construct. The maximum gross density of the project will range
between 2.1 and 3.5 units per acre for the Conventional Plan. All roads are to be
constructed to NCDOT public road standards. (A map is included with this agenda item,
which shows the specific area and vicinity).
2. Comprehensive Plan Update Phase II: This will be the third and final Public Hearing held
during the Comprehensive Plan update process. The last Public Hearing was held on May
19, 2008 to introduce and receive public comments on the draft Comprehensive Plan in its
entirety. The Board of County Commissioners scheduled this additional Public Hearing on
the draft Plan to provide additional time for the public to review the document and prepare
.comments.
The Comprehensive Plan is an official public document that includes analysis of existing and
predicted conditions and provides guidance for future legal and policy decisions, as
determined by Orange County. The updated Plan will serve to guide development and the
preservation of resources within the unincorporated areas of the County, by addressing a
multitude of issues. The adopted Plan also serves as the statutory basis for many of Orange
County's land use regulations as well as the application of zoning districts, as zoning must
be in accordance with a comprehensive plan.
On October 3, 2006, the Board of County Commissioners (BOCC) approved a process for
updating the County's Comprehensive Plan in two phases as follows:
Phase I, to include the development of Comprehensive Plan goals and County Profile
Element; and Phase II, to include the remaining seven (7) Elements of the updated
Comprehensive Plan.
Phase I was completed by the County in September 2007 and Phase II was initiated
immediately thereafter.
During October 2007-April 2008, a Planning Consultant, County staff and the following
County advisory boards have worked together to develop the draft Comprehensive Plan:
Affordable Housing Advisory Board, Agricultural Preservation Board, Commission for the
Environment, Economic Development Commission, Historic Preservation Commission,
Orange Unified Transportation Board, Planning Board, and Recreation and Parks Advisory
Council.
The Comprehensive Plan includes the following eight Elements: 1) County Profile; 2)
Economic Development; 3) Housing; 4) Land Use; 5) Natural and Cultural Systems; 6) Parks
and Recreation; 7) Services (Utilities) and Community Facilities; and 8) Transportation.
Recommendations are also provided in the draft Comprehensive Plan that address the
administration, implementation, and monitoring of the Plan that will need to take place
following its adoption.
In addition to numerous citizen comprised County advisory board meetings, during Phase II
of the update process, the County conducted public input meetings on January 28th, April 3~a
April 9th and April 23~a
The .draft Comprehensive Plan is available on the Orange County Planning Department
website at http://www.co.orange.nc.us/planning/compre_cpupdate.asp.
Purpose: To provide an additional opportunity to receive public comment on the updated
Comprehensive Plan in its entirety and receive direction from the Board of Commissioners
as to subsequent steps.
FINANCIAL IMPACT: Other than advertising costs, which are included in the proposed FY
2008-09 Budget, there are no direct financial impacts associated with the approval of this item.
RECOMMENDATION(S): The Administration recommends approval of the proposed August
25, 2008 Quarterly Public Hearing legal advertisement.

A joint public hearing will be held in the Judge F. Gordon Battle Superior Courtroom of the
New Orange County Courthouse, 106 E. Margaret Lane, Hillsborough, North Carolina, on
Monday, August 25, 2008, at 7:30 PM for the purpose of giving all interested citizens an
opportunity to speak for or against the following items:

Bob Barrett, agent for School House Road Partners, LLC (Holder of Purchase
Contract Option from George Tate, Jr. Heirs and Ollie McDade, Bonnie W. McDade
and Sandra H. McDade), has submitted a petition to rezone from R-1 (Rural
Residential District) to PD-H-R5 (Single-family residential with accessory uses)
property located in the Cheeks Township at the northwest intersection of Tinnin

the Orange County Tax Records as Parcel Identification Numbers 9845-40-5243,
