Neebe for Spring 2014 Arts Grant Agreement $250 / a2 0,(4-- 3 � C a ORANGE COUNTY ARTS COMMISSION z m RA m+ c u r r ,a r 5 SPRING,2014 GRANT AGREEMENT C;�Pt4 fit!1 5 51'0?► � p tl c � THIS AGREEMENT, entered into this 16th day of June, 2014, by and between Orange County ("County"), by and through the Orange County Arts Commission ("Arts Commission") and Paul M. Neebe ("Grant Recipient"). WHEREAS, the Arts Commission is a countywide arts agency that ensures the growth of local arts experiences by providing funding and support for diverse high quality programs and projects. WHEREAS, the Arts Commission administers the Spring and Fall Arts Grants Program to provide economic opportunities to Orange County artists and non-profit organization coordinating arts projects benefiting the citizens of Orange County. WHEREAS, the Spring Arts Grants Program is supported by Arts Commission with funds from the Grassroots Program of the North Carolina Arts Council, an agency of 11he Department of Cultural Resources and the National Endowment for the Arts. WHEREAS, the Grant Recipient was selected by the Arts Commission to receive the Spring Arts Grant through the procedures duly adopted by the Arts Commission; and WHEREAS, both parties wish to promote and maintain the integrity and clarity of the Grant Recipient's ideas and statements and delineate the Grant Recipient's obligations to the County; NOW, THEREFORE, the County and the Grant Recipient, for the consideration and under the conditions hereinafter set forth, agree as follows: 1. Approved Grant Project. Grant funds are provided under this Agreement for the project ("Project") described in the Grant Recipient's Grant Application, attached hereto and incorporated herein as Exhibit A. 2. Grant Award. Grant funds in an amount not to exceed two hundred and fifty dol. ($250) have been awarded by the Arts Commission to the Grant Recipient for the approved Project. These funds must be matched at least dollar-for-dollar with cash from the Grant Recipient's funds not derived from either Orange County appropriations or the North Carolina Arts Council. 3. Contingency. This grant is contingent on North Carolina Arts Council Grassroots Program funding to the Arts Commission. Final decisions on Grassroots Program funds to the North Carolina Arts Council are subject to approval by the North Carolina General Assembly. 4. Responsibilities of the Grant Recipient 1 Revised May 2012 A. Implementation. The Project implementation shall take place between July 1, 2014 and June 30, 2015. The Project shall be implemented in the manner described in Exhibit A. Time is of the essence in the implementation of the Project. B. Modifications to project. Grant Recipient shall present major changes to the original proposal, including but not limited to changes in design, implementation schedule and increase in Project budget by more than 10%, in writing to the !'arts Commission for approval. Arts Commission shall approve or disapprove Grant Recipient's request for modifications within seven (7) days of receipt thereon. Consent to project modifications shall not be unreasonably withheld. Arts Commission's decisions shall be in writing. In the event the Arts Commission fails to approve or disapprove the requested modifications within the time stated herein,the modifications shall be deemed approved. C. Non—assi nment. The grant cannot be assigned or transferred to a different project or artist without prior written approval of the Arts Commission. D. Records. Grant Recipient must maintain records and other evidence: pertainink, to costs incurred and revenues acquired during the Project implementation. Grant Recipient shall maintain financial records pertaining to the Project fir three (3 years from the date of this Agreement, in case of audit. E. Use of Funds. Grant Recipient shall not use the grant funds to repay outstanding taxes or other debts of any nature. The grants shall be utilized solely for tlic purpose of implementing the Project and Project related expenses. F. Final Report. Grant Recipient shall submit to the Arts Commission a Final Report on July 6, 2015 . The Final Report shall be in the format required by the North Carolina Arts Council. Failure to submit the Final Report or late submission of the Final Report, for any reason, shall be grounds for denial and/or cancellation of grant funds for the Project and future grant proposals. 5. Responsibilities of the Arts Commission A. Payment. The Arts Commission shall release the grant funds in the amount on $250 to the Grant Recipient. 6. Publicity A. Acknowledizeme nt. Credit must be given to the Orange County Arts Commission using the Arts Commission logo and if State funds are received to the North Carolina Grassroots Program in brochures, news releases. programs, and all other printed and online publications. Copies of such primed materials must accompany the evaluation report. When no printed information is used, verbal credit shall be given. In addition, all print and promotional material must include the following credit line (check all that apply): 2 Revised May 2012 i. x County Funds Only. "This program is supported hl' the Orange County Arts Commission with funds from the Grassroots Progr aln of the North Carolina Arts Council, a state agency. " B. The Grant Recipient must enter all events, exhibits and performances open to the public and related to this grant award on the ExploreChapelHiltARTS.com website and display ExploreChapelHillARTS.com publicity materials (postcards, brochures, etc.) prominently and consistently at their venue or performance space. In addition, the Grant Recipient must add a link to the ExploreChapelHillARTS.com (ExploreChape1Hi11ARTS.com logo preferre(l) to their main webpage. The Grant Recipient shall contact the Orange County A rt s Commission for replacement ExploreChapelHiltARTS.com publicity materials. 7. Indemnity. The Grant Recipient agrees to indemnify and hold harmless the County, the Arts Commission and the North Carolina Arts Council and their officers and employees from any and all claims or actual injury, damage or loss to a person, or real or personal property that results from or is in any way connected to the use of the grant funds. 8. Independent Contractor. The Grant Recipient is an independent contractor and not an employee, agent or other representative of the County and/or the Arts Commission. Nothing contained in this Agreement shall be construed to create the relationshil) of principal and agent, or employer and employee, between Grant Recipient and Arts Commission or Orange County Government. Grant Recipient understands and agrees that he/she is not authorized to incur any expenses or any liability whatsoever on behalf of the County or the Arts Commission and has no authority, expressed or implied. to obligate or make representations on behalf of the County or the Arts Commission. In addition, Grant Recipient agrees to maintain his or her own worker's compensation insurance for himself/herself and his or her employees for the duration of the art work's installation. 9. Termination A. In the event of any of the circumstances set forth below (hereinafter referred to as "default"),the Arts Commission may immediately terminate this Agreement: (i) Any fraudulent representation in any verification required to oritain payment under this Agreement or other dishonesty on a material matter relating to the performance of services under this Agreement. (ii) Nonperformance, incomplete service or performance, or failure to satisfactorily perform any part of the Project or to comply with any provision of this Agreement, as determined by the Arts Commission in its sole discretion. 3 Revised May 2012 (iii) Failure to adhere to the terms of applicable county, state or federal laws, regulations, or stated public policy. B. In the event of default by the Grant Recipient, the Arts Commission has the discretion to elect to terminate this Agreement, in whole or in part and/or require the Grant Recipient to repay the grant funds within seven (7) from written notice of default or allow the grant recipient the opportunity to cure the default. This clause shall not be interpreted to limit the County's or the Arts Commissioii's remedies in law or in equity. 10. Miscellaneous. A. Entire Agreement. This Agreement and the attachments contain the final and entire understanding of the parties with respect to the subject matter of this Agreement. All modifications and amendments to this Agreement shall be ill writing. This Agreement shall be binding upon the parties, their heirs, successors and assigns. B. Governing Law. This Agreement shall be interpreted in accordance with the law s of the State of North Carolina and the Orange County. NC s Paul Neebe Orange County Arts Council Narrative Proposed project is the CD Pressing of a recording titled "21St Century American Trumpet Concertos" consisting of American Trumpet and Orchestra Concertos recorded by Paul Neebe with the State Philharmonic Orchestra Kosice. Albany Records has agreed to be the label on this project and is committed to this final stage of the project. The cost for pressing is $4,500. Albany records will do considerable marketing including sending over 100 Copies to public radio stations in the USA including North Carolina. Albany will also make the CD available on Itunes and Spotify. One composer, Roger Petrich, works in Chapel Hill at St. Thomas More, Catholic Church. Another composer, Eddie Bass, lives in Greensboro, North Carolina. Composers Richard Cioffari and Walter Ross are from Ohio and Virginia respectively. A project of this magnitude will surely boost the Artistic presence of North Carolina and especially Chapel Hill. This will be the third CD from Artist and Trumpet Paul Neebe. The first "Te Deum" (2004) was a CD of Trumpet and Organ works. The second "American Trumpet Concertos" (2006) was for Trumpet and Orchestra. What distinguishes this CD "21 st Century American Trumpet Concertos" from all the rest are two things. 1. All the pieces were commission and performed by Paul Neebe 2. A published composer and arranger, his works have been commissioned and performed by artists and ensembles nationally and internationally. They have been presented at the International Double Reed Society, the International Horn Society, the International Trumpet Guild, the National Flute Association, the International Tuba Euphonium Association, the New York Brass, and on NPR's "From the Top." Several of his works are on the Music Educators National Conference state contest lists and two of his works, for unaccompanied bassoon and trumpet ensemble, are generally considered standard repertory for those media. He is a member of the American Society of Composers, Authors and Publishers and is listed in the International Who's Who in Music. He has served as principal keyboardist of the Columbus Symphony Orchestra and as a collaborative pianist and chamber recitalist. An unusually versatile musician, he was principal double bassist of the North Carolina Symphony and has conducted the Ohio Wesleyan University Chamber Orchestra and the Metropolitan Chamber Orchestra of Columbus. Concerto Iberico for Trumpet and Orchestra was commissioned in 2009 by Paul Neebe, who premiered the new work on April 30, 2011 with the Charlottesville Symphony Orchestra. It received its European premiere with Neebe as soloist on September 24, 2013 and the State Philharmonic Orchestra Kogice, under the baton of Steven White. Richard Cioffari was there for both premieres as well as at the CD recording sessions. The composer writes: "It has been quite a journey since Paul and I discussed the idea of my writing a concerto for him. I was immediately and enthusiastically smitten by the concept. We brainstormed and I decided to write a traditional, full-length three-movement concerto for full orchestra that would meet performer and audience expectations for a work that would showcase the trumpet in what it does best within a context of musical substance. Because the trumpet seems to me an instrument particularly adept in conveying the idioms of music traditionally associated with Spain, I adapted such a flavor in this concerto. I also particularly wanted to call for a wide range of expressivity for the soloist, from the bombastic fanfare of the opening to the quiet tenderness in the beginning of the second movement. Above all, I endeavored to treat the trumpet and respect it as an instrument capable, within its idiom, of the degree of subtlety one would expect, for example, from a violin. During the process of bringing the concerto to life with Paul, I was very impressed with his musical subtlety and virtuosity, as well as his excellent ideas and collegiality. I could not be happier with Paul's performance of Concerto Iberico as portrayed on this CD. He brings to the piece the required wide range of expressivity, and his technique is every bit up to the not inconsiderable demands made on the performer." Walter Ross (b. 1936) has written a number of major concertos far various instruments including oboe, harp, bassoon, clarinet, piano, flute and guitar, trombone, tuba, double bass, and violin. Ross prefers the concerto form to that of the symphony because of its more varied possibilities for artistic expression in contrasting the solo against the orchestra. His works are published by Boosey & Hawkes, Terzak Verlag (Germany) and Dorn Publications (Massachusetts). Eleven compositions have been recorded commercially on CRI, Golden Crest, Ravello, MMC and Crystal, among other labels. In 1972 Boosey & Hawkes nominated Ross for a Pulitzer Prize. Ross has received a number of awards and prizes as well as many grants and fellowships. He has been a visiting composer at the Aspen Music Festival and a featured composer at several universities and forums. He has been heard on national and international radio broadcasts and was a member of the board of the Capital Composers Alliance. Trumpet Concerto was commissioned in 2004 by Paul Neebe, who premiered the work in 2007 during a recital tour in North Carolina and Virginia with organist Tom Brown. Walter Ross writes: "When Paul Neebe asked me to write him a concerto. I accepted immediately because I had heard him perform on many occasions and was impressed with his technique and quality of tone. I wanted to address these aspects of his musicianship in my concerto. The first movement is rather aggressive in character. It is in the Aeolian mode and has a diverse percussion section enlarged by a piano. The second movement is romantic in nature with rich harmonies and smooth, flowing melodies giving the solo trumpet a chance to sing. The last movement is similar to the first in character, but is now a three- part scherzo with more technical display on the part of the soloist. The trumpet and full orchestra bring the concerto to a rousing conclusion," Roger Petrich (b. 1938), a North Dakota native, earned his Bachelor of Music from St. Olaf College (magna cum laude) and his MA & MFA at Thc University of Iowa, where he studied music history, music theory, composition and organ performance. Mr. Petrich studied composition with the Pulitzer Prize-winning American composer Leo Sowerby at the American Conservatory of Music in Chicago. He continued his studies with Dr. Sowerby as one of the first Fellows of the College of Church Musicians at Washington National Cathedral in Washington, D.C. Petrich also studied composition with Ernst Pepping at the Berlin School of Church Music in Spandau, Germany and sang as a member of the Spandauer Kantorei under the direction of Helmut Rilling. Mr. Petrich's music has been published by Oxford University Press as well as Selah, Concordia, Morningstar, Augsburg and Fortress publishing. The Choral Variations on `Ah, Holy Jesus ' has been recorded several times, most notably in "Music from Riverside." Two of his compositions for trumpet, Sonatina and Prayer and Epilogue, have been recorded by Paul Neebe and featured on the nationally-syndicated radio program "Pipe Dreams." The recently composed Missa Brevis has been premiered at St Lambertus Basilika, Netherlands. Zatten was commissioned in 2005 by Paul Neebe during the composer's vacation to do ancestral research in the town of Zatten, currently part of Poland. The premiere was in 2007 with the East Chapel Hill High School Orchestra, Paul Neebe soloist, Ryan Ellefsen conducting and Roger Petrich in attendance. The composer writes: "The DNA of this composition tracks back to my great-grandfather and the tiny Plattdeutsch village where he was born. Zatten is located in the eastern part of Berlin/Brandenburg and in an area of forest and small farms dating back to the 1600s. My grandfather R. T. Petrich, whose initials I bear, was six years old when he, along with his parents, sister and older brother left Prussia to start a new life in the USA. My own childhood memories include many visits to the family homestead in Dakota Territory, where I used to play in the barn which hosted many summer dances. The Dakota sky was vast by day, and nights could become magical with the addition of the Northern Lights. Though not a professional musician, my father kept up his trumpet playing all his life. In a special way it was his "voice" — a sound that deeply imprinted all my growing up years. All of this is mixed together in my Zatten Concerto." Eddie Bass (b. 1937) is Professor Emeritus at the School of Music UNC- Greensboro. He earned his A.B., M.M., and Ph.D. degrees from UNC- Chapel Hill and taught at Marshall University before coming to UNCG in 1968. From 1985 until 1993 Dr. Bass chaired the department of � I Composition, History and Theory, and later served as coordinator of composition. Dr. Bass has composed for a variety of media, including orchestra, wind ensemble, chorus, vocal soloists and chamber ensembles. His music has been performed throughout the United States and in Canada, Britain, Russia and the Far East. He won first prize in the 1989 composition contest of the International Trombone Association for his Pas de Quotre for Trombone Quartet. Dr. Bass's compositions are published by Seesaw (New York), the BVD Press (Connecticut) and Warwick (England). A performer as well as a composer, Dr. Bass was principal trumpet of the Greensboro Symphony from 1968 to 1985. Until 2000 he was a member of the Market Street Brass, the UNCG faculty quintet. He has published articles on the music of Claude Debussy, Hector Berlioz and Gustav Mahler. In addition to his musical accomplishments, Dr. Bass keeps fit as a competitive half-marathoner and cyclist. Suite Coneertante was commissioned by Paul Neebe in 2004 and premiered in 2005 with the Chapel Hill Philharmonia, under the baton of Don Oehler. John Lambert of Classical Voice of North Carolina said about the performance, "Neebe is a spectacular player whose work this writer has long admired, and if he were an organist, one would be tempted to say he pulled out all the stops." Eddie Bass writes: "The Suite Concertante features concerto-like writing for the solo trumpet, but within a "suite" concept rather than a traditional "concerto" concept. Each movement has a distinct character, as suggested b its title; and the role of the solo trumpet in relation to that of the orchestra varies from movement to movement as well. In Alborada, or "morning song," the soloist begins with a pensive soliloquy, to which the orchestra responds. The middle section, with its Spanish flavor, is a deliberate tribute to Maurice Ravel, whose Alborada der' Grazioso was an inspiration for the movement. The March begins aggressively, with the soloist and orchestra alternating as protagonists. Lyric episodes follow, in which the solo trumpet shares the leading melodic role with sections of the orchestra. Nocturne suggests an evening in a smoky jazz club. A walking bass underpins a passacaglia, at the beginning of which the soloist seems to be standing at the bar listening. The passacaglia is twice interrupted by rhythmically free sections in which the soloist seems to comment on the goings-on, somewhat in the mood of the Alborada. Caccia is a boisterous chase led by the soloist. As in the March, solo trumpet and orchestra are frequently in friendly competition, but in the final section they come together to drive the work to a brilliant conclusion." Paul Neebe is highly accomplished across classical music genres as a soloist, orchestral musician and chamber player. The International Trumpet Guild praises his "crystal clear sound" and "ringing articulation," and the Slovak music magazine Hudobny zivot sums up his playing in one word: "virtuosity." Neebe performs widely as a soloist across the Eastern United States and throughout Europe, where he has appeared with the Goethe Institute Cultural Program in Rothenburg ob der Tauber, Germany, as well as in Norway and Slovakia. He currently serves as principal trumpet of the Roanoke Symphony Orchestra and the Wintergreen Festival Orchestra and is the trumpet mentor of the National Music Festival in Chestertown, Maryland. Neebe has been praised for his commitment to the commissioning and recording of contemporary American works for the trumpet. Neebe's CD Te Deum (MDG 2003) includes the first of his commissions from American Composer Roger Petrich, Prayer and Epilogue, a work for trumpet and organ, premiered and recorded in Germany. His CD American Trumpet Concertos (Albany Records 2005) with the Slovak Radio Symphony Orchestra consists of all world premieres of trumpet with orchestra compositions. For this new CD, 21" Century American Trumpet Concertos, Neebe commissioned, recorded and premiered each of the compositions.
