BACKGROUND: The Board of County Commissioners reviews proposals to be considered at public hearing for consistency with general County policy and presentation format. The following items are proposed for consideration at the November 20, 2006 Quarterly Public .Hearing. A. PUBLIC HEARING ITEMS 1. Zoning Atlas Amendment: Request by Brian and Lydia Gilmour to rezone a portion of their property at 6500 Yarborough Road (TMBL 3.54..2A) from Existing Commercial-V (EC-5) to Agricultural Residential (AR). There is an undeveloped portion of the property zoned EC-5 and applicants desire to eliminate the EC-5 zoning designation altogether. 2. Hillsborough & Orange County Strategic Growth Plan Report: Presentation of findings and recommendations contained in the Plan prepared jointly by a Town of Hillsborough/Orange County Steering Committee with the assistance of planning consultants. The focus will be on areas of County jurisdiction surrounding the Town and developing a framework for the exchange of information and approval of developments as well as defining a boundary within which the Town can be expected to grow and provide public services. Citizen comment and Board direction is sought on future actions which may include: • Adoption of the Small Area Plan; and • Recommended amendments to County plans, ordinances, and agreements necessary for implementation of the small area plan. 2 , 3. Zoning Ordinance Text Amendments: Text amendments to Section 6.23 entitled `Extra Requirements for Watershed Protection Overlay Districts' to align the text with the zoning atlas boundaries for the Upper Eno Watershed. 4. Zoning Ordinance Text Amendments: Staff initiated amendments to Sections 6.23.7 through 6.24.3 -Stream Buffers - to include new regulations: • Establishing formal stream buffer replacement standards in cases where a stream buffer has been disturbed or needs to be re-established as the result of new development; and • Creation of new regulations allowing for minimal disturbance within an identified stream buffer for specific types of development (i.e. docks, boat houses, trails and greenways, etc.) as well as mitigation standards. 5. Subdivision Regulations Text Amendments: Planning Board and staff initiated amendments to Section IV-B, Conservation-Cluster Option, to modify the perimeter buffer standards to distinguish and develop comparable dimensions between urban versus rural design subdivisions. 6. Cultural and Archaeological Survey Required for Special Use Permits: To add provisions to Section 8 of the Zoning Ordinance to incorporate the requirement of a Cultural and Archaeological Survey as a submittal requirement of a Special Use Permit. B. NON-PUBLIC HEARING ITEMS (Each projected to take about five minutes) 1. Efland-Mebane Small Area Plan (EMSAP) Implementation Focus Group Update: The Focus Group has been identifying implementation measures to be pursued for each of the plan recommendations along with the entities and/or groups that should be involved with each measure. Depending on the recommended order of implementation, it is possible that some implementing regulations could be presented at the February 2007 Quarterly Public Hearing. 2. NC 57 Small Area Plan Task Force Update: A status report on the work of the Task Force will be presented along with a proposed timeline for completion of the Plan and presentation at a future public hearing. 3. Sedimentation and Erosion Control Ordinance: The NC Department of Environment and Natural Resources (DENR) Land Quality Section has completed a technical audit of the County's Erosion Control program and suggested 15 amendments/changes designed to strengthen the County's Ordinance and enhance compliance with the State's 2006 Model Ordinance. A strategy and timeline for addressing the suggested amendments will be presented. 4. Zoning Ordinance Article 9 (Signs) and Article 12 (Landscaping and Buffer Requirements): In support of the Churton Street Revitalization Project, staff suggests general amendments and a timeline for completion will be presented. 5. Traffic Impact Requirements: Text amendments to Zoning Ordinance (Article 13) and Subdivision Regulations (Section IV-B-3-e) to lower the threshold at which a traffic impact study is required (currently 80 lots or 800 trips per day) and possible transportation improvement standards. Possible presentation at February 2007 Quarterly Public Hearing. FINANCIAL IMPACT: Other than advertising costs which are included in the FY 2006-07 Budget, there are no direct financial impacts associated with the approval of this item. RECOMMENDATIO.N(S): The Manager recommends approval of the proposed November 20, 2006 Joint Quarterly Public Hearing legal advertisement. 4 NOTICE OF JOINT PUBLIC HEARING ORANGE COUNTY BOARD OF COMMISSIONERS ORANGE COUNTY PLANNING BOARD A joint public hearing will be held in the Judge F. Gordon Battle Superior Courtroom of the New Orange County Courthouse, 106 E. Margaret Lane, Hillsborough, North Carolina, on Monday, November 20, 2006, at 7:30 PM for the purpose of giving all interested citizens an opportunity to speak for or against the following items: A. PUBLIC HEARING ITEMS 1. Zoning Atlas Amendment: Request by Brian and Lydia Gilmour to rezone a portion of their property at 6500 Yarborough Road (TMBL 3.54..2A) from Existing Commercial-V (EC-5) to Agricultural Residential (AR). There is an undeveloped portion of the property zoned EC-5 and applicants desire to eliminate the EC-5 zoning designation altogether. Purpose: To receive citizen comment on a proposed rezoning request to eliminate an existing EC-5 zoning designation that was improperly applied during the initial zoning of Cheeks Township. This is part of an ongoing effort to identify improperly zoned property in the County and correct the official Zoning Atlas. 2. Hillsborough and Orange County Strategic Growth Plan Report: Growth pressures within the Town of Hillsborough, as well as in adjacent areas of Orange County jurisdiction where the Town provides public services, prompted the Town and County to enter into a joint planning process. A Town of Hillsborough and Orange County Steering Committee has worked for the past year with the assistance of planning consultants to prepare the Strategic Growth Plan. The Plan is intended to clarify the most desirable rate, timing, and location for growth occurring over the next 20 years within and around the Town of Hillsborough. Purpose: To present findings and recommendations contained in the jointly prepared plan. Citizen comment and direction from the Board of County Commissioners is sought on future actions which may include: • Adoption of the Small Area Plan; and • Recommended amendments to County plans, ordinances, and agreements necessary for implementation of the small area plan. 3. Purpose: To receive citizen comment on the proposed text amendments designed to establish appropriate standards to mitigate encroachment into required stream buffers as the result of new development or the re-establishment of previously disturbed buffer areas. 5. Subdivision Regulations Text Amendments: Planning Board and staff initiated amendments to Section IV-B, Conservation-Cluster Option, to modify the perimeter buffer standards to distinguish and develop comparable dimensions between urban versus rural design subdivisions. Purpose: To receive citizen comment on amendments that address buffer widths, vegetative requirements, and landscaping/planting requirements for subdivisions following the Conservation Cluster Option of Flexible Development. 6. Cultural and Archaeological Survey Required for Special Use Permits: To add provisions to Section 8 of the Zoning Ordinance to incorporate the requirement of a Cultural and Archaeological Survey as a submittal requirement of a Special Use Permit. Purpose: To receive citizen comment on a proposal to require evaluation of property associated with a Special Use Permit application in order to determine if cultural or archaeological resources are present. B. NON-PUBLIC HEARING ITEMS 1.
