HomeMy WebLinkAboutAgenda - 08-22-2006-5oORANGE COUNTY BOARD OF COMMISSIONERS ACTION AGENDA ITEM ABSTRACT Meeting Date: August 22, 2006 SUBJECT: Authorization to Close DEPARTMENT: Purchasing and Central Services Action Agenda Item No. ,5-p on Eubanks Road PUBLIC HEARING: (YIN) No County Attorney ATTACHMENT(S): INFORMATION CONTACT: Pam Jones, 245-2652 Geof Gledhill, 732-2196 PURPOSE: To consider authorizing the County Attorney tc complete closing on the Eubanks Road property, acquired for siting the Animal Services Facility., BBACKGROUND: In September 2005, the Board authorized the purchase of a 5.5 acre parcel of land on Eubanks Road as a potential site for the proposed Animal Services Facility for a total of $167,000. One of the conditions of closing was that the County acquire the needed regulatory approvals from the Town of Chapel Hill. The County has received reasonable assurance through various conversations with Town Planning staff that the property may be used for the intended purpose, although a Special Use Permit (SUP) and perhaps re-zoning may be required. Since the process is lengthy (12 months is cited as the timeline for expedited review), the County Attorney and Staff are recommending that the Board authorize the property closing in advance of the requirement far regulatory approval condition being met, In the unlikely event that an SUP or re-zoning request is not granted, the property is desirable for and would likely be used as buffer area for the Landfill, which is immediately to the west of the subject property. FINANCIAL IMPACT: There is na additional financial impact prompted by this action. Funding far the purchase of this property is provided by the 2004 2/3 Net Debt Reduction Bonds, as approved by the Board in September 2005. RECOMMENDATION(S): The Manager recommends that the Board amend the Offer to Purchase and Contract to delete the requirement that the Town of Chapel Hill approve Orange County s planned governmental use of the property before the County is required by the contract to purchase the property; and authorize the County Attorney and the Finance Director to close on the purchase of this property as soon as practical.
