PURPOSE: To consider draft revisions to the Orange County Personnel Ordinance
sections covering "Trainee Appointment" and "Salary of Trainee." These
are proposed to support appointment of an Environmental Health Specialist
Trainee in the Orange County Health Department.
BACKGROUND: The Board of Commissioners approved a new Environmental Health
Specialist position effective in December 1994. That new position has been
filled by an internal transfer of an Environmental Health Specialist.
Personnel has recruited extensively for the remaining vacant Environmental
Health Specialist position. Over the last four months, recruitment has not
yielded a candidate who is available for employment and meets the
minimum education and experience requirements for the position.
In general, counties in North Carolina have had difficulty filling
Environmental Health Specialist positions. This is due in part to the
minimum qualification requirements mandated by Article 4, Chapter 90A of
the General Statutes of North Carolina.
The North Carolina Association of County Commissioners 1995 Legislative
Goals supported by the Board of Directors for consideration included a
proposed goal to:

Support legislative review to determine if overly
stringent employment and certification requirements
impose handicaps on the ability of counties to hire
qualified Environmental Health Specialists.
In view of the recruitment situation and State requirements, the State
Department of Human Resources has advised filling the position with a
trainee appointment.
The current Personnel Ordinance includes provision for a trainee
appointment. There has not been a need to use this type of appointment for
several years. Prior to use of a trainee appointment, the Ordinance sections
relating to trainee appointments need to be updated and clarified.
The proposed changes include:
- Clarifying that a trainee appointment may extend beyond the maximum
length of the probationary period.
- Specifying that an employee appointed as a trainee who does not
satisfactorily meet the minimum qualification requirements of the class
during the established trainee period is terminated.
- Adding a provision that a trainee salary progression may include salary
increases at predetermined intervals during the trainee appointment
period.
- Specifying that a trainee salary may not be adjusted to the minimum of
the salary range for the class until the minimum qualification
requirements have been completed.
With the approval of the proposed Personnel Ordinance changes, the Health
Department may fill the Environmental Health Specialist position with a
trainee, if the current recruitment does not yield candidates who meet the
requirements for regular appointment.
RECOMMENDATION: The Manager recommends the Board adopt the proposed Personnel
Ordinance revisions effective April 1, 1995

Article II, Section 5.3, Trainee Appointment
5.3 Trainee Appointment
A trainee appointment may be made to a permanent position in any class for which
the specification includes special provisions for a trainee progression leading to
regular appointment.
An employee may not remain on a trainee appointment beyond the time when the
minimum qualification requirements for the class are met.
After the employee has successfully completed all edueatien and expefienee minimum
qualification requirements, . the
employee will be granted permanent status or probationary status if the employee
has not yet satisfied the probationary period requirement.
If the period of trainee appointment equals or exceeds the maximum probationary period,
permanent status must be is given immediately or-be separated. upon completion of the
minimum qualification requirements for the class. If the employee fails to
satisfactorily meet the minimum qualification requirements for the class during the
established trainee appointment period,the employee is terminated.
If an employee with permanent status in a position in one class accepts a trainee
appointment to a position in another class,the employee waives permanent status
for the duration of the trainee appointment. The employee may regain permanent
status either through successful completion of the trainee appointment or transfer to
a position in another class for which he or she meets the minimum qualification
requirements.
